Online dispute resolution (ODR) is an alternative to traditional litigation that can both significantly reduce the disadvantages suffered by litigants unable to afford an attorney and greatly improve court efficiency and economy. An important aspect of many ODR systems is a facilitator, a neutral party who guides the disputants through the steps of reaching an agreement. However, insufficient availability of facilitators impedes broad adoption of ODR systems. This paper describes a novel model of facilitation that integrates two distinct but complementary (...) knowledge sources: cognitive task analysis of facilitator behavior and corpus analysis of ODR session transcripts. This model is implemented in a decision-support system that (1) monitors cases to detect situations requiring immediate attention and (2) automates selection of standard text messages appropriate to the current state of the negotiations. This facilitation model has the potential to compensate for shortages of facilitators by improving the efficiency of experienced facilitators, assisting novice facilitators, and providing autonomous facilitation. Visual research is a fast-growing interdisciplinary field. The flexibility and diversity of visual research methods are seen as strengths by their adherents, yet adoption of such approaches often requires researchers to negotiate complex ethical terrain. The digital technological explosion has also provided visual researchers with access to an increasingly diverse array of visual methodologies and tools that, far from being ethically neutral, require careful deliberation and planning for use. To explore these issues, the Symposium on Exploring Ethical Frontiers of Visual (...) Methods was held at the University of Melbourne, Australia, on 4 March 2014. The symposium was hosted by the Visual Research Collaboratory, a consortium of Australian and Canadian visual researchers, with support from Melbourne Social Equity Institute, University of Melbourne. The symposium represented the culmination of a process to develop a resource outlining principles of ethical practice for visual researchers and ethics committee members, the Guidelines for Ethical Visual Research Methods, which were launched at the event. The Guidelines present a framework for considering ethical matters in visual research, distinguishing six groups of issues united by an overarching theme: confidentiality; minimizing harm; consent; fuzzy boundaries; authorship and ownership; and representation and audiences. Freedom of information laws promote transparency by permitting individuals and organizations to obtain government documents. However, exemptions from disclosure are necessary to protect privacy and to permit government officials to deliberate freely. Deliberative language is often the most challenging and burdensome exemption to detect, leading to high processing costs and delays in responding to open-records requests. This paper describes a novel deliberative-language detection model trained on a new annotated training set. The deliberative-language detection model is a component of a decision-support (...) system for open-records requests under the US Freedom of Information Act, the FOIA Assistant, that ingests documents responsive to an open-records requests, suggests passages likely to be subject to deliberative language, privacy, or other exemptions, and assists analysts in rapidly redacting suggested passages. The tool’s interface is based on extensive human-factors and usability studies with analysts and is currently in operational testing by multiple US federal agencies. (shrink)

BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

In this analysis I apply a Foucauldian approach to ethics to examine the politically prescribed moral and ethical character required of carers of aged persons at home in Australia and the role of nurses in shaping these behaviours. The work that spousal carers provide, although often founded on love and/or obligation, has been formalized through a variety of policy initiatives and technologies that serve to construct the moral approach they must adopt. This shaping of conduct at the most personal level (...) takes place through the application of codes of behaviour policed largely by nurses. These codes redefine the mode of coexistence between an aged husband and wife and propose a new form of relationship that is derived from and supports policies of the deinstitutionalization of care services for elderly persons. In this way modern carer policy has drawn on knowledge and governance of the self to produce a morality of caring that is both authoritative and scientific. (shrink)

The Ethics of Need: Agency, Dignity, and Obligation argues for the philosophical importance of the notion of need and for an ethical framework through which we can determine which needs have moral significance. In the volume, Sarah Clark Miller synthesizes insights from Kantian and feminist care ethics to establish that our mutual and inevitable interdependence gives rise to a duty to care for the needs of others. Further, she argues that we are obligated not merely to meet others’ needs (...) but to do so in a manner that expresses "dignifying care," a concept that captures how human interactions can grant or deny equal moral standing and inclusion in a moral community. This paper considers the justifications for adhering to a principle of confidentiality within medical practice. These are found to derive chiefly from respect for individual autonomy, the doctor/patient contract, and social utility. It is suggested that these will benefit more certainly if secrecy is rejected and the principle of confidentiality is removed from the area of health care.

In three experiments, the relation between different modes of thought and the generation of “creative” and original ideas was investigated. Participants were asked to generate items according to a specific instruction . They either did so immediately after receiving the instruction, or after a few minutes of conscious thought, or after a few minutes of distraction during which “unconscious thought” was hypothesized to take place. Throughout the experiments, the items participants listed under “unconscious thought” conditions were more original. In this chapter, we critique a concept of resilience that has emerged from contemporary positive psychology and its application to health education. We argue that the present popularity of “resilience” as a strategy for managing mental health discourages educational institutions from providing students with the mental health services they need. Using the tools of American pragmatism, especially the work of John Dewey, we criticize the paradigm of resilience and identify several concrete reformulations of disability studies which would make concrete differences (...) in the lives of those with mental disability. Traditional philosophical discussions of knowledge have focused on the epistemic status of full beliefs. In this book, Moss argues that in addition to full beliefs, credences can constitute knowledge. For instance, your .4 credence that it is raining outside can constitute knowledge, in just the same way that your full beliefs can. In addition, you can know that it might be raining, and that if it is raining then it is probably cloudy, where this knowledge is not knowledge of propositions, (...) but of probabilistic contents. -/- The notion of probabilistic content introduced in this book plays a central role not only in epistemology, but in the philosophy of mind and language as well. Just as tradition holds that you believe and assert propositions, you can believe and assert probabilistic contents. Accepting that we can believe, assert, and know probabilistic contents has significant consequences for many philosophical debates, including debates about the relationship between full belief and credence, the semantics of epistemic modals and conditionals, the contents of perceptual experience, peer disagreement, pragmatic encroachment, perceptual dogmatism, and transformative experience. In addition, accepting probabilistic knowledge can help us discredit negative evaluations of female speech, explain why merely statistical evidence is insufficient for legal proof, and identify epistemic norms violated by acts of racial profiling. Hence the central theses of this book not only help us better understand the nature of our own mental states, but also help us better understand the nature of our responsibilities to each other. This is why we should encourage the efforts towards a global thought of the world. Such a worldview can help us to understand and explain reality. However, we should be critical towards a mere theoretical approach of that world. A worldview should not be confined to the (...) abilities of our mind. In this article we propose to consider the body as an agent of our encounter with the world. In this paper, we turn to the philosophy of Jean-Luc Nancy. In his work La Création du Monde ou la Mondialisation of 2002 the French philosopher analyses the process of globalisation. Rather than denoting a new homogeneity, the term refers to a world horizon characterized in its interpalpable multiplicity of cultural, socio-economical, ideological and politico-moral content. According to Nancy, globalisation refers to ag-glome-ration: the decay of what once was a globe and now nothing more than a glome. On the one (...) hand, Nancy indicates that the world has changed by an unknown increase of techno-science, the worsening of inequalities between growing populations and by the changing and disappearing of given certainties, views and identities of the world and of man. On a large scale, this deformation is due to the relation between the capitalist evolution and the capitalising of worldviews. On the other hand, due to the inter-palpability of the multiplicity, this means that on our planet there is only space for one world. The world gradually becomes the only world. In this paper we will investigate what Nancy means with the becoming-world of the world and how this relates to our being in the world. For Nancy globalisation reveals two possible destinies of our relation with the world. In La Création du Monde ou la Mondialisation he discerns globalisation from mondialisation to analyze these two possibilities. We will investigate this distinction of Nancy and its consequences for everyday life. (shrink)

This paper develops a precise understanding of the thesis of moral encroachment, which states that the epistemic status of an opinion can depend on its moral features. In addition, I raise objections to existing accounts of moral encroachment. For instance, many accounts fail to give sufficient attention to moral encroachment on credences. Also, many accounts focus on moral features that fail to support standard analogies between pragmatic and moral encroachment. Throughout the paper, I discuss racial profiling as a case study, (...) arguing that moral encroachment can help us identify one respect in which racial profiling is epistemically problematic. The research discussed in this paper centers around the convergence of extended reality (XR) platforms, computational design, digital fabrication, and critical urban study practices. Its aim is to cultivate interdisciplinary and multiscalar approaches within these domains. The research endeavor represents a collaborative effort between two primary disciplines: critical urban studies, which prioritize socio-environmental justice, and integrated digital design to production, which emphasize the realization of volumetric or voxel-based structural systems. Moreover, the exploration encompasses augmented reality to assess its utilization in (...) both the assembly process of the structures and the integration of phygital (physical and digital) data with the physical environment. Within the context of these research scopes, this paper introduces FabriCity-XR as an interactive phygital installation. In addition to presenting an overview of the integrated research driven and performative design to production methodologies, the project showcases the practical implementation of web-based augmented reality trails, eliminating the requirement for external applications for interaction. This approach allows users to seamlessly navigate and engage with phygital content overlaid on physical objects using their personal smart devices. Affektregulierung als wichtiger Bestandteil von Mentalisierung beinhaltet unterschiedliche Teilaspekte, die in der psychoanalytischen Literatur zum Thema Affekt ausführlich beschrieben werden. Der vorliegende Beitrag bespricht eine Affekttheorie aus der französischsprachigen psychoanalytischen Literatur, die die Transformation von heftigen Affektzuständen mittels Signalen und Zeichen zur Symbolisierung in Bildern und Sprache verdeutlicht.Mithilfe phänomenologischer sowie entwicklungspsychologischer Ansätze wird es möglich, zwischen den Theorien Lacans und Greens eine Brücke zu schlagen. Anhand eines kinderanalytischen Prozesses wird illustriert, wie das normale Spannungsverhältnis zwischen Affekt und Sprache aufgrund einer (...) traumatischen Vorgeschichte besonders starken Belastungen ausgesetzt sein kann. Die detaillierte Analyse klinischen Materials aus der Phase der Diagnostik und aus zwei Therapiesitzungen gibt einen Einblick in die Ängste und Kontaktwünsche eines traumatisierten Kindes und veranschaulicht, wie affektregulierende Therapie im Dienste der Symbolisierung aussehen kann. In common language, education is mostly understood as teaching. In this article, I would like to employ the hermeneutical philosophy of Merleau-Ponty to draw attention on that other etymological background of education: educere. Education as educere is about liberating or displacing our view instead of achieving a liberated view. In this sense, education does not refer to an immaterial relation of knowing or mastering , but to a relation of being . I hope to demonstrate Merleau-Ponty's philosophy of the body (...) can make us attentive to the importance of this hermeneutical and praxical character of education. After all, his thinking very aptly describes our relation to the world in terms of a corporeal being rather than in terms of a cognitive or abstract knowing. His conception of corporeality and of our being to the world deconstructs a mere formal and all too immaterial account of education. (shrink)

In a footnote of his La Communaute Desoeuvree, Jean Luc Nancy writes that it is necessary to investigate more closely the entry of myth into modern political thinking and more generally the relationship between myth and ideology (Nancy 1990, 116n). In this paper, I will explore the way in which we should understand this strange relation between myth and ideology. To do so, I will first briefly outline Nancy's now already known thinking of myth. What matters for this article, is not inasmuch the content of the politico-moral claims or the ideological scope of worldviews as described by sociological and political sciences in the process of globalization, but rather a philosophical horizon that exceeds everyday political reality. This stems from a point of view that the debate on globalization and its alternatives is still too often protruded by ideological and idealist arguments. This article (...) will scrutinize what globalization actually means, considered from a philosophical standpoint. In this article we argue that duties towards future generations are situated on the collective level and that they should be understood in terms of collective responsibility for structural injustice. In the context of climate change, it seems self‐evident that our moral duties pertain not only to the current generation but to future generations as well. However, conceptualizing this leads to the non‐identity problem: future persons cannot be harmed by present‐day choices because they would not have existed if other choices (...) had been made. Recently, Charlotte Franziska Unruh has proposed a solution that places the duties not on the individual level but on the collective level. The current generation has a responsibility for future generations as a whole. This solution is promising, but we argue that it problematically overlooks the existence of unjust relations within the contemporary collective, as we all contribute differently to bringing future generations into existence. Therefore, we propose to graft Iris Marion Young's Social Connection Model, which is concerned with structural injustice, on to the discussion of responsibility for future generations. Our proposal incorporates the strengths of Unruh's arguments, while also allowing for a differentiated responsibility based on different implications in unjust structures. (shrink)

Introduction: The humanities enrich and transform the practice of medicine. What remains to be seen, however, is how best to integrate humanities into the medical curriculum to optimize both educational and patient-related outcomes. The present study considers the structure of an innovative student-driven humanities curriculum and seeks to understand its strengths and limitations, as well as make recommendations for improvement. Methods: The Penn State College of Medicine, University Park Regional Campus uses an inquiry-based approach to education, whereby students are responsible (...) for creating learning objectives in four core pillars of exploration: Foundational Science, Clinical Science, Health Systems Science, and Health Humanities. This study explores student-derived humanities learning objectives (HLO) across four years of the curriculum. Results: 420 HLOs met criteria for analysis and were coded as instrumental (developing direct clinical skill), non-instrumental (non-skill based), or both. Of these, 125 (30%) were instrumental, 239 (57%) were non-instrumental, and 56 (13%) were coded as both. Most instrumental HLO centered around communication skills. Non-instrumental HLO most commonly focused on bearing witness and critiquing a particular experience within a social and/or political context. Conclusions: Findings from this study contribute to the development of a humanities curriculum in a student-directed learning program. Non-instrumental HLO lacked a theoretical framework to guide student’s investigations to a deeper level of analysis. Student-directed learning offers many strengths, but can be enhanced through external direction from humanities trained faculty, particularly given that many medical students have a limited humanities background. Generic generalizations such as ‘mosquitoes carry the West Nile virus’ or ‘sharks attack bathers’ are often accepted by speakers despite the fact that very few members of the kinds in question have the predicated property. Previous work suggests that such low-prevalence generalizations may be accepted when the properties in question are dangerous, harmful, or appalling. This paper argues that the study of such generic generalizations sheds light on a particular class of prejudiced social beliefs, and points to new ways in (...) which those beliefs might be undermined and combatted. Contemporary discourses surrounding adoption have a normative tone and are critical of the ways in which international adoption is power based and exploitative. These discourses have a significant influence on adoptive parents, structuring their actions and opening the door for scrutiny of individual adopters' motives and ethics. As an internationally adoptive parent, I reflect, in this article, on my experience and use it as a vantage point from which to consider alternative perspectives on the ethical debates in the extant adoption (...) literature. The insights gained from my experience can inform adoption practices and the development of more nuanced, less polarized perspectives on the ethics of international adoption and inspire new avenues of research that explore the ways in which adoptive parents navigate their socio-political contexts in ways that are ethically sensitive and workable for them. Existing discussions of legal proof address a host of apparently disparate questions: What does it take to prove a fact beyond a reasonable doubt? Why is the reasonable doubt standard notoriously elusive, sometimes considered by courts to be impossible to define? Can the standard of proof by a preponderance of the evidence be defined in terms of probability thresholds? Why is statistical evidence often insufficient to meet the burden of proof? -/- This paper defends an account of proof that addresses (...) each of these questions. Where existing theories take a piecemeal approach to these puzzles, my theory develops an insight that unifies them—namely, the thesis that legal proof requires knowledge. Although this thesis may seem radical at first, I answer several common objections to it, and I argue that it does better than several competing accounts when it comes to making sense of our intuitions about what legal proof requires. This paper motivates and develops a novel semantics for several epistemic expressions, including possibility modals and indicative conditionals. The semantics I defend constitutes an alternative to standard truth conditional theories, as it assigns sets of probability spaces as sentential semantic values. I argue that what my theory lacks in conservatism is made up for by its strength. In particular, my semantics accounts for the distinctive behavior of nested epistemic modals, indicative conditionals embedded under probability operators, and instances of constructive dilemma (...) containing epistemic vocabulary. Jean Bodin was a figure of great importance in European intellectual history, known as a jurist, associate of kings and courtiers in sixteenth-century France, and author of influential works in the fields of constitutional and social thought, historical writing, witchcraft, and a great deal else besides. Best known for his contribution to formulating the modern doctrine of sovereignty, Bodin was a scholar of exceptional range, whose works provoked controversy in his own time and have continued to do so down the (...) centuries. Hugh Trevor-Roper described him as 'the Aristotle, the Montesquieu of the sixteenth century, the prophet of comparative history, of political theory, of the philosophy of law, of the quantitative theory of money, and of so much else'. This chapter defines and defends time-slice epistemology, according to which there are no essentially diachronic norms of rationality. The chapter begins by distinguishing two notions of time-slice epistemology, and ends by defending time-slice theories of action under indeterminacy, i.e. theories about how you should act when the outcome of your decision depends on some indeterminate claim. In a recent chapter, J. Robert G. Williams defends a theory of action under indeterminacy which is subject to several objections. An alternative theory is (...) proposed in its place. The resulting discussion highlights a more general moral about action under indeterminacy, namely that time-slice theories are supported by strong analogies with ethical theories. In particular, our understanding of agents torn between interpretations of a decision situation should be guided by our theories of agents torn between incommensurable values. (shrink)

This paper argues that just as full beliefs can constitute knowledge, so can properties of your credence distribution. The resulting notion of probabilistic knowledge helps us give a natural account of knowledge ascriptions embedding language of subjective uncertainty, and a simple diagnosis of probabilistic analogs of Gettier cases. Just like propositional knowledge, probabilistic knowledge is factive, safe, and sensitive. And it helps us build knowledge-based norms of action without accepting implausible semantic assumptions or endorsing the claim that knowledge is interest-relative.

This essay reviews recent debates over the allocation of regulatory authority in three separate fields of financial regulation: corporate governance, securities regulation, and the regulation of financial institutions. In each field, the essay argues, reform proposals can be organized into three basic groups: those that advocate centralization of regulatory authority; those that favor competition among governmental bodies; and those that recommend the privatization of regulatory standards. While this debate is most familiar in the field of corporate governance, highly analogous policy (...) discussions are currently taking place in securities regulation and the regulation of financial institutions. This essay traces the development of arguments over the proper allocation of regulatory authority in various sectors of the financial services industry, noting differences both in the contexts in which the issue has arisen in various sectors of the industry and also in the ways regulatory authority is currently allocated in each sector. The essay concludes with several tentative thoughts about normative grounds on which debates over the proper allocation of regulatory authority might ultimately be resolved. (shrink)

Revisiting the successive steps that gave birth to the modern occidental subject and showing that it hasn't always existed in the way it does today is the aim of this work. Since the Pre-Socratic philosophers and Socrates, Plato and Saint Augustine, the gradual configuration of an inner space favors the formation of an autonomous subject, ontologically linked at birth. Its subsequent emancipation and transformation into a radical reflexivity during Modernity remains linked to the philosophy of Descartes, Locke, and Kant.

In former socialist countries, neoliberal reform promised to replace stagnation with growth and development. Many places, however, experienced a decade of economic decline, accompanied by rising poverty. Although even the worst performing economies managed positive growth rates by 1999-2000, this growth starts from levels as low as 36 percent of 1989 levels. Less recognized than the problem of rising poverty is the erosion of development gains in countries once characterized by high human development. This article distinguishes de-development from the widely (...) recognized issue of poverty. The authors find that transition outcomes are mixed but that de-development can be seen in parts of Central and Eastern Europe and most of the former Soviet Union. One important question is how to use renewed growth to prevent further erosion of development and to recapture lost gains. (shrink)
