This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. In his influential work, The Concept of Law, H. L. A. Hart levels several criticisms at the traditional natural law principle: lex iniusta non est lex. Although some of his criticisms have received a great deal of careful evaluation, others have not. In this paper I will focus on several ways in which Hart attempts to undermine the value of this principle. I will pay particularly close attention to his claims concerning the unfortunate effects that follow from either scholars’ or (...) ordinary citizens’ acceptance of this principle. It is my aim to show that his criticisms of this principle fail. It must be noted that my end is a modest one. I do not attempt to clear all possible objections to this principle, nor conclusively prove its value, but merely show that one set of arguments against it fails. Although this aim is surely modest, it is, I contend, nonetheless important. Investigating the relationship between morality and legality is undoubtedly one of the central tasks of legal philosophy. Since the time of Plato, natural law theories, although differing on various particulars, have proposed a powerful answer concerning this relationship. It is clear that these theories no longer receive the attention they once did, at least in part because of Hart’s objections. I intend to show that these objections fail to show the inadequacy of the lex iniusta principle. (shrink)

Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. Biopolitics and Utopia explores the intersection of biopolitics and utopian thought. As an interdisciplinary work, it addresses many salient biopolitical issues (state and medical interventions in the body, fears over scientific progress, resistance to state biopower, and ethical concerns), while also engaging in the utopian drive behind biopolitical efforts. Background The rise in genomic and biobanking research worldwide has led to the development of different informed consent models for use in such research. This study analyses consent documents used by investigators in the H3Africa (Human Heredity and Health in Africa) Consortium. Methods A qualitative method for text analysis was used to analyse consent documents used in the collection of samples and data in H3Africa projects. Thematic domains included type of consent model, explanations of genetics/genomics, data sharing and feedback of (...) test results. Results Informed consent documents for 13 of the 19 H3Africa projects were analysed. Seven projects used broad consent, five projects used tiered consent and one used specific consent. Genetics was mostly explained in terms of inherited characteristics, heredity and health, genes and disease causation, or disease susceptibility. Only one project made provisions for the feedback of individual genetic results. Conclusion H3Africa research makes use of three consent models—specific, tiered and broad consent. We outlined different strategies used by H3Africa investigators to explain concepts in genomics to potential research participants. To further ensure that the decision to participate in genomic research is informed and meaningful, we recommend that innovative approaches to the informed consent process be developed, preferably in consultation with research participants, research ethics committees and researchers in Africa. We investigated the role of honour concerns in mediating the effect of nationality and gender on the reported intensity of anger and shame in reaction to insult vignettes. Spain, an honour culture, and The Netherlands, where honour is of less central significance, were selected for comparison. A total of 260 (125 Dutch, 135 Spanish) persons participated in the research. Participants completed a measure of honour concerns and answered questions about emotional reactions of anger and shame to vignettes depicting insults in (...) which type of threat was manipulated. It was found that Spanish participants responded especially intensely to insults that threaten family honour, and that this effect of nationality on emotional reactions to threats to family honour was mediated by individual differences in concern for family honour. O presente artigo apresenta resultados de uma pesquisa que enfocou a avaliação de desempenho (AD) como um instrumento de poder utilizado na gestão de pessoas. Realizou-se um estudo de caso que utilizou entrevistas individuais com 14 participantes, sendo 4 diretores e gerentes e 10 trabalhadores da área administrativa e operacional. Para análise dos dados, utilizou-se a análise gráfica do discurso de Lane (1985). A análise dos dados indicou que os participantes (diretoria) percebiam as políticas de gestão de pessoas permeadas pela (...) ideologia dominante como uma forma de garantir a competitividade da empresa no mercado. Já os trabalhadores a percebiam como a possibilidade para o desenvolvimento profissional e a promoção. Os dados sugerem que os resultados da AD eram utilizados na gestão de pessoas apenas quando sustentavam/confirmavam as práticas e decisões da diretoria relacionadas às políticas de pessoal. Assim, a AD pode ser considerada um instrumento de poder na gestão de pessoas, porém tendo seu uso limitado a fatores externos à técnica quando subsidia as ações dos diretores. (shrink)

In Frege's Conception of Logic Patricia A. Blanchette explores the relationship between Gottlob Frege's understanding of conceptual analysis and his understanding of logic.

This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

In this volume, Peter Furlong delves into the question of divine determinism - the view that God has determined everything that has ever happened or will ever happen. This view, which has a long history among multiple religious and philosophical traditions, faces a host of counterarguments. It seems to rob humans of their free will, absolving them of all the wrongs they commit. It seems to make God the author of sin and thus blameworthy for all human wrongdoing. Additionally, (...) it seems to undermine the popular 'Free Will Defense' of the problem of evil, to make a mockery of the claim that God loves us, and to make it inappropriate for God to blame and punish us. This work carefully formulates these and other objections to divine determinism and investigates possible responses to each of them, providing systematic and balanced discussion of this major philosophical and theological debate. It describes three proposals to make cognition computationally tractable, namely: Resource Rationality, the Adaptive Toolbox and Massive Modularity. While each of these proposals appeals to evolutionary considerations to dissolve the intractability of cognition, Rich, Blokpoel, de Haan, and van Rooij argue that, in each case, the intractability challenge is not resolved, but just relocated to the level of evolution.

Husserl’s writings on sociality have received increasing attention in recent years. Despite this growing interest, Husserl’s reflections on the specific role of communication remain underexplored. In this paper, we aim to fill this gap by reconstructing the various ways in which Husserl draws systematic connections between communication and communalization. As will become clear, Husserl’s analysis converges with much more recent ideas defended by Margaret Gilbert and Naomi Eilan.

Evolutionary biology and feminism share a variety of philosophical and practical concerns. I have tried to describe how a perspective from both evolutionary biology and feminism can accelerate the achievement of goals for both feminists and evolutionary biologists. In an early section of this paper I discuss the importance of variation to the disciplines of evolutionary biology and feminism. In the section entitled “Control of Female Reproduction” I demonstrate how insight provided by participation in life as woman and also as (...) a feminist suggests testable hypotheses about the evolution of social behavior—hypotheses that are applicable to our investigations of the evolution of social behavior in nonhuman animals. In the section on “Deceit, Self-deception, and Patriarchal Reversals” I have overtly conceded that evolutionary biology, a scientific discipline, also represents a human cultural practice that, like other human cultural practices, may in parts and at times be characterized by deceit and self-deception. In the section on “Femininity” I have indicated how questions cast and answered and hypotheses tested from an evolutionary perspective can serve women and men struggling with sexist oppression. There are two prominent viewpoints regarding the nature of rationality and how it should be evaluated in situations of interest: the traditional axiomatic approach and the newer ecological rationality. An obstacle to comparing and evaluating these seemingly opposite approaches is that they employ different language and formalisms, ask different questions, and are at different stages of development. I adapt a formal framework known as SCOP to address this problem by providing a comprehensive common framework in which both approaches may be (...) defined and compared. The main result is that the axiomatic and ecological approaches are in far greater agreement on fundamental issues than has been appreciated; this is supported by a pair of theorems to the effect that they will make accordant rationality judgements when forced to evaluate the same situation. I conclude that ecological rationality has some subtle advantages, but that we should move past the issues currently dominating the discussion of rationality. (shrink)

This book explores Gilles Deleuze's contribution to film theory. According to Deleuze, we have come to live in a universe that could be described as metacinematic. His conception of images implies a new kind of camera consciousness, one that determines our perceptions and sense of selves: aspects of our subjectivities are formed in, for instance, action-images, affection-images and time-images. We live in a matrix of visual culture that is always moving and changing. Each image is always connected to an assemblage (...) of affects and forces. This book presents a model, as well as many concrete examples, of how to work with Deleuze in film theory. It asks questions about the universe as metacinema, subjectivity, violence, feminism, monstrosity, and music. Among the contemporary films it discusses within a Deleuzian framework are Strange Days, Fight Club, and Dancer in the Dark. (shrink)

Sarah Moss’ thesis that we have probabilistic knowledge is from some perspectives unsurprising and from other perspectives hard to make sense of. The thesis is potentially transformative, but not yet elaborated in sufficient detail for epistemologists. This paper interprets Mossean probabilistic knowledge in a suitably-modified Kripke framework, thus filling in key details. It argues that probabilistic knowledge looks natural and plausible when so interpreted, and shows how the most pressing challenges to the thesis can be overcome. Most importantly, probabilistic knowledge (...) can satisfy factivity in the framework, though we are not forced to accept a specific account of probabilistic “facts”. The framework also reflects Moss’ claim that old-fashioned propositional knowledge is just a limiting case of probabilistic knowledge, and all knowledge is fundamentally probabilistic. Finally, Moss endorses a failure of contraposition: for example, p implies probably p, but not probably p does not imply not p. The framework makes clear the sense in which the valid inferences regarding probably p are as Moss claims. (shrink)
