Particle indistinguishability has always been considered a purely quantum mechanical concept. In parallel, indistinguishable particles have been thought to be entities that are not properly speaking objects at all. I argue, to the contrary, that the concept can equally be applied to classical particles, and that in either case particles may (with certain exceptions) be counted as objects even though they are indistinguishable. The exceptions are elementary bosons (for example photons).

We demonstrate that the quantum-mechanical description of composite physical systems of an arbitrary number of similar fermions in all their admissible states, mixed or pure, for all finite-dimensional Hilbert spaces, is not in conflict with Leibniz's Principle of the Identity of Indiscernibles (PII). We discern the fermions by means of physically meaningful, permutation-invariant categorical relations, i.e. relations independent of the quantum-mechanical probabilities. If, indeed, probabilistic relations are permitted as well, we argue that similar bosons can also be discerned in all (...) their admissible states; but their categorical discernibility turns out to be a state-dependent matter. In all demonstrated cases of discernibility, the fermions and the bosons are discerned (i) with only minimal assumptions on the interpretation of quantum mechanics; (ii) without appealing to metaphysical notions, such as Scotusian haecceitas, Lockean substrata, Postian transcendental individuality or Adamsian primitive thisness; and (iii) without revising the general framework of classical elementary predicate logic and standard set theory, thus without revising standard mathematics. This confutes: (a) the currently dominant view that, provided (i) and (ii), the quantum-mechanical description of such composite physical systems always conflicts with PII; and (b) that if PII can be saved at all, the only way to do it is by adopting one or other of the thick metaphysical notions mentioned above. Among the most general and influential arguments for the currently dominant view are those due to Schrodinger, Margenau, Cortes, Dalla Chiara, Di Francia, Redhead, French, Teller, Butterfield, Giuntini, Mittelstaedt, Castellani, Krause and Huggett. We review them succinctly and critically as well as related arguments by van Fraassen and Massimi. (shrink)

I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory. This paper discusses the results of the international applied research project ‘UniDiversity – Universities Towards Diversity’ that examined what discriminatory attitudes, beliefs and behaviours based on sexual orientation, gender identity and sex characteristics (SOGISC) exist in the Lithuanian, Greek and Italian academic environment. Specifically, this paper analyses how LGBTI+ individuals conceive of different forms of discrimination in the Lithuanian academic environment. The paper fills the knowledge gap in terms of intolerance and discrimination against LGBTI+ individuals at Lithuanian higher education institutions (...) and provides its theoretical explanation. By focusing on the empirical data collected from survey and focus group interviews, the paper interprets them within the framework of both the sociopolitical context and theoretical debates about heteronormative attitudes. The paper argues that there exists a gap between the declarative openness to LGBTI+ people within Lithuanian universities and persisting stereotypes and discriminatory attitudes towards them. Rapid advancement of technologies continues to revolutionize healthcare foundations and outlook. Technological progress in medicine are not only continuing to improve quality of individual life but also generally improving quality of healthcare services. As a matter of fact, the most significant change in healthcare systems was the shift from standardized, patronizing and rigid physician–patient relationship to more patient-focused, personalized and participatory practice. With this shift came increased attention to the assurance of patient’s right to autonomy. Therefore, this article aims to (...) discuss principal problematic aspects of patient’s right to autonomy hereby the patient’s role in the context of technologies and innovation. It is argued, that one of the effective ways to ensure patient’s right to autonomy is implementation of legal instruments, such as informed consent, advance directives and Ulysses contracts. However, this article also proposes, that with a potential of new technologies and artificial intelligence, these legal instruments need to be reconsidered and transformed in more efficient and eligible model, presenting information in more individualized, appealing and convenient manner. I find it hard to disagree that psychopathology is soaked in philosophy from its origins, and that to try (...) and dry it out would be both unwise and impossible.In this commentary, I go back to Karl Jaspers' account of the role of philosophy in his General Psychopathology. In doing so, I do not find that Gibson adds anything new, but instead gives us a well-illustrated reminder that philosophy "is operative within every living science" (Jaspers, 1997, p. 770).Situated Psychopathological TheorizingGibson addresses a broad 'we' who might be engaged with psychopathological theorizing. This seems to encompass three main settings, from which examples are drawn.1. Everyday and regulative social practices (ordinary and legal setting).2. Empirically driven disciplines which work with psychopathological constructs (academic setting).3. Psychiatry and psychotherapy (clinical setting).In my view, it is a mistake not to map the terrain where psychopathological theorizing is situated. In each setting psychopathological theorizing has its own set of aims and constraints. In the ordinary setting, the aim might be to know whether to blame a loved one for their action. In the legal setting it might be to decide whether treatment or punishment is appropriate. In the clinical setting, the aim is usually a therapeutic assessment, and moral stance taking is often best kept at bay. In the academic setting, we might want to ensure our concepts are reliable and valid, opening them up to investigation using objective scientific methods. [End Page 13]Beyond what can be said in the most general terms, the role of philosophy will look different in these different situations.Understanding Is Not (Just) a Philosophical ToolUnderstanding is a mode of knowing that is concerned with the particular, rather than the general, and accessed inter-relationally, relying on tacit knowledge and empathetic imagination. Gibson introduces the concept as an elementary form of social intuition, used in ordinary life to make sense of social relations and other people's behaviors and reactions. I agree with Gibson, drawing on Strawson, that Understanding is a mode of knowledge that involves the subject of enquiry as a participant (Strawson, 1982). There is a moral imperative to take this stance, which drives us to value the expansion of what we are able to understand of other people's mental states. This at least partly motivates the agenda when we theorize about psychopathology.At times throughout his argument, Gibson seems to be arguing for the role of Understanding in psychopathological theorizing, in place of his explicit aim of arguing for the role of philosophy. However it is not at all clear that this replacement can be made. Accepting the picture drawn, Understanding is not any more the expertise or domain of the philosopher than the author, police officer, or sociologist. We are surely not meant to take Understanding as a uniquely philosophical tool, but rather a mode of knowing available to all social agents, integral to social reasoning in ordinary life and in the human studies.What philosophy can distinctively do is point to and defend the existence of forms of intersubjective and tacit knowledge within human studies such as psychopathology. For Jaspers, Understanding can be a scientific tool, albeit one that reminds us that knowledge in psychopathology is not all of one kind. One role for philosophy therefore is to help us to "distinguish the different modes of knowing," so that we might "order knowledge into a comprehensive whole" (Jaspers, 1997, p. 769). Democracy is commonly associated with political equality and/or majority rule. This essay shows that these three ideas are conceptually separate, so the transition from any one to another stands in need of further substantive argument, which is not always adequately given. It does this by offering an alternative decision-making mechanism, called lottery voting, in which all individuals cast votes for their preferred options but, instead of these being counted, one is randomly selected and that vote determines the outcome. In this review of the Korean cloning scandal involving Woo-Suk Hwang, the nature of the disaster is documented and reasons why it occurred are suggested. The general problems it raises for scientific research are highlighted and six possible ways of improving practice are offered in the light of this case: better education of science students; independent monitoring and validation; guidelines for tissue donation for research; fostering of debate about ethically contentious research in science journals; development of an international code of (...) ethical research practice; fostering of public involvement in ethical review and debate through the web. The paper defends a view of structural realism similar to that of French and Ladyman, although it differs from theirs in an important respect: I do not take indistinguishabiity of particles in quantum mechanics to have the significance they think it has. It also differs from Cao's view of structural realism, criticized in my "Critical Notice: Cao's `The Conceptual Development of 20th Century Field Theories".

Category Theory has developed rapidly. This book aims to present those ideas and methods which can now be effectively used by Mathe­ maticians working in a variety of other fields of Mathematical research. This occurs at several levels. On the first level, categories provide a convenient conceptual language, based on the notions of category, functor, natural transformation, contravariance, and functor category. These notions are presented, with appropriate examples, in Chapters I and II. Next comes the fundamental idea of an adjoint (...) pair of functors. This appears in many substantially equivalent forms: That of universal construction, that of direct and inverse limit, and that of pairs offunctors with a natural isomorphism between corresponding sets of arrows. All these forms, with their interrelations, are examined in Chapters III to V. The slogan is "Adjoint functors arise everywhere". Alternatively, the fundamental notion of category theory is that of a monoid -a set with a binary operation of multiplication which is associative and which has a unit; a category itself can be regarded as a sort of general­ ized monoid. Chapters VI and VII explore this notion and its generaliza­ tions. Its close connection to pairs of adjoint functors illuminates the ideas of universal algebra and culminates in Beck's theorem characterizing categories of algebras; on the other hand, categories with a monoidal structure lead inter alia to the study of more convenient categories of topological spaces. Analyzing two key figures in Elif Shafak’s novel The Island of Missing Trees—a schoolgirl’s scream and a narrating fig tree—this essay analyzes the intersection between susceptibility and resilience, particularly as these terms are developed in psychology, trauma studies, and ecology. I argue that the novel’s resonant scream critiques the discourse of psychological resilience on multiple counts: its inadequacy as a response to complex trauma, its focus on autonomous individuals, its assumption that responsibility for resilience rests on victims rather than perpetrators (...) of harm, its construction of a “resistance imperative” and its disavowal of the inequalities in access to resilience-building resources. By contrast, the novel’s fig tree, I contend, exemplifies an ecological model of resilience rooted in a recognition of the interdependence of the multiple and diverse organisms that comprise an ecosystem, and of susceptibility as an advantageous suite of capacities that are crucial to resilience. These contrasting conceptions of resilience lead me to advocate for a politics of susceptibility, an eco-psychosocial politics based on the recognition that individuals cannot become resilient on their own, through their own volition, intention, or “self-efficacy”, and that focuses instead on building systemic and sustainable forms of resilience inclusive of the diverse subjects that comprise a community, society or ecosystem; that, rather than fetishizing independence, liberty and rights, fortifies interdependence and reinforces mutual responsibilities; and that rather than exploiting susceptibility as a weakness, nurtures it as the soul of resilience itself. Article 14 Chapter I ‘The State of Lithuania’ of the Constitution of the Republic of Lithuania of 1992 reads as follows: ‘Lithuanian shall be the State language’. This principle is not new in the Lithuanian history of constitutionalization, as Lithuanian was the official language of the State in the interwar period but lost this status during the Soviet occupation. After 1988, when many political, economic and social changes crucial for further development of the State took place in Lithuania, linguistic issues (...) re-emerged. It was recognized back then that language played a vital role in the life of the State and the society, and the Lithuanian language was given back its status of the official language by the Constitution. The principle that Lithuanian is the official language of the State, enshrined in Article 14 of the Constitution of the Republic of Lithuania, was further elaborated by the Constitutional Court of the Republic of Lithuania in its rulings and judgments. According to its official constitutional doctrine, the Lithuanian language should be treated as a very specific constitutional value, as it forms the basis of the ethnic and cultural identity of the Lithuanian nation and is the guarantor of the national identity and survival. The status of Lithuanian as the official language means that the Lithuanian language must be used in all spheres of public life. The Court also holds that having this principle enshrined in Chapter I ‘The State of Lithuania’ of the Constitution implies that the Lithuanian language enjoys particular protection since the provisions of this Chapter may be amended only by a referendum. The Swiss Confederation is characterised by a long constitutional evolution that can be divided into several important periods: the Old Swiss Confederacy (13–14 C.), Helvetica (1798–1848), Mediation (1803–1814), Restoration (1815–1830), Regeneration (1830–1848) and development since 1874. It can be stated that Switzerland adopted a modern, democratic constitution early; this state is the oldest democratic republic in Europe. In 1874, many amendments to the effective Constitution were made and a lot of gaps in legal regulation came to light, which led to (...) the opinion that in order to remove those shortcomings, a few specific amendments were no longer sufficient; therefore, it was decided to make substantial changes to the Constitution. The new Constitution was approved by the people and the cantons in the referendum of 18 April 1999 and came into effect on 1 January 2000. The most significant features of this Constitution include the entrenchment of the principles of democracy, federalism, and of the state of law and social welfare. Pursuant to the principle of division of governmental powers, the governing of the state is carried out by the following federal institutions: the Federal Assembly, the Bundesrat and the Federal Court. While analysing constitutions of various countries in the legal literature, usually not only the form and the content but also the structure of the constitution is discussed. The structure of the constitution is an internal organisational order of the norms of the constitution. Although every state has a unique structure of their constitution, however, certain regularities can be discerned. The analysis of the structure of various constitutions leads to a conclusion that normally each constitution consists of the following standard structural (...) parts: the preamble, the main part, the final, transitional or additional provisions, in some constitutions there can also be annexes. The article ascertains that most of the constitutions begin with the introductory part, the preamble. Only the constitutions of several countries (e.g. Norway, the Netherlands, Belgium, Italy, Greece) contain no preamble. After analysing the preambles of the Lithuanian Constitutions adopted in 1918-1940, the Lithuanian Constitution of 1992, the Constitution of the United States of America of 1787, the Constitution of Federal Republic of Germany of 1949, and the constitutions of several Central and Eastern European countries (the Constitution of the Republic of Estonia of 1992, the Constitution of Czech Republic of 1992 and the Constitution of the Republic of Poland of 1997) it is stated that a preamble is considered as an inseparable part of an official text of a constitution. The preamble reflects the historical context and the circumstances of the adoption of a constitution, names the goals of the constitutional regulation, fortifies the values to be attained, declares the key political principles or even the fundamental human rights and freedoms, etc. Often the preamble reveals the methods of adoption of a constitution. The preamble is an important structural part of the constitution that helps to understand the established constitutional regulation. The principles enshrined in it can be considered as significant argument for the constitutional justice institutions while solving the case of whether the law or any other legal act in question contradicts with the constitution. While interpreting and applying the constitution as a single act, its separate sections, clauses or certain provisions it is necessary to take the content of the preamble into account, since no text of the constitution shall be interpreted in a way to contradict the statements of the preamble and its spirit. The preamble is not only a category of a political, ideological or philosophical nature, it undoubtedly has the legal burden, therefore it is considered to have legal validity. Constitutions usually do not contain any particular preamble amendment procedures. The preambles are characterised to have the so-called higher style; they are usually formulated not in compliance with the requirements of legal technique. Therefore, they differ from other constitutional provisions that are usually set out in official writing style according to certain rules of legal technique. (shrink)

Abstractabstract:John Stuart Mill's harm principle holds that an individual's freedom can only be restricted to prevent harm to others. However, there is an important ambiguity between a strong version, which limits legitimate interference to self-defense and therefore prohibits society from protecting third parties (those who are not its members), and a narrow version, which grants any society universal jurisdiction to prevent nonconsensual harms, no matter who is harmed. Mill sometimes appeals to the strong harm principle to preclude interference, but elsewhere (...) endorses measures (including humanitarian foreign intervention and animal cruelty laws) to protect third parties, suggesting that he subscribes only to the weak harm principle. This ambiguity regarding who it is that society has standing to protect has important implications for the scope of individual freedom. (shrink)

Ces études débordent le problème du temps chez les Stoïciens et se proposent d’établir que cette question, en apparence modeste, permet d’éclairer, et en même temps commande l’ensemble du système.Au premier abord en effet, la théorie du temps se présente comme une simple section d’un chapitre de la Physique, celui qui traite des Incorporels. Mais déjà la simple interprétation des textes transmis fait voir que cette théorie tient étroitement à d’autres théories, comme celle des incorporels en général, des catégories, de (...) la substance. Abordant ensuite les thèses majeures de la logique et de l’éthique, on s’aperçoit qu’à leur tour elles sont solidaires de la conception du temps qui, dans bien des cas, fait évanouir leur apparence de paradoxe. A cela même, il n’y a rien d’étrange, si l’on se souvient que le stoïcisme, plus que tout autre philosophie antique, constitue un système cohérent. Mais plus particulièrement, le problème du temps a dû former comme le noeud de la réflexion stoïcienne qui vise, contre les lourdes autorités de Platon et d’Aristote, à rétablir dans sa réalité et dans sa dignité, le concret, le sensible, disqualifié comme « sujet à la génération et à la corruption », c’est-à-dire, en un mot, comme « l’être dans le temps ». The article considers structuralism as a philosophy of mathematics, as based on the commonly accepted explicit mathematical concept of a structure. Such a structure consists of a set with specified functions and relations satisfying specified axioms, which describe the type of the structure. Examples of such structures such as groups and spaces, are described. The viewpoint is now dominant in organizing much of mathematics, but does not cover all mathematics, in particular most applications. It does not explain why certain structures (...) are dominant, not why the same mathematical structure can have so many different and protean realizations. ‘structure’ is just one part of the full situation, which must somehow connect the ideal structures with their varied examples. Current research in human–robot interaction often focuses on rendering communication between humans and robots more ‘natural’ by designing machines that appear and behave humanlike. Communication, in this human-centric approach, is often understood as a process of successfully transmitting information in the form of predefined messages and gestures. This article introduces an alternative arts-led, movement-centric approach, which embraces the differences of machinelike robotic artefacts and, instead, investigates how meaning is dynamically enacted in the encounter of humans and machines. Our design approach (...) revolves around a novel embodied mapping methodology, which serves to bridge between human–machine asymmetries and socioculturally situate abstract robotic artefacts. Building on concepts from performativity, material agency, enactive sense-making and kinaesthetic empathy, our Machine Movement Lab project opens up a performative-relational model of human–machine communication, where meaning is generated through relational dynamics in the interaction itself.
