In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. The 2008 crisis has revived debates on the relevance of laissez-faire, and thus on the role of the State in a modern economy. Lady Lovelace’s notes on Babbage’s Analytical Engine never refer to the concept of surprise. Having some pretension to ‘originate’ something—unlike the Analytical Engine—is neither necessary nor sufficient to being able to surprise someone. Turing nevertheless translates Lovelace’s ‘this machine is incapable of originating something’ in terms of a hypothetical ‘computers cannot take us by surprise’ objection to the idea that machines may be deemed capable of thinking. To understand the contemporary significance of what is missed in Turing’s ‘surprise’ translation of (...) Lovelace’s insight, one needs to distinguish between trivial surprises and those events, propositions or encounters that lead us to question our understanding of ourselves or what surrounds us. Only some of these non-trivial surprises are the product of originality endeavours. Not only is it uncommon for surprises to track such endeavours, the type of autonomy that would be required on the part of ‘digital computers’ for originality and surprise to intersect in that way goes far beyond the operational autonomy that can be achieved by ‘learning machines’. This paper argues that a salient translation of Lovelace’s originality insight—for contemporary and future ‘learning machines’—is an upside-down version of Turing’s surprise question: can computers be surprised by us in a non-trivial, ‘co-produced’ way? Considering the sensory dimension of clinical decision-making is a challenge for the training of health professionals. Therefore, how can we help them stimulate a form of sensory acuity? We conducted a study in partnership with the Simulation Laboratory of a Canadian hospital to understand the sensory work accomplished by nurses during a clinical decision-making. To do this, we analyzed the interactions occurring during focus groups to reveal the sensory work performed by nurses during the clinical evaluation of patients (personas).

L’analyse de l’exclamation d’un point de vue diachronique fait l’objet de notre étude dans cet article. Le point de départ de l’analyse est la définition de l’Oxford English Dictionary et on se propose de citer les principales formes exclamatives depuis le vieil anglais et de comprendre comment elles sont analysées à cette époque. La thématique des questions d’un point de vue diachronique est l’objet de cet article. Dans un premier temps, est proposé un tour d’horizon des questions ouvertes et fermées depuis le vieil anglais avant de nous intéresser à l’apparition et à l’évolution des pronoms relatifs en wh-. L’auxiliaire do est brièvement discuté. Sont ensuite analysés les syntagmes nominaux thématisés et les prédications existentielles, puis les questions tags ainsi que la grammaticalisation des questions fermées.

The objective of this study was to explore the participants’ processing strategies on the mere exposure effect, object decision priming and explicit recognition. In Experiments 1, we observed that recognition and the mere exposure effect for unfamiliar three-dimensional objects were not dissociated by plane rotations in the same way as recognition and object decision priming. However, we showed that, under identical conditions, prompting analytic processing at testing produced a large plane rotation effect on recognition and the mere exposure effect similar (...) to that observed for object decision priming. Furthermore, inducing a non-analytic processing strategy at testing produced a reduced plane rotation effect on recognition and object decision, similar to that observed for the mere exposure effect. This article offers a critical reading of what Julia Kristeva calls ‘woman’s primary homosexuality’ and discusses homophobia in Kristeva’s work. If we are to draw conclusions on the merits and limitations of Kristeva’s theories of sexuality, homophobia needs to be assessed within the aesthetic and ethical contexts that typify Kristeva’s overall oeuvre. The article shows that we can apply Kristeva’s semiotic/symbolic model of signification to sexuality and argues for the construction of ‘primary homosexuality’ as the manifestation of resistance to authorized (...) sexual identity. The article also shows why the political demands to recognize lesbianism as a valid form of sexuality and especially as an intelligible lifestyle go against Kristeva’s understanding of what resistance entails. Respondents from Austria (N = 146) and the Czech Republic (N = 165) noted down their experiences with people from their neighbouring country and their attitudes to their own country and the neighbouring nation on feeling thermometers. The quantitative content analysis and qualitative critical discourse-inspired analysis of the open statements focused on the role of language in the construction of Czech-Austrian relations. Using qualitative analysis we enquired as to which themes were intertwined with the topic of language, and as to (...) the ways in which the participants perceived themselves, the Others, behind the border, and the relations between the two sides. We looked not only into what participants said but also how they said it. Using statistical analysis we tested the link between language-related topics in the descriptions of intergroup contact and the evaluation of the neighbouring nation as a whole. Throughout the article we compare the findings obtained by the two kinds of analysis and comment on (dis)agreement as well as on the (dis)advantages of both approaches. (shrink)

The eighteenth century was the century of self-organization, but also that of materialism, inasmuch as it was then that certain thinkers proclaimed themselves to be materialists (rather than just being labelled as such by enemies of various sorts). If one seeks to read these two features – one hesitates to call them ‘facts’ or ‘events’ – together, one arrives rather quickly at an influential metaphor, the beeswarm. But a metaphor of or for what? Irreducible organic unity, most broadly – spelled (...) out in the vocabulary of the period in terms of synergy, sympathy and sensibility, but also of cohesion, consensus and conspiration: individual bees have their characteristics, their intentions, and their own purposes, but they also ‘conspire’, ‘cohere’ and ‘consent’ in the name of a larger living unity, the swarm, although this leaves open further questions such as the exact nature of the order or organization yielded or enacted by the swarm (bottom-up? top-down? emergent? etc.). The fascination with the beeswarm is a fascination with organic unity and in some cases (notably Diderot), with the organic or organismic features of living matter itself. The objective of the present study was to show that the use of adversative and conclusive connectives to mark off the prototypical schema of argumentative text begins to set in at approximately the age of 10 or 11. Based on Adam's (1992) proposals, we constituted an argumentative text with two blocks of arguments separated by an adversative instruction (the connective but or an equivalent) and followed by a conclusion introduced by a conclusive instruction (the connective thus or an equivalent). Four (...) revising tasks (insertion or substitution with or without five connectives) have been used to asses children's knowledge of the argumentative schema and the use of connectives that punctuate them. The study of good and erroneous locations (concerning the placement of but and thus) showed that there was some regularity in the choices made by the children. The main result of this study shows that argumentative connectives are used differently by children aged 9 and children aged 10 or 11. The argumentative schema is used more consciously by 11-year-olds to guide revising tasks than by 10-year-olds. (shrink)

This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. It delves into the Kantian duty to enter a rightful condition beyond the state and shows that a proper understanding of this duty not only leads us to acknowledge a duty of right to assist states that are unable to fulfil the core functions of a state, (...) but also provides valuable hints at what just transnational trade relations and a just regulation of immigration should look like. Hart's and Kelsen's respective outlooks on the concept of normativity not only differ by the way they explain this concept but also, more importantly, in what they seek to achieve when endeavouring to account for the normative dimension of law. By examining Hart's and Kelsen's models in the light of Korsgaard's understanding of the “normativity problem,” my aim is to emphasise not only their contrasted perspectives, but also the common limit they impose on their theories by dismissing as inappropriate any (...) question regarding the emergence of legal normativity. On the basis of my previous arguments, I shall explain why I deem Raz's analysis of the contrast between Hart's and Kelsen's conceptions of normativity to be misleading. (shrink)

This paper describes the construction method of a legal application ontology. This method is based on the merging of micro-ontologies built from European community directives. The terminae construction method from texts enhanced by an alignment process with a core legal ontology is used for building micro-ontologies. A merging process allows constructing the legal ontology.

ABSTRACTThis essay aims to contribute robust grounds to question the Susskinds’ influential, consequentialist logic when it comes to the legitimacy of automation within the legal profession. It does so by questioning their minimalist understanding of the professions. If it is our commitment to moral equality that is at stake every time lawyers hail the specific vulnerability inherent in their professional relationship, the case for wholesale automation is turned on its head. One can no longer assume that, as a rule, wholesale (...) automation is both legitimate and desirable, provided it improves the quality and accessibility of legal services. The assumption, instead, is firmly in favour of designing systems that better enable legal professionals to live up to their specific responsibility. The rest of the essay outlines key challenges in the design of such profession-specific, ‘ethics aware’ decision-support systems. (shrink)

In his review of Bernard Williams' Ethics and the Limits of Philosophy, Hart eloquently formulated an apprehension that still haunts much of contemporary jurisprudence: if the moral 'I must' has to be 'seen as coming not from outside, but from what is most deeply inside us? the fear is that this will not be enough'. I argue that this fear is the byproduct of the dualist outlook within which Hart—and a significant part of contemporary legal theory—is confined: because of his (...) bald naturalist premise, Hart could not conceive of moral objectivity except in terms presupposing an order of Reason resolutely distinct from the 'natural' world. This paper seeks to debunk this dualist outlook by engaging with the kind of 'non-bald' naturalism advocated in different ways by both McDowell and Blackburn. In considering contemporary efforts to draw a middle way between ethical scepticism and metaphysical rationalism, the paper draws on the pragmatic elements emerging from the confrontation between Habermas and Rawls. This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. ‘The regulation of gender in menopause theory’ offers a critical commentary on some key theories of menopause experience. It aims to show that the theorisation of menopause keeps to the same epistemic and ideological lines as hegemonic understandings of gender identity. Narratives of menopause has become one of the means by which one can learn to cite women’s gender correctly. In reverse, relating menopause experience against the grain of established narratives is becoming the means by which one may resist epistemic (...) bias and dominant ideology of gender. Moreover, I am proposing that while menopause experience is an important aspect of gender identity formation and its resistance, it is also becoming a new area for identity politics in general, and more particularly the site of dissident narratives. Les situations auxquelles nous sommes confrontés aujourd'hui dans nos pratiques d'information et de communication sont marquées par l'incertitude et la multidimensionnalité. Les approches adoptées ne peuvent s'appuyer sur la seule logique rationnelle et font appel à des savoirs pratiques, parfois issus de traditions anciennes, qui mobilisent l'abduction. Du point de vue de la connaissance, et contrairement à l'opinion courante, l'abduction associe étroitement déduction et induction. Les exemples empruntés à la science, à la littérature, à l'épistémologie et à l'esthétique soulignent la (...) pertinence d'une approche transdisciplinaire de ce mode de découverte.In today's information and communication activities we are faced with situations characterized by uncertainty and multidimensionality. These approaches we adopt to these cannot only be guided by rational logic and require practical know-how, sometimes from ancient traditions, which imply abductive thinking. Contrary to the widely-held opinion, abduction closely combines induction and deduction. Examples from science, literature, epistemology and aesthetics stress how relevant a transdisciplinary approach of this discovery mode really is. (shrink)

Le verdissement du droit de l’urbanisme a commencé dès l’apparition du droit de l’environnement et s’est depuis largement développé. Néanmoins, s’agissant d’un principe aussi novateur que le principe de précaution, l’impact de celui-ci a véritablement peiné à émerger et l’on pouvait donc s’attendre à ce que la Charte de l’environnement lui donne une impulsion décisive. Toutefois, plus de quinze ans après l’entrée en vigueur de ce texte, le constat est celui d’une influence qui reste à la marge du droit de (...) l’urbanisme. Le droit écrit, tout d’abord, est resté singulièrement imperméable à ce principe, que ce soit sous forme d’une consécration officielle ou au travers de règles et mécanismes d’application. Du côté de la jurisprudence administrative, ensuite, on constate que si la nouvelle Charte a conduit à un spectaculaire revirement de jurisprudence, le Conseil d’État a fixé des conditions d’application telles que le principe reste encore à l’état virtuel.
