Prior to Kripke's seminal work on the semantics of modal logic, McKinsey offered an alternative interpretation of the necessity operator, inspired by the Bolzano-Tarski notion of logical truth. According to this interpretation, `it is necessary that A' is true just in case every sentence with the same logical form as A is true. In our paper, we investigate this interpretation of the modal operator, resolving some technical questions, and relating it to the logical interpretation of modality and some views in (...) modal metaphysics. In particular, we present an hitherto unpublished solution to problems 41 and 42 from Friedman's 102 problems, which uses a different method of proof from the solution presented in the paper of Tadeusz Prucnal. Restatements of the law are usually considered a uniquely American phenomenon, explained by the complexities and uncertainties of a multi-jurisdictional common law system. They have also been subject to the accusation from legal realists that they are misleading, conservative and formalistic exercises. This review interrogates the role of the restatement in a jurisdiction with a singular common law tradition, focusing on Andrew Burrows’ recent Restatement of the English law of Unjust Enrichment. It compares and contrasts his restatement with previous American (...) restatements and with other types of ‘public statement’ of private Law, such as codes and legal treatises. It concludes that there may be good (and particular) reasons for restating unjust enrichment law in England and that Burrows’ work is unique in its form and purposes. This article’s central thesis is that a restatement can provide an important public platform for intellectual debate and a powerful centripetal force addressing legal fragmentation and uncertainty even in a singular common law jurisdiction. It further suggests that modernist doctrinal enterprises of this type may be more sympathetic to the critical insights of legal realism than is sometimes suggested. (shrink)

Aristotle famously held that objects are comprised of matter and form. That is the central doctrine of hylomorphism (sometimes rendered “hylemorphism”—hyle, matter; morphe, form), and the view has become a live topic of inquiry today. Contemporary proponents of the doctrine include Jeffrey Brower, Kit Fine, David Hershenov, Mark Johnston, Kathrin Koslicki, Anna Marmodoro, Michael Rea, and Patrick Toner, among others. In the wake of these contemporary hylomorphic theories the doctrine has seen application to various topics within mainstream analytic metaphysics. Here, (...) appeals to form and matter are used to shed light on problems about ontology, personal identity, philosophy of mind, and philosophy of religion. I defend the truthmaker approach to counterfactuals against certain objections that Andrew Bacon has made in his paper.

In this paper two paradoxes of infinity are considered through the lens of counterfactual logic, drawing heavily on a result of Fine (2012b). I will argue that a satisfactory resolution of these paradoxes will have wide ranging implications for the logic of counterfactuals. I then situate these puzzles in the context of the wider role of counterfactuals, connecting them to indicative conditionals, probabilities, rationality and the direction of causation, and compare my own resolution of the paradoxes to alternatives inspired by (...) the theories of Lewis and Fine. Here is a quick overview of the paper. Sections 17.1 and 17.2 introduce two paradoxes of infinity that rest on certain principals concerning the logic of counterfactuals. Section 17.3 considers three possible ways to weaken the counterfactual logic that would resolve these paradoxes, and examines three concrete theories of conditionals which make those weakenings — Lewis (1973), Fine (2012a) and Bacon (2015). With the first two theories found wanting, Sect. 17.4 develops my preferred solution in (Bacon, 2015) a little further, and provides some simple models to show that the paradoxes can indeed be resolved in that framework. Understanding a patient’s story is integral to providing ethically supportable and practical recommendations that can improve patient care. Important skills include how to elicit an individual’s story, how to weave different narrative threads together, and how to assist the care team, patients, and caregivers to resolve difficult decisions or moral dilemmas. Narrative approaches to ethics consultation deepen dialogue and stakeholders’ engagement to reveal important values, preferences, and beliefs that may prove critical in resolving care challenges. Recognizing barriers to narrative inquiry, (...) such as patients who are unable or refuse to share their story, is also important. In this article we offer specific steps and guidelines that ethicists can follow to systematically elicit and construct patients’ stories. We provide a case example to illustrate how a narrative approach to ethics consultation illuminates salient ethical issues that may otherwise go unnoticed. Kit Fine develops a Fregean theory of abstraction, and suggests that it may yield a new philosophical foundation for mathematics, one that can account for both our reference to various mathematical objects and our knowledge of various mathematical truths. The Limits ofion breaks new ground both technically and philosophically.

I provide a brief history and some philosophical reflections on the development of the method of abstraction in mathematics during the late nineteenth and early twentieth century.

I propose formulating identity criteria as generic statements of ground, thereby avoiding objections that have been made to the more usual formulations.

How should politicians act? When should they try to lead public opinion and when should they follow it? Should politicians see themselves as experts, whose opinions have greater authority than other people's, or as participants in a common dialogue with ordinary citizens? When do virtues like toleration and willingness to compromise deteriorate into moral weakness? In this innovative work, Andrew Sabl answers these questions by exploring what a democratic polity needs from its leaders. He concludes that there are systematic, principled (...) reasons for the holders of divergent political offices or roles to act differently. Sabl argues that the morally committed civil rights activist, the elected representative pursuing legislative results, and the grassroots organizer determined to empower ordinary citizens all have crucial democratic functions. But they are different functions, calling for different practices and different qualities of political character. To make this case, he draws on political theory, moral philosophy, leadership studies, and biographical examples ranging from Everett Dirksen to Ella Baker, Frances Willard to Stokely Carmichael, Martin Luther King Jr. to Joe McCarthy. Ruling Passions asks democratic theorists to pay more attention to the "governing pluralism" that characterizes a diverse, complex democracy. It challenges moral philosophy to adapt its prescriptions to the real requirements of democratic life, to pay more attention to the virtues of political compromise and the varieties of human character. And it calls on all democratic citizens to appreciate "democratic constancy": the limited yet serious standard of ethical character to which imperfect democratic citizens may rightly hold their leaders--and themselves. A satisfactory theory of linguistic communication must explain how it is that, through the interpersonal exchange of auditory, visual, and tactile stimuli, the communicative preconditions for the acquisition of testimonial knowledge regularly come to be satisfied. Without an account of knowledge-yielding communication this success condition for linguistic theorizing is left opaque, and we are left with an incomplete understanding of testimony, and communication more generally, as a source of knowledge. This paper argues that knowledge-yielding communication should be modelled on knowledge (...) itself. It is argued that knowledge-yielding communication occurs iff interlocutors coordinate on truth values in a non-lucky and non-deviant way. This account is able to do significant explanatory work: it sheds light on the nature of referential communication, and it allows us to capture, in an informative way, the sense in which interlocutors must entertain similar propositions in order to communicate successfully. In this paper I argue that the enkratic principle in its classic formulation may not be a requirement of rationality. The investigation of whether it is leads to some important methodological insights into the study of rationality. I also consider the possibility that we should consider rational requirements as a subset of a broader category of agential requirements.

This paper argues that the dominance of linear models has led many sociologists to construe the social world in terms of a "general linear reality." This reality assumes (1) that the social world consists of fixed entities with variable attributes, (2) that cause cannot flow from "small" to "large" attributes/events, (3) that causal attributes have only one causal pattern at once, (4) that the sequence of events does not influence their outcome, (5) that the "careers" of entities are largely independent, (...) and (6) that causal attributes are generally independent of each other. The paper discusses examples of these assumptions in empirical work, consider standard and new methods addressing them, and briefly explores alternative models for reality that employ demographic, sequential, and network perspectives. A Physicalist Manifesto is a full treatment of the comprehensive physicalist view that, in some important sense, everything is physical. Andrew Melnyk argues that the view is best formulated by appeal to a carefully worked-out notion of realization, rather than supervenience; that, so formulated, physicalism must be importantly reductionist; that it need not repudiate causal and explanatory claims framed in non-physical language; and that it has the a posteriori epistemic status of a broad-scope scientific hypothesis. Two concluding chapters argue in (...) detail that contemporary science provides no significant empirical evidence against physicalism and some considerable evidence for it. Written in a brisk, candid and exceptionally clear style, this 2003 book should appeal to professionals and students in philosophy of mind, metaphysics and philosophy of science. (shrink)

This article addresses a still unsolved puzzle in private law regarding the proper explanation of cases in which courts make substantial awards of damages to claimants whose rights have been infringed, but who appear to have suffered no factual loss in consequence of the infringement. The paradigm examples tend to involve awards of ‘user’, license fee or ‘hypothetical bargain’ damages in cases involving interference with property rights. It suggests that existing explanations of such cases are all unsatisfactory in one or (...) another respect and posits a new and potentially more powerful explanatory thesis, drawing on Hohfeld. Such awards, it argues, compensate right-holders for the loss of legal powers associated with their primary claim-rights—in particular, the loss of powers they are accorded by the law to ‘prevent’ the infringement of certain types of primary claim right ex ante. Legal powers are thus to be regarded as assets or amenities, the loss of which is amenable to monetary compensation. (shrink)

Kant holds that in order to have knowledge of an object, a subject must be able to “prove” that the object is really possible—i.e., prove that there is neither logical inconsistency nor “real repugnance” between its properties. This is (usually) easy to do with respect to empirical objects, but (usually) impossible to do with respect to particular things-in-themselves. In the first section of the paper I argue that an important predecessor of Kant’s account of our ignorance of real possibility can (...) be found in Locke’s Essay Concerning Human Understanding. In the middle sections I discuss the way in which our inability to prove the real possibility of things-in-themselves motivates Kant’s famous prohibition on certain kinds of knowledge-claims about them. In the final section I examine Hegel’s attempts to dissolve this problem of real repugnance and thereby remove an inherited obstacle to speculative knowledge of the supersensible. -/- . (shrink)

Empirical work has lately confirmed what many philosophers have taken to be true: people are ‘biased toward the future’. All else being equal, we usually prefer to have positive experiences in the future, and negative experiences in the past. According to one hypothesis, the temporal metaphysics hypothesis, future-bias is explained either by our beliefs about temporal metaphysics—the temporal belief hypothesis—or alternatively by our temporal phenomenology—the temporal phenomenology hypothesis. We empirically investigate a particular version of the temporal belief hypothesis according to (...) which future-bias is explained by the belief that time robustly passes. Our results do not match the apparent predictions of this hypothesis, and so provide evidence against it. But we also find that people give more future-biased responses when asked to simulate a belief in robust passage. We take this to suggest that the phenomenology that attends simulation of that belief may be partially responsible for future-bias, and we examine the implications of these results for debates about the rationality of future-bias. Empirical evidence suggests that a majority of people believe that time robustly passes, and that many also report that it seems to them, in experience, as though time robustly passes. Non-dynamists deny that time robustly passes, and many contemporary non-dynamists—deflationists—even deny that it seems to us as though time robustly passes. Non-dynamists, then, face the dual challenge of explaining why people have such beliefs and make such reports about their experiences. Several philosophers have suggested the stable-self explanation, according to which (...) what partly explains one or both of the explananda is that people believe themselves to have a stable persisting self which is imagined either as moving through time, or as being stationary, with time moving around it. This paper empirically investigates this explanation. We found, however, no evidential support for the stable-self explanation, leaving the non-dynamist but also, we will argue, the dynamist, with an extant explanatory challenge. (shrink)

In this article, we analyzed the effect of various factors on moral judgment and ethical attitudes of working persons. It was found that the effect of various socio-demographic factors on ethical attitudes varied between the two different categories of ethical issues under study, issues which involve explicit violation of laws vis-à-vis issues which involved social concerns. Our results did not support the implication of Callahan’s hypothesis that males are more sensitive to rule-based ethical issues while women are to issues involving (...) social concerns; it was found that females have a lower acceptability of unethical behaviors related to both categories of issues in Hong Kong, whereas gender effect was not statistically significant in Mainland China. University education also had no significant effect on ethical attitudes. Religion played an important role in affecting ethical attitudes, however, its effect varied with different types of religions; Christianity was found to be most favorable to higher ethical standards, but people of traditional Chinese religion had a higher acceptability of unethical behaviors involving social concerns compared to people with no religion. Our finding also indicated that employees in state-owned enterprises, private employees, employees in foreign-investment firms, and employers in Mainland China all had a higher acceptability of unethical law-breaking behaviors compared to workers in collectives, throwing doubt on the validity of convergence theory in Mainland China. Confucian ethics as applied to the study of business ethics often relate to the micro consideration of personal ethics and the character of a virtuous person. Actually, Confucius and his school have much to say about the morals of the public administration and the market institutions in a more macro level. While Weber emphasizes the role of culture on the development of the economy, and Marx the determining influence of the material base on ideology, we see an interaction between culture (...) – specifically Confucian business ethics – and the economy. In this paper, we are going to study this interaction in several crucial stages of development of Confucianism. The paper concludes by postulating the relevance of Confucian business ethics to the global knowledge economy. (shrink)

Researchers have documented the dominance of intensive mothering ideologies and their impact on mothers and their families. However, the effect of these ideologies on childless women has received little attention. I draw on interview data to examine the parenting ideologies of childless women with electively frozen eggs. I demonstrate that incorporation of and commitment to intensive mothering ideologies affect fertility decision making among these childless women. I find that concerns about the heavy burdens of intensive motherhood, coupled with unsupportive partners (...) and workplaces, produce ambivalence toward childbearing and a strategy of fertility postponement. I extend the literatures on intensive mothering, reproductive decision making, assisted reproductive technologies, and elective egg freezing by identifying egg freezing as an expression of the gendering of fertility risk and as a means of “doing security.” Participants view egg freezing as a means of managing risk in two primary ways: as a means of securing access to biogenetic motherhood by managing biological risks of infertility and fetal genetic abnormality, and as a means of enabling intensive parenting by managing temporal risks inherent in coordinating careers, relationships, and childbearing. Plagiarism is a problematic issue in universities across the globe (Curtis & Vardanega, 2016 ). This study explored the relationship between negative emotionality and positive attitudes toward plagiarism through the mediation of academic self-efficacy and self-control. Negative emotionality was examined as three components: stress, anxiety, and depression. Self-report surveys were completed by 454 university students to investigate the relationship between negative emotionality and positive attitudes toward plagiarism, as well as the mediating role of academic self-efficacy and self-control in this relationship. The hierarchical multiple regression found that negative emotionality significantly predicted positive attitudes toward plagiarism over and above age and gender (i.e., where male students and younger students were more likely to plagiarise). Furthermore, three mediation analyses showed that academic self-efficacy and self-control mediate the relationship between positive attitudes toward plagiarism and each component of negative emotionality. Considering these results, subsequent research should investigate whether implementing strategies that alleviate stress, anxiety, and depression could increase academic self-efficacy and self-control, which in turn, could then reduce positive attitudes toward plagiarism. This is the first book-length treatment of the relationship between citizenship and the environment. Andrew Dobson argues that ecological citizenship cannot be fully articulated in terms of the two great traditions of citizenship - liberal and civic republican - with which we have been bequeathed. He develops an original theory of citizenship, which he calls 'post-cosmopolitan', and argues that ecological citizenship is an example and an inflection of it. Ecological citizenship focuses on duties as well as rights, and these duties (...) are owed non-reciprocally, by those individuals and communities who occupy unsustainable amounts of ecological space, to those who occupy too little. This introduction to mathematical logic starts with propositional calculus and first-order logic. Topics covered include syntax, semantics, soundness, completeness, independence, normal forms, vertical paths through negation normal formulas, compactness, Smullyan's Unifying Principle, natural deduction, cut-elimination, semantic tableaux, Skolemization, Herbrand's Theorem, unification, duality, interpolation, and definability. The last three chapters of the book provide an introduction to type theory (higher-order logic). It is shown how various mathematical concepts can be formalized in this very expressive formal language. This expressive notation facilitates proofs (...) of the classical incompleteness and undecidability theorems which are very elegant and easy to understand. The discussion of semantics makes clear the important distinction between standard and nonstandard models which is so important in understanding puzzling phenomena such as the incompleteness theorems and Skolem's Paradox about countable models of set theory. Some of the numerous exercises require giving formal proofs. A computer program called ETPS which is available from the web facilitates doing and checking such exercises. Audience: This volume will be of interest to mathematicians, computer scientists, and philosophers in universities, as well as to computer scientists in industry who wish to use higher-order logic for hardware and software specification and verification. Are there, in addition to the various actual objects that make up the world, various possible objects? Are there merely possible people, for example, or merely possible electrons, or even merely possible kinds? We certainly talk as if there were such things. Given a particular sperm and egg, I may wonder whether that particular child which would result from their union would have blue eyes. But if the sperm and egg are never in fact brought together, then there is no (...) actual object that my thought is about. Or again, in the semantics for modal logic we presuppose an ontology of possibilia twice over. For first, we countenance various possible worlds, in addition to the actual world; and second, each of these worlds is taken to be endowed with its own domain of objects. These will be the actual objects of the world in question, but they need not be actual simpliciter, i.e., actual objects of our world. What are we to make of such discourse? There are four options: (i) the discourse is taken to be unintelligible; (ii) it is taken to be intelligible but nonfactual, i.e. as not in the business of stating facts; (iii) it is taken to be factual but reducible to discourse involving no reference to possibilia; (iv) it is taken to be both factual and irreducible. These options range from a full-blooded form of actualism at one extreme to a full-blooded form of possibilism at the other. The two intermediate positions are possibilist in that they accept the intelligibility of possibilist discourse but actualist in that they attempt to dispense with its prima facie commitment to possibilia. All four positions have found advocates in the literature. Quine, in his less irenic moments, favours option (i); Forbes advocates option (ii), at least for certain parts of possibilist discourse; many philosophers, including Adams and myself, opt for (iii); while Lewis and Stalnaker have endorsed versions of (iv), that differ in how full-blooded they take the possible objects to be.. This book expounds the transcendental realist theory of science and critical naturalist social philosophy that have been developed by Bhaskar and are used by many contemporary social scientists. It defends Bhaskar's view that the possibility and necessity of experiment show that reality is structured and stratified, his use of this idea to develop a non-reductive explanatory account of human sciences, and his notion that to explain social structures can sometimes be to criticize them. After a discussion of the uses of (...) critical realism in controversial areas of social science, Bhaskar's optimism about the prospects of human sciences is criticized. (shrink)

This essay considers Kant’s theory of modality in light of a debate in contemporary modal metaphysics and modal logic concerning the Barcan formulas. The comparison provides a new and fruitful perspective on Kant’s complex and sometimes confusing claims about possibility and necessity. Two central Kantian principles provide the starting point for the comparison: that the possible must be grounded in the actual and that existence is not a real predicate. Both are shown to be intimately connected to the Barcan formulas, (...) and Kant’s views on what he distinguishes as three different kinds of modality are then considered in light of this connection.
