This paper primarily reports the findings of content analyses of seventy-five codes of ethics ofFinancial Post 500 corporations. The contents of each code were comprehensively evaluated along sixty-one criteria according to four levels. It was found that the focus of these codes was the protection of the firm. While some of them refer to issues of social responsibility, they are principally concerned with conduct against the firm.

In this introduction, I briefly summarize Sophia Moreau's Faces of Inequality. I situate her monograph within two highly contemporary bodies of literature — relational egalitarianism and discrimination theory — to show how it provides important insights for understanding both what it means to treat others as equals in society and how to define wrongful discrimination. Moreau's work on discrimination is of great relevance for philosophers and socio-legal theorists alike as the commentaries from the symposium contributors demonstrate, including Dale Smith, Pablo (...) The status of indirect discrimination is ambiguous in the current literature. This paper addresses two contemporary and related debates. First, for some, indirect discrimination is not truly a distinct kind of discrimination, but it is simply a legal construct designed to address distributive inequalities between groups. Second, even if one accepts that indirect discrimination is a distinct type of discrimination, the connection between the two kinds of discrimination, direct and indirect, is debated. For some, they are distinct act-types, while for (...) others, indirect discrimination should be conceived as a side effect of prior cases of direct discrimination. Sextus Empiricus (IIe-IIIe s. ap. J.-C.) est le dernier philosophe sceptique de l'Antiquite et le seul dont l'uvre soit en grande partie conservee. Son Contre les dogmatiques prend pour cible la connaissance philosophique. Cet ensemble de traites tres argumente est articule suivant la distinction, d'epoque hellenistique, entre trois parties de la philosophie, la logique, la physique et l'ethique. On donne ici la premiere traduction francaise de la premiere et plus importante partie de cet ouvrage, le Contre les logiciens, qui conteste (...) la possibilite meme de connaitre. Prenant appui sur la distinction entre " choses apparentes " et " choses cachees ", Sextus Empiricus traite en premier lieu du " critere de la verite " ou des voies d'acces a la connaissance des choses apparentes. Un long developpement doxographique qui conduit des philosophes presocratiques aux Stoiciens, aux Epicuriens et aux Academiciens precede l'expose des arguments qui plaident en faveur de l'inexistence d'un tel critere. Au livre II, Sextus Empiricus met en question, a propos des choses cachees, le " vrai " lui-meme, avant de faire ressortir la faiblesse de l'inference semiotique et celle de la demonstration. L'ouvrage porte ainsi a notre connaissance tout a la fois des doctrines dogmatiques - comme la logique stoicienne - auxquelles nous aurions moins acces sans son temoignage, et une bonne partie de l'argumentaire sceptique deploye depuis la renaissance du pyrrhonisme, a l'epoque d'Enesideme, qui serait autrement perdue. We present an age-structured model for erythropoiesis in which the mortality of mature cells is described empirically by a physiologically realistic probability distribution of survival times. Under some assumptions, the model can be transformed into a system of delay differential equations with both constant and distributed delays. The stability of the equilibrium of this system and possible Hopf bifurcations are described for a number of probability distributions. Physiological motivation and interpretation of our results are provided.

The use of predictive machine learning algorithms is increasingly common to guide or even take decisions in both public and private settings. Their use is touted by some as a potentially useful method to avoid discriminatory decisions since they are, allegedly, neutral, objective, and can be evaluated in ways no human decisions can. By (fully or partly) outsourcing a decision process to an algorithm, it should allow human organizations to clearly define the parameters of the decision and to, in principle, (...) remove human biases. Yet, in practice, the use of algorithms can still be the source of wrongful discriminatory decisions based on at least three of their features: the data-mining process and the categorizations they rely on can reconduct human biases, their automaticity and predictive design can lead them to rely on wrongful generalizations, and their opaque nature is at odds with democratic requirements. We highlight that the two latter aspects of algorithms and their significance for discrimination are too often overlooked in contemporary literature. Though these problems are not all insurmountable, we argue that it is necessary to clearly define the conditions under which a machine learning decision tool can be used. We identify and propose three main guidelines to properly constrain the deployment of machine learning algorithms in society: algorithms should be vetted to ensure that they do not unduly affect historically marginalized groups; they should not systematically override or replace human decision-making processes; and the decision reached using an algorithm should always be explainable and justifiable. His work spans some sixty years and includes original work on a diverse range of subjects, from dialectical materialism to architecture, urbanism and the experience of everyday life. The Production of Space is his major philosophical work and its translation has been long awaited by scholars in many different fields. Les démocraties s’articulent autour de deux pôles qui ne se réduisent pas l’un à l’autre, mais qui doivent communiquer constamment : la société civile et l’État. Or, l’équilibre à rechercher entre ces deux éléments est mis à mal par la consolidation de l’État administratif qui tend à autonomiser son action par rapport au reste de la société ; la société civile y est d’ordinaire exclue des prises de décisions. Cette exclusion peut toutefois être considérée positivement ou négativement. Comme il sera (...) discuté à partir des philosophies de John Dryzek et d’Iris Marion Young, on devrait tenter de penser à la fois l’inclusion de la société civile dans certaines prises de décisions étatiques et son indépendance pour favoriser sa dimension critique envers l’État. Generation of Animals is one of Aristotle's most mature, sophisticated, and carefully crafted scientific writings. His overall goal is to provide a comprehensive and systematic account of how animals reproduce, including a study of their reproductive organs, what we would call fertilization, embryogenesis, and organogenesis. In this book, international experts present thirteen original essays providing a philosophically and historically informed introduction to this important work. They shed light on the unity and structure of the Generation of Animals, the main theses (...) that Aristotle defends in the work, and the method of inquiry he adopts. They also open up new avenues of exploration of this difficult and still largely unexplored work. Contemporary political philosophers are often uncomfortable with the notion that a conception of the good life can be developed out of liberalism. Liberalism, they say, should remain neutral out of respect for pluralism. Early liberals of the nineteenth century, however, understood their project as a vindication of the good life, along with a diagnosis of what threatens it. This article attempts to build a conception of the good life from liberal values and sensibilities, yet not run afoul of the need (...) to respect pluralism. In this article I interpret John Rawls’s concept of the original position as a spiritual exercise. In addition to the standard interpretation of the original position as an expository device to select principles of justice for the fundamental institutions of society, I argue that Rawls also envisages it as a “spiritual exercise”: a voluntary personal practice intended to bring about a transformation of the self. To make this argument, I draw on the work of Pierre Hadot, a philosopher and classicist, (...) who introduced the idea of spiritual exercises as central to ancient and modern conceptions of philosophy. By reading Rawls alongside Hadot, this article portrays Rawls as a thinker deeply concerned with the question of how subjects can lead more just and fulfilling lives. It also proposes that the original position as a spiritual exercise can help defend liberalism as a social and political doctrine. (shrink)

To commemorate the 75 th anniversary of Henri Bergson’s death I present what I believe is his most vital and lasting contribution to political philosophy: his conception of human rights. This article has two goals. The first is to present Bergson’s writings on human rights as clearly and simply as possible, so as to reach the wide audience it deserves. The second is to demonstrate his relevance for contemporary human rights scholarship. To do so, I connect him to recent debates (...) in the history and historiography of human rights. I also highlight his distinctive approach to human rights as furnishing a tool for individuals to work upon and improve themselves. Cet article s’intéresse à la manière dont Aristote utilise l’hylémorphisme pour son explication de la reproduction sexuée dans la Génération des animaux. Il se concentre sur GA I 19 où Aristote établit que les menstrues sont analogues au sperma. Dans les théories de la double semence, le mâle et la femelle apportent l’un et l’autre une contribution de statut causal identique. Aristote montre au contraire que les menstrues ne sont pas du sperma ; menstrues et sperma jouent deux fonctions causales (...) différentes dans la génération : les menstrues apportent la matière et le sperma, la cause motrice et la forme. Mais l’hylémorphisme suppose qu’il existe aussi une identité entre les deux contributions, puisque la matière menstruelle est en puissance ce que les mouvements de la semence du mâle sont en entéléchie. Aristote maintient donc une identité entre les deux contributions. Il la conçoit de deux façons : le plus souvent comme une identité analogique (les menstrues sont analogues au sperma), parfois comme une identité quasi générique (semence et menstrues sont l’un et l’autre du sperma, moins élaboré dans le cas des menstrues). Aristote hésite entre ces deux solutions : dans le premier cas, le dernier résidu utile devient ou menstrues ou sperma ; dans l’autre, c’est le sperma qui devient menstrues chez la femelle ou semence chez le mâle. Aristote semble avoir hésité à considérer que le sperma est forme, chez le mâle, et matière, chez la femelle, ce qui l’aurait conduit à afficher une sorte de théorie du double sperma, chose qu’il refuse en vertu de l’identité profonde qui existe selon lui entre les menstrues et la semence du mâle. When we think of human rights we assume that they are meant to protect people from serious social, legal, and political abuses, and to advance global justice. In _Human Rights and the Care of the Self_, Alexandre Lefebvre turns this assumption on its head, showing how the value of human rights also lies in enabling ethical practices of self-transformation. Drawing on Foucault's notion of 'care of the self', Lefebvre turns to some of the most celebrated authors and activists (...) in the history of human rights–such as Mary Wollstonecraft, Henri Bergson, Eleanor Roosevelt, and Charles Malik–to discover a vision of human rights as a tool for individuals to work on, improve, and transform themselves for their own sake. Comment la notion aristotelicienne de puissance s'est-elle constituee? Comment Aristote peut-il designer du meme nom de dynamis a la fois le principe du changement et l'etre en puissance en tant qu'il est distingue de l'etre en acte? L'histoire de la dynamis correspond-elle a l'effacement d'un sens primitivement intensif, qui serait celui de la force, au profit du sens aristotelicien de potentialite? Plutot que d'aborder ces questions dans les limites d'une lecture interne du Livre Theta de la Metaphysique sur la puissance (...) et l'acte, ou meme du corpus aristotelicien, la presente recherche plonge d'abord la notion de puissance dans son histoire pre-aristotelicienne, philosophique et non-philosophique. Si les termes d'energeia et d'entelekheia, par lesquels Aristote designe ce qui est en acte, sont des neologismes qui possedent la precision du vocabulaire technique, le mot dynamis appartient au grec courant et comporte une polysemie qui complique la comprehension de son usage. Ce livre veut articuler les sens philosophiques de cette notion chez Aristote a partir de son histoire depuis Homere et Hesiode, a travers Democrite, Xenophon ou encore le corpus hippocratique. Mais l'etude des principaux textes (poetiques, politiques, medicaux, mathematiques, philosophiques) est conduite selon un fil conducteur precis, dicte par l'emploi dominant de ce terme dans la clause restrictive kata dynamin (autant que je le peux). Les significations et l'histoire de la dynamis sont reevaluees a partir de ce nouveau point de depart. L'heritage platonicien est aussi pris en compte pour degager finalement le sens de la critique aristotelicienne de la puissance, qui met en lumiere son indetermination axiologique et ontologique, sans renoncer aux sens de capacite et de force. Nous ne cherchons pas a proposer une etude lexicographique, mais a situer la pensee aristotelicienne de la puissance et de l'acte dans une histoire conceptuelle, en esperant qu'elle gagnera ainsi en coherence et en clarte. The Image of Law is the first book to examine law through the work of Gilles Deleuze, activating his thought within problems of jurisprudence and developing a concept of judgment that acknowledges its inherently creative capacity.

The chapter presents Bergson’s conception of philosophy as a way of life, as a thinking that seeks to make contact with the creativity of life as a whole. This endeavor to alter our vision of the world, and ultimately, our action and sense of being in the world, seeks to operate a “conversion of attention.” For Bergson, such a conversion is tied in with what he calls the “true empiricism” that allows us to experience and think change as that which (...) makes up living reality as a whole. Bergson conceptualizes this move beyond the human in terms of sympathy, a term employed both descriptively, to develop the notion of a sympathetic whole of life in which philosophy as a way of life resituates the self, and prescriptively, as urging us to overcome our estrangement from “the ocean of life” to which we owe our existence. This effort of sympathy takes the form of a spiritual exercise. Not limited to mere contemplation of the world, it transforms the manner in which we perceive the reality of duration and thus opens the path for a different way of living. (shrink)

Ostracism—being excluded and ignored—thwarts satisfaction of four fundamental needs: belonging, self-esteem, control, and meaningful existence. The current study investigated whether training participants to focus their attention on the here-and-now reduces distress from an ostracism experience. Participants were first trained in either focused or unfocused attention, and then played Cyberball, an online ball-tossing game for which half the participants were included or ostracized. Participants reported their levels of need satisfaction during the game, and after a short delay. Whereas both training groups (...) experienced the same degree of need-threat in the immediate measure, participants who were trained in focused attention showed more recovery for the delayed measure. We reason that focused attention would not reduce the distress during the ostracism experience, but it aided in recovery by preventing participants from reliving the ostracism experience after it concludes. L’article porte sur le rapport entre la phronèsis (prudence ou sagesse pratique) et la vertu éthique dans la conception aristotélicienne de l’action et du bonheur. La question principale est la suivante : faut-il penser, selon une conception « humienne », que, chez Aristote, les buts sont fixés par notre désir, tandis que la raison servirait de simple instrument pour déterminer les moyens de les atteindre? La thèse défendue est que la vertu de caractère donne bien le contenu des fins, mais (...) cela ne conduit pas à reléguer la phronèsis au rang de simple instrument. En effet, la phronèsis est l’excellence de la délibération sur les choses en vue d’une fin. Elle nous permet de comprendre ce que signifie avoir une fin. Pour le démontrer, l’auteur examine conjointement le fonctionnement des syllogismes délibératif et démonstratif, qui sont tous deux des arguments explicatifs. Cette comparaison permet à l’auteur d’établir que la vertu éthique donne le « que » (« quoi faire »), alors que la phronèsis permet de comprendre le « pourquoi », c’est-à-dire en vue de quelle fin l’action doit être accomplie. La vertu complète suppose de saisir le « pourquoi » ; c’est pourquoi la phronèsis a une importance éthique et est nécessaire au bonheur. (shrink)

Abundant research exists on the restructuring operations of large, publicly listed firms. However, little is known about the antecedents of layoffs in small and medium-sized enterprises (SMEs). Building on the stakeholder salience theory and arguments on social proximity, this study posits that SMEs are less likely to dismiss employees than large firms. We argue that the existence of strong interpersonal ties between employees and managers makes it hard for SME owners and managers to dismiss employees. Empirically analyzing a large sample (...) of European Union firms, the results confirm that the likelihood of layoffs is lower in SMEs than in large firms, even when performance declines. (shrink)

The work of Henri Bergson, the foremost French philosopher of the early twentieth century, is not usually explored for its political dimensions. Indeed, Bergson is best known for his writings on time, evolution, and creativity. This book concentrates instead on his political philosophy—and especially on his late masterpiece, _The Two Sources of Morality and Religion_—from which Alexandre Lefebvre develops an original approach to human rights. We tend to think of human rights as the urgent international project of protecting all (...) people everywhere from harm. Bergson shows us that human rights can also serve as a medium of personal transformation and self-care. For Bergson, the main purpose of human rights is to initiate all human beings into love. Forging connections between human rights scholarship and philosophy as self-care, Lefebvre uses human rights to channel the whole of Bergson's philosophy. (shrink)

A collection of eight studies on Theophrastus' Metaphysics, presenting an overview of the first reception of Aristotle.

The French Marxist philosopher and sociologist Henri Lefebvre meditates on the relationship between jouissance, space, and architecture. Commissioned as a part of a study on tourist new towns in Spain, the book identifies spaces devoted to pleasure, enjoyment, sensuality, and desire as sites where the possibilities for a society moving beyond Fordism are manifested. In order to study these possibilities, architecture needs to be redefined as a mode of imagination rather than being restricted to a specialized practice or a (...) collection of monuments. Taking the practices of habitation as the starting point of the inquiry, Toward an Architecture of Enjoyment is understood as a production of space on all scales, from the domestic interiors, through urban spaces, to landscapes. Extending the focus of the book from “architecture” to “space of jouissance” within a transdicisplinary perspective, Lefebvre opens the discussion towards questions of subversive spaces, rhythmanalysis of the body, and pedagogy of senses. He proposes a Marxist take of architecture different from and alternative to the voice of Manfredo Tafuri, which since then has dominated critical architectural theory and history. Toward an Architecture of Enjoyment not only fundamentally changes our view on French and international architecture culture after 1968 but it gives new impulses for today’s debates about architecture and the urban society.
