Accountability is a quality often demanded of the church and its leaders today, and especially so within the Roman Catholic Church. But how should accountability itself be understood, and how might a more accountable church be achieved? This essay explores these questions from a new angle by offering a detailed ethical analysis of how accountability operates within broad-based community organizing (BBCO), a form of democratic politics with a highly developed theory and practice of accountability in which many churches already participate. (...) In dialogue with BBCO, the essay develops a constructive framework for conceptualizing accountability. It makes a case for understanding accountability principally as a property of reciprocal relationships between persons, and stresses the need to proactively cultivate and sustain relationships of accountability through ongoing democratic practices of accountability. It also highlights the role played by moral authority, power, and virtue in these relationships and practices. The essay concludes by using this framework to propose a new interpretation of the Catholic Church’s accountability crisis. It suggests a more accountable church may only be achieved when the whole people of God begin organizing themselves to build it. (shrink)

This paper presents an account of the moral boundaries of organizations. We define an organization’s moral boundary to encompass all of the actions for which it could be held morally responsible. Our theory requires us to view organizations as subjects that act in the world, rather than as objects that are used as tools; that is, it requires us to focus on corporate moral agency. We present a process model for determining whether a given action lies within an organization’s moral (...) boundary, and we discuss how an organization’s moral boundary can be created, destroyed, or modified as a result of deliberate choices by human and organizational actors. Our article contributes to the literature by conceptualizing the distinction between organizations as subjects and organizations as objects, and so clarifying the distinction between legal and moral boundaries; by recentering the discussion of boundaries on organizational actions rather than on contingent institutional features; and by adding nuance to the assignment of moral responsibility in complex organizational networks and in situations where one corporate moral agent depends upon another for its existence. Carl Menger’s theory of subjective economic value is not only one of the greatest contributions of Austrian economics, subjective value is also the received view in mainstream economics today. However, modern-day economic theory does not explicitly address the theory advanced by Menger but merely assumes that value is subjective on the basis that the experience of valuing something is no more than an expression of preference. Accordingly, contemporary economists do not appear to recognize the distinction between this understanding of value (...) and any other possible understanding of value, such as objective theories of moral value advanced in older strands of inquiry. Lacking the theoretical basis laid by Menger, subjectivity indeed appears deceptively simple: choices are made on the basis of preferences, and preferences are subjective. It would thus follow that further examination of the phenomenon of choice appears unnecessary. The aim of this paper is to present the Austrian philosophical foundations of the theory of subjective economic value and examine how this received theory has been quite significantly transformed in its transition to a neoclassical economics framework that has disposed of its theoretical basis. Public pressure is essential for providing multinational enterprises (MNEs) with motivation to follow the standards of human rights conduct set in soft-law instruments, such as the United Nations Guiding Principles on Business and Human Rights. But how does the public judge MNE involvement in human rights violations? We empirically answer this question drawing on an original survey of American adults. We asked respondents to judge over 12,000 randomly generated scenarios in which MNEs may be considered to have been involved in (...) human rights violations. Our findings reveal substantial gaps between public judgments and the standards set in soft law and the normative literature. We identify the attributes of episodes of human rights violations involving MNEs that influence public judgments, including the relationship between the MNE and the perpetrator, the practice of due diligence, and the type of abuse. These results provide insights as to when we might expect public pressure to drive MNE compliance with soft-law instruments, and they direct attention to specific standards that will likely require stronger, ‘hard’ law approaches or broader efforts to shift the public’s view. Este trabalho tem por objetivo apresentar diferentes concepções sobre a educação das crianças na perspectiva de filósofos e educadores, considerados como alguns dos autores mais representativos no estudo do tema. Trata-se de uma pesquisa de caráter bibliográfico, fundamentada na construção de conhecimentos oriundos das contribuições de autores clássicos e contemporâneos, além de estudos posteriores feitos por estudiosos e pesquisadores sobre as idéias de tais autores. Esse procedimento é necessário porque nem todos os autores trataram sistematicamente do tema em questão, mas (...) apenas abordaram-no esporadicamente em aforismos, ensaios e proposições. Assim, teremos seqüencialmente o estudo e a interpretação de algumas idéias encontradas nas obras Platão, Montaigne, Descartes, Locke, Rousseau, Kant, Vygotsky, Dewey, Piaget e Lipman. A partir da compreensão dos avanços e retrocessos no estudo da educação da criança defendemos a necessidade e a relevância do estudo dessa temática no âmbito acadêmico, particularmente, na disciplina filosofia da educação, pois conforme acreditamos, a mesma constitui um dos principais campos teóricos na contribuição para a formação de futuros educadores. Language does not have to be held as a problem for radical enactivists. The scope objection usually presented to criticize enactivist explanations is a problem only if we have a referentialist and representationalist view of the nature of language. Here we present a normative hypothesis for the great question concerning the hard problem of content, namely, on how linguistic practices develop from minds without content. We carry representational content when we master inferential relations and we master inferential relations when we (...) master normative relations, especially when we are introduced into frameworks of authorizations and prohibitions. Inspired by the anti-intellectualism of the later Wittgenstein and Brandom’s inferentialism, we present the hypothesis that language emerges from inferentially articulated action from normative elements and not from manipulation in internal mental states of contents fixed by reference to external things. Entre os temas kantianos discutidos por Nietzsche, o tradicional problema do estatuto da coisa em si é particularmente relevante para a formulação de sua própria filosofia. Por esse motivo, a compreensão de Nietzsche desse problema também se tornou um dos assuntos mais debatidos e controversos entre seus intérpretes. De forma geral, tende-se a identificar na filosofia de Nietzsche uma trajetória que o levaria da admissão de um conceito de coisa em si em sua juventude até uma negação, em sua filosofia (...) madura, da coisa em si, considerada como uma concepção contraditória. A discordância entre os comentadores surge quando se pergunta se o conceito de coisa em si que Nietzsche nega é exatamente aquilo que Kant entendia por coisa em si. Nosso trabalho pretende discutir essa questão a partir do estudo de três objeções de Nietzsche ao conceito de coisa em si, levando em consideração os aspectos históricos do problema e as soluções oferecidas pela literatura secundária. Among the Kantian issues discussed by Nietzsche, the traditional problem of the status of the thing-in-itself is particularly relevant to the formulation of his own philosophy. For this reason, Nietzsche's comprehension of this problem has also become one of the most debated and controversial subjects among his interpreters. There is a general trend among them to identify in Nietzsche's philosophy a path that would lead him from the assumption of a concept of thing-in-itself in his youth to a denial of the thing-in-itself, in his late philosophy, what is regarded as a contradictory conception. The disagreement among them takes place when it is called into question if the concept of thing-in-itself that Nietzsche denies is exactly what Kant meant by thing-in-itself. My purpose is to discuss this issue by means of a study of three objections made by Nietzsche to the concept of thing-in-itself, taking the historical aspects of the problem, as well as the solutions offered by the secondary literature, into consideration. Dos de las respuestas a la pregunta sobre la naturaleza de la comprensión lingüística —el comunitarismo y el interpretativismo—, las cuales discuto ampliamente en Escepticismo del significado y teorías de conceptos, son objeto de la crítica de Axel Barceló en su comentario al libro. En esta réplica respondo a sus objeciones mostrando que la concepción comunitarista de la comprensión de palabras está en condiciones de distinguir entre una comprensión divergente y la no comprensión, y que el enfoque interpretativista no exige (...) el conocimiento previo de las intenciones comunicativas del hablante para dar cuenta de la fijación interpretativa de su comprensión lingüística. Two answers to the question about the nature of linguistic understanding —the community view and the interpretive stance—, which I discuss in my book Escepticismo del significado y teorías de conceptos, are criticized by Axel Barceló in his short commentary. Here, I address his objections by showing that, within the community view, distinguishing between a deviant understanding and no understanding at all is possible, and that the interpretive stance does not require previous knowledge of the speaker's communicative intentions in order to explain how an interpreter could determine the meaning of his words. Does Wittgenstein have a coherent philosophy of mathematics? Here, I will be concerned with showing that the answer is positive. However, given that his life-long philosophical perspective on mathematics tends to be misleading, I focus on the specific problem posed by Paul Benacerraf in ‘Mathematical Truth’, that is: the puzzle about how to reconcile the metaphysics with the epistemology for mathematics. My aim is to show that there is an adequate anti-platonistic solution to that puzzle in the mature writings of (...) the Austrian philosopher. (shrink)

Among various case studies addressing the reception of relativity, very few deal with Portugal at either the international or the national level. The national literature on the topic has mainly concentrated on the reactions to relativity of the Portuguese mathematical community. The absence of Portuguese astronomers alongside Eddington during the 1919 expedition to Principe, then a Portuguese island, has been implicitly equated with the astronomical community's lack of interest in the event. In reception studies dealing with general relativity, analysis has (...) tended to focus on the physics and mathematics communities, less on the astronomers. Given that relativity was born at the interface of physics, mathematics and astronomy, reactions of members of these scientific communities depended on differences in shared traditions, values, problems and expectations, as well as on individual practitioners' idiosyncrasies. This paper addresses the contributions of the overlooked Portuguese astronomical community, evaluates the actions and reactions of its members to the expedition and assesses their role in the process of appropriation of relativity. Traditionally inscribed at the margins of moral and political theory, it is time, after centuries of ongoing debates originated and grounded in Modernity’s values, to reflect on the status of Feminist Theory. Defined basically as critical theory —apostille of the mainstream theory—, feminist thought can be defined as theory tout court, in so far as the egalitarian discourses are central parts of moral and political thought and feminism is philosophical. This paper addresses the ambivalent relation between feminist theory and moral-political (...) theory with a critical view that upholds an integral vision that incorporates the dimension of care into the male-stream, and takes into account gender differences as well as the division between the public and private spheres. The 1988 Brazilian Constitution establishes a right to health in two of its provisions. The first provision provides a relatively long list of social rights, which includes not only the right to health, but also the right to the determinants of health such as education, food, employment, and shelter. The second provision recognizes the two components of the right to health, namely: factors that are likely to affect a person’s health, such as access to clean water, sanitation and nutrition; and (...) medical care or health services. This second provision establishes that the right to health “shall be guaranteed by means of social and economic policies aimed at reducing the risk of illness and other hazards and by the universal and equal access to actions and services for its promotion, protection and recovery.” It also enumerates state obligations, the first and most important one being the duty of the Brazilian state to guarantee the right to health to every citizen. Recent studies of the Brazilian case suggest that successful litigation can have regressive effects and negatively impact the health care system. While the data to support this claim is not conclusive, this paper assumes that such immediate regressive effects are indeed taking place, but asks if these are the only consequences that should be analyzed in assessing the impact of right to health litigation in Brazil. The answer is no. The current perspective adopted to assess right to health litigation in (...) Brazil is too narrow. Other consequences can and should be considered in analyzing the overall impact of litigation. To go beyond the set of questions asked by the existing experts on the topic, this paper analyzes whether the right to health litigation in Brazil has the potential, and could be generating: (i) policy changes within the health care system; (ii) institutional changes within the health care system; and (iii) institutional changes outside the health care system. After presenting anecdotal evidence that suggests these three types of changes may be happening in Brazil, I conclude the paper by discussing what would be required to assess them, and how these changes may affect our overall assessment of the more immediate and supposedly negative impact that litigation has had on the system. We attempt to offer a new interpretation of Schlegel’s original solution for the problem of the new mythology. We claim that, while grasping the problem of the missing center as the structure of modern thought, Schlegel develops a theory of literature which implies an ontology of time. We advance that, by identifying myth with romantic literature, Schlegel’s argumentative economy leads him to apply the metaphysical predicates of myth to romantic literature as such. We propose then to read the status of (...) literary forms as constituting the substance which precedes them but, paradoxically, only exists through them. (shrink)

Aristotle’s conception of causality and the ones Modern philosophers have bequeathed us have been exhaustively discussed, although the contrast between them has not, in my opinion, been sufficiently highlighted. This paper proposes to fill this gap. I start with Aristotelian causality and his theses that causal explanation requires knowledge of causal laws and that the necessity associated with these laws presupposes the existence of causal powers. I discuss next Locke’s and Leibniz’s attempts to modernize Aristotle’s theses on causality. The third (...) part of the paper presents two paradoxes Hume identified, on the one hand, between Locke’s and Leibniz’s theses about our knowledge of causal laws and, on the other hand, between the Aristotelian thesis that there must be causal powers and the scientific practice of Modernity. Hume’s proposal to eliminate these paradoxes is also discussed. I finish with some critical remarks on the humean model about our knowledge of causal laws as compared with his contribution to the analysis of the concept of causality. (shrink)

In this paper, we analyze the legal situation regarding physician-assisted suicide in the world. Our hypothesis is that the prohibitive stance on physician-assisted suicide in most societies in the world today seems to be related to our moral attitudes toward suicide. This brings us to a discussion about life itself. We claim that the total lack of legal protection for physician-assisted suicide from international organizations and most countries in the world lies in a philosophical assumption that supports much of our (...) common beliefs about what life really is. This assumption states that life must be thought of as not belonging exclusively to the individual. We argue that this assumption is a misconception that can be heard in the debate on suicide. Consequently we endorse a different conception of life which tends to favor a pro-choice stance towards suicide and assisted death in general. This position takes the patient’s decision about when to die more seriously. We conclude that there is no reason why physician-assisted suicide does not deserve legal protection as an individual right to die under international law. (shrink)

In this article, we publish the critical edition of Andalò di Negro’s De compositione astrolabii, with English translation and commentary. The mathematician and astronomer Andalò di Negro presumably redacted this treatise on the astrolabe in the 1330s, while residing at the court of King Robert of Naples. The present edition has three purposes: first, to make available a text missing from the previous compilations of works by Andalò di Negro; second, to revise a privately circulated edition of the text; and (...) third, to help disseminating one of the rare Latin texts presenting the principles of the stereographic projection which underlie the construction of the astrolabe. Neste artigo argumentamos que os temas da ação e da história presentes em alguns contos de Jorge Luis Borges antecipam alguns pontos que apareceram nas discussões pós-estruturalistas - nos campos da história, filosofia, antropologia - das últimas décadas do século XX. No seu labirinto literário-filosófico, especialmente por meio da ideia de destino, Borges explora elementos chave que se tornaram parte da noção de crítica que enfatiza as ideias de contingência e da impossibilidade de controle deliberado dos efeitos da ação humana (...) em seu curso temporal. It is argued in this paper that the themes action and history present in some of Jorge Luis Borges's short stories have anticipated certain aspects of the post-structuralist debates - on history, philosophy, and anthropology - in the last decades of the twentieth century. In his literary and philosophical labyrinth, especially through the idea of destiny, Borges explores key elements that became part of the notion of critique that emphasize the idea of contingency and the impossibility of deliberated control of the effects of human action in its temporal course. Amidst this most terrible and brutal context, reading and re-reading the book that Alexandra Kertz-Welzel offers was both a blessing and an intense exercise of food for thought. A blessing as (...) it drives our minds through a complex but nonetheless rewarding journey into the meanders of critical and ideal visions. An exercise of food for thought as she turns to the arts, philosophy, sociology, and political theory to construct an interdisciplinary, sustained story. While rethinking “the goals of music education in view of social change,”1 the introduction describes the purpose of the study and presents the author’s chosen theoretical pillars: Levitas’s concept of utopia, Georgina Born’s four planes of music’s sociality, David Hesmondalgh’s defense of aesthetic experience, and Martha Nussbaum’s concept of human flourishing. Furthermore, Kertz-Welzel aims to answer the question of what social change is in general but also, concerning music education, to critically consider the contribution that music education can make to social change. She proposes to redefine “the general goals of music education regarding its social and musical intentions, reuniting two dimensions which have been defined as opposite, but are in fact complementary regarding [End Page 99] politically and socially responsive music education and esthetic music education.”2 I will get back later to this last intention in the context of the author’s approach to the redefinition of music education. For now, I will begin with her proposed definition of music education as utopian theory and practice, in the context of the chosen title for this book.Rethinking Music Education and Social Change is a very appealing title not only because rethinking music education is a most pressing issue within the community of music educators but also because social change, in relationship with music, has been the object of research in numerous projects, claiming the transformative power of music. This is a theme I have been very much involved with, being the co-founder of the research platform, Social Impact of Making Music (SIMM),3 that aims to systematically investigate the possible social impacts of learning and playing music. Having said that, I found myself confronted with a book that sets in the middle of its focus to thoroughly investigate the concept of utopia in its multiple facets based on a complete discussion of its theoretical basis. In that context, the fact that the title of the book does not include utopia seemed to me rather puzzling, and I intend to come back to this at the end of this review.The author presents a comprehensive and updated review of the literature, its complexities and ambivalences in the relationship between the arts and social change as it appears and has evolved across time. This approach connects social change with activism, not forgetting the issue of dramatic social change that she exemplifies with the COVID-19 pandemic, and to which we can now sadly add the present state of war. Quoting Roxane de la Sablonniére (2017) and her four typologies of social change, Kertz-Welzel highlights the fact that in the last hundred years the pace of change has increased enormously, and “dramatic social change is a threat to cultural identity.”4The notion of the arts as a political instrument is thoroughly developed, and it should be acknowledged that the author takes here, as well as in other parts of the book, a courageous standpoint. She does not avoid critical or uncomfortable issues, one of them being the ambiguity of the arts. In her discussion on social distinction and identity construction, she cites Max Weber, Georg Simmel, and Pierre Bourdieu and argues that culture has indeed been used as a way of discrimination among people. She also points out the supposedly refined taste of higher social classes cultivated through access to various arts experiences, while others would be denied these experiences and therefore unable to develop their full artistic potential... Objective: Symptom improvement is often examined as an indicator of a good outcome of accessing mental health services. However, there is little evidence of whether symptom improvement is associated with other indicators of a good outcome, such as a mutual agreement to end treatment. The aim of this study was to examine whether young people accessing mental health services who meaningfully improved were more likely to mutually agree to end treatment.Methods: Multilevel multinomial regression analysis controlling for age, gender, ethnicity, and (...) referral source was conducted on N = 8,995 episodes of care [Female = 5,469, 61%; meanAge = 13.66 years] using anonymised administrative data from young people's mental health services.Results: Compared to young people with no change in mental health difficulties, those showing positive meaningful changes in mental health difficulties were less likely to have case closure due to non-mutual agreement. Similarly, they were less likely to transfer or end treatment for other reasons than by case closure due to mutual agreement.Conclusion: The findings suggest that young people accessing mental health services whose symptoms meaningfully improve are more likely to mutually agree to end treatment, adding to the evidence that symptom improvement may be appropriate to examine as an indicator of a good outcome of accessing mental health services. We present asecond-personalaccount of corporate moral agency. This approach is in contrast to thefirst-personalapproach adopted in much of the existing literature, which concentrates on the corporation’s ability to identify moral reasons for itself. Our account treats relationships and communications as the fundamental building blocks of moral agency. The second-personal account rests on a framework developed by Darwall. Its central requirement is that corporations be capable of recognizing the authority relations that they have with other moral agents. We discuss the relevance (...) of corporate affect, corporate communications, and corporate culture to the second-personal account. The second-personal account yields a new way to specify first-personal criteria for moral agency, and it generates fresh insights into the reasons those criteria matter. In addition, a second-personal analysis implies that moral agency is partly a matter of policy, and it provides a fresh perspective on corporate punishment. (shrink)

This paper discusses the negative theology, based on the mystical discourse, as an alternative approach to the rational and positivist thought of the classical theology. Through the understanding and attempt to talk of God without the concept of being , the possibility of remaining in the theology domain will be analyzed here, but being guided rather by the search and love instead of the intellect’s descriptive interest, as it happens in mystical thought. The distinction between the positive theology and the (...) negative theology is presented in this argument as a path for thinking through and understanding God, by means of replacing the concept of being with the ideal Good, which awakens in the theologian a desire for union with the object. Love, in its appetitive meaning, becomes the adequate path for searching and meeting God, with no need for removing Him from His original condition. Therefore, the negative theology possibility reaches the extremely high level of mystique and contemplation. Keywords: God. Being. Theology. Mystique. Love. Resumo Este artigo discute a teologia negativa, sustentada sobre o discurso místico, como uma abordagem alternativa ao pensamento racional e positivista da teologia clássica. A partir da compreensão e da tentativa de falar sobre Deus sem o conceito de ser , será analisada, aqui, a possibilidade de continuar no domínio da teologia, mas se orientando mais pela busca e pelo amor e menos pelo interesse descritivo do intelecto, como acontece no pensamento místico. A distinção entre teologia positiva e teologia negativa é apresentada nesse argumento como caminho para reflexão e compreensão de Deus, a partir da substituição do conceito de ser pelo Bem ideal, que desperta no teólogo um desejo de união com o objeto. O amor, em sua acepção apetitiva, torna-se o caminho adequado para a busca e o encontro de Deus, sem a necessidade de retirá-lo de sua condição original. En esta nota critico la teoría de la interpretación de Mota Pinto, arguyendo que predice significados donde intuitivamente no debería haberlos. De paso, critico su presentación de la perspectiva comunitarista del significado, distinguiendo entre dos tipos diferentes de hechos semánticos: el que una palabra signifique lo que significa en vez de significar otra cosa, y el que una expresión signifique lo que significa en vez de no significar nada. In this brief commentary, I argue that Mota Pinto's theory (...) of interpretation predicts meanings where there are none. I also criticize his presentation of the communal perspective on meaning, drawing a distinction between two different kinds of semantic facts: a word meaning what it does rather than meaning something else, and such word meaning what it does rather than not meaning anything at all. O objetivo deste artigo é, primeiro, apresentar e considerar as críticas de Paley com mais detalhes e, em seguida, discutir algumas das aplicações significativas da fenomenologia que muitas vezes foram negligenciadas pelos pesquisadores qualitativos. Como foi amplamente demonstrado ao longo dos anos, a fenomenologia pode não apenas fazer a diferença no manuseio, análise e interpretação dos dados disponíveis, mas também em como os dados são obtidos em primeiro lugar, por exemplo, através de técnicas especiais de entrevista. Consideraremos algumas figuras centrais (...) da psicologia fenomenológica clássica e da psiquiatria fenomenológica e apresentaremos alguns dos desenvolvimentos mais recentes na ciência cognitiva. Em seguida, discutiremos três casos concretos que demonstram como a fenomenologia foi aplicada no trabalho clínico com pacientes com esquizofrenia, paralisia cerebral e negligência hemispatial.
