El autor abre una amplia y profunda interrogante sobre la esperanza, recordándonos que en torno a la guerra se elevan las manifestaciones a favor de la paz; teniendo éstas su expresión principal en los foros anti-globalizadores y en los consejos ecuménicos, actuando como una presión desde abajo, que moviliza las conciencias y obliga a la clase política a saldar las cuentas con la voluntad popular. Es la sociedad civil mundial tras nuevas metas de humanización y emancipación, y desarrollo de la (...) conciencia mundial de la interdependencia. The paper compares the suitability of two different epistemologies of counterfactuals—(EC) and (W)—to elucidate modal knowledge. I argue that, while both of them explain the data on our knowledge of counterfactuals, only (W)—Williamson’s epistemology—is compatible with all counterpossibles being true. This is something on which Williamson’s counterfactual-based account of modal knowledge relies. A first problem is, therefore, that, in the absence of further, disambiguating data, Williamson’s choice of (W) is objectionably biased. A second, deeper problem is that (W) cannot satisfactorily (...) elucidate modal knowledge. Third, from a naturalistic perspective, the nature of this second problem favours (EC) against (W). The paper argues against Peacocke's moderate rationalism in modality. In the first part, I show, by identifying an argumentative gap in its epistemology, that Peacocke's account has not met the Integration Challenge. I then argue that we should modify the account's metaphysics of modal concepts in order to avoid implausible consequences with regards to their possession conditions. This modification generates no extra explanatory gap. Yet, once the minimal modification that avoids those implausible consequences is made, the resulting account cannot support (...) The paper presents a dilemma for both epistemic and non-epistemic versions of conceivability-based accounts of modal knowledge. On the one horn, non-epistemic accounts do not elucidate the essentialist knowledge they would be committed to. On the other, epistemic accounts do not elucidate everyday life de re modal knowledge. In neither case, therefore, do conceivability accounts elucidate de re modal knowledge.

Causal approaches to explanation often assume that a model explains by describing features that make a difference regarding the phenomenon. Chirimuuta claims that this idea can be also used to understand non-causal explanation in computational neuroscience. She argues that mathematical principles that figure in efficient coding explanations are non-causal difference-makers. Although these principles cannot be causally altered, efficient coding models can be used to show how would the phenomenon change if the principles were modified in counterpossible situations. The problem is (...) that efficient coding models also involve difference-makers that, prima facie, cannot be characterized as non-causal in this sense. Mathematical principles always involve variables which have counterfactual relations between them. However, we cannot simply assume that these difference-makers are causal. They can also be found in paradigmatic non-causal explanations and therefore they must be characterized as non-causal in some sense. I argue that, despite appearances, Chirimuuta's view can be applied to these cases. The mentioned counterfactual relations presuppose the counterpossible conditionals that describe the modification of a relevant mathematical principle. If these conditionals are the hallmark of non-causal relations, then Chirimuuta’s criterion has the desired implication that variables in mathematical principles are non-causal difference-makers. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

Nowadays, batteries play an important role in a lot of different applications like energy storage, electro-mobility, consumer electronic and so on. All the battery types have a common factor that is their complexity, independently of its nature. Usually, the batteries have an electrochemical nature. Several different test are accomplished to check the batteries performance, and commonly, it is predictable how they work depending of their technology. The present research describes the hybrid intelligent system created to accomplish fault detection over a (...) Lithium Iron Phosphate—LiFePO4 power cell type, commonly used in electro-mobility applications. The approach is based on the cell temperatures behaviour for voltage and current specific values. Taken into account the operating range of a real system based on a LiFePO4 cell, a large set of points of operation have been used to achieve the dataset. The different behaviour zones have been obtained by clustering as a first step. Then, different regression techniques have been used over each cluster. Polynomial regression, artificial neural networks and support vector regression were the combined techniques to develop the hybrid intelligent model proposed. The intelligent system gives very good results over the operating range, detecting all the faults tested during the validation. (shrink)

A partir del diagnóstico de que la globalización socio-económica y la mundialización cultural están cambiando la forma de vivenciar el mundo, el autor señala que la espiritualidad representa la posibilidad de dar más de sí, y explora desde allí el ecosistema humano, preguntándose si éste puede dar más de sí. Afirma que la espiritualidad requerida por la situación actual se despliega en el ejercicio de la ciudadanía activa.

Resumen: Este artículo trata sobre la construcción de significados e interpretación conjunta de la obra literaria por medios digitales. Para ello, se hace una revisión a la realidad digital de la literatura y sus procesos de recepción: la lectura digital no viene determinada tanto por la naturaleza del texto como por el comportamiento del lector digital. Internet ha facilitado la creación de espacios de afinidad en los que los usuarios pueden reunirse en torno a sus aficiones, intereses u objetivos. Se (...) generan, así, comunidades de lectores en los que debaten, analizan y elaboran fanworks que, en suma, conforman el fandom. Desde esta perspectiva, es la comunidad, como inteligencia colectiva, y no el autor, la que establece los límites de la interpretación textual: decide qué es o no canónico. Todo ello permite llegar a la conclusión de que estas prácticas letradas permiten a los usuarios realizar una lectura virtualmente digital caracterizada por la sincronización y socialización de los procesos de comprensión e interpretación textual. Lo realmente interesante es la construcción del fanon pues se genera una lectura multilineal, hipertextual, transmediática, reactiva, y, sobre todo, consensuada.: This article deals with the construction of meanings and joint interpretation of the literary work by digital means. Thereby, a review of the digital reality of literature and its reception processes are made. Digital reading is not determined as much by the nature of the text as by the behavior of the digital reader. The Internet has facilitated the creation of affinity spaces where users can gather around their hobbies, interests or objectives. Thus, communities of readers are generated to debate, analyze and elaborate fanworks that, in short, make up the fandom. From this perspective, it is the community, as collective intelligence, and not the author, that sets the limits of textual interpretation: they decide what is or is not canonical. All of this allows us to conclude that these literacy practices allow users to perform a virtually digital reading characterized by the synchronization and socialization of the processes of comprehension and textual interpretation. The most interesting issue is the construction of the fanon because it generates a multilinear reading, hypertextual, transmedia, reactive, and, above all, consensus reading. (shrink)

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. In the present article, we attempt to elucidate the conceptual rela- tionship between censorship and emotional development. We employ a framework from emotion regulation studies in order to clarify how censorship works and to ex- plain why it cannot affect emotional development in the same way as the remaining types of emotional regulation. Nevertheless, we argue that, by focusing on Plato’s ac- count of censorship, and specifically of its sociocultural function, one can find that it is not a useless device (...) for emotional development. Censorship affects relevant variables in the dynamics of contraposed emotional processes that compete for dominance. (shrink)

International Accountability Standards have proliferated in the last 20 years, with the UN Global Compact as the most widely accepted principle-based standard catalyzing voluntary participation by firms. This study aims to improve understanding about the factors that determine companies’ progress in adopting principle-based standards. Drawing on the resource-based view of the firm, we examine the direct and combined influences of different organizational resources on standard implementation as perceived by 213 Spanish GC signatories. Our results reveal that the level of firm-specific (...) resources has a positive effect on the extent of GC principles implementation and that innovative capability and length of GC participation strengthen this effect. Contrary to our expectations, we find that the internationalization of firms does not have an effect on GC principles implementation. We discuss the implications of these findings for scholars and practicing managers. (shrink)

According to Essentialism, an object’s properties divide into those that are essential and those that are accidental. While being human is commonly thought to be essential to Socrates, being a philosopher plausibly is not. We can motivate the distinction by appealing—as we just did—to examples. However, it is not obvious how best to characterize the notion of essential property, nor is it easy to give conclusive arguments for the essentiality of a given property. In this paper, I elaborate on these (...) issues and explore the way in which essential properties behave in relation to other related properties, like sufficient-for-existence properties and individual essences. Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

The present paper offers a libertarian reading of one of the most important Chinese novels of the twentieth century, The Travels of Laocan, written by Chinese entrepreneur Liu E between 1903 and 1906. I start with an exposition of the ideas associated with the concept of “Asian values,” the evident cultural unviability of this notion, and how “Asian authoritarianism” has been rationalized and justified on the basis of a Hobbesian conception of human nature. Next, I examine Liu E’s life and (...) career as an entrepreneur in a highly interventionist society. Finally, I focus on his magnum opus, The Travels of Laocan, a fictionalized autobiography that explains Liu E’s philosophical and libertarian ideas. (shrink)
