The present paper considers controversial utterances that were erroneously taken as derogatory. These examples are puzzling because, despite the audiences’ error, many speakers retract and even apologise for what they didn’t say and didn’t do. In recent years, intuitions about retractions have been used to test semantic theories. The cases discussed here test the predictive power of theories of derogatory language and help us better understand what is required to retract a slur. The paper seeks to answer three questions: are (...) the cases considered genuine retractions? If the speakers didn’t derogate by using a slur, how are the cases retractions of derogatory acts? Do these examples support expressive accounts of slurs? I argue that the examples provide evidence for an expressivist account of slurs: a slurring utterance (defeasibly) makes a derogatory speech act where the speaker expresses a commitment to a morally questionable appraisal state, such as disgust or contempt for a target group. A retraction of a derogatory speech act requires undoing the enactment of that commitment, which can be achieved with a genuine apology. This helps explain the conduct of audiences who misunderstand what the speaker says, and the speakers’ reactions. -/- . (shrink)

Rarely in the short history of liberal-democratic government has a primer on basic liberal-democratic values and institutions been more needed than now. Popular discontent, even anger, with democratic governments has grown steadily over the past twenty years. And not since the 1930s have citizens and their elected officials been so baffled about their respective roles in the maintenance of both democratic governments and liberal economies. Recent research in the cognitive science of religion suggests that humans intuitively believe that others survive death. In response to this finding, three cognitive theories have been offered to explain this: the simulation constraint theory (Bering, Citation2002); the imaginative obstacle theory (Nichols, Citation2007); and terror management theory (Pyszczynski, Rothschild, & Abdollahi, 2008). First, I provide a critical analysis of each of these theories. Second, I argue that these theories, while perhaps explaining why one would believe in his own personal immortality, (...) leave an explanatory gap in that they do not explain why one would intuitively attribute survival of death to others. To fill in the gap, I offer a cognitive theory based on offline social reasoning and social embodiment which provides for the belief in an eternal social realm in which the deceased survive—the afterlife. This is a three paper dissertation. ;for paper 1. Quine held that quantifying into modal contexts is illegitimate. It is sometimes thought that if he is right about this, then essentialist claims make no sense. Perhaps as a consequence of this thought together with the current prominence of essentialist views, there have been two good fairly recent attacks on Quine's argument against quantifying into modal contexts: Neale's revival of Smullyan's points and Kaplan's paper "Opacity". I first argue that Quine's view (...) is not refuted by Neale or Kaplan. I next explain that nonetheless, essentialists need not surrender in the face of Quine's injunction against quantifying in. Quine's work does not rule out the intelligibility of essentialist theses; it does however issue a challenge to explain the mysterious notion of metaphysical necessity. ;Abstract for paper 2. I examine the case that has been made for origin essentialism and find it wanting. I focus on the arguments of Salmon and Forbes. Like most origin essentialists, they have been concerned to respect the intuition that slight variation in the origin of an artifact or organism is possible. But, I argue, both of their arguments fail to respect this intuition. Salmon's argument depends on a sufficiency principle for crossworld identity, which should be rejected, if---as Salmon concedes---a given artifact might have been originally made from slightly different material. Similarly, Forbes's argument succeeds only if essentially the same argument can be used to establish a claim that---by his own admission---is too strong, namely that no variation, however slight, in an organism's origin is possible. ;Abstract for paper 3. Chisholm's Paradox suggests that origin essentialism is incompatible with the view that some variation in the origin of a given thing is possible. Since the latter view is strongly supported by intuition, origin essentialists have been eager to offer solutions to the paradox. In this paper I look at three allegedly different solutions to the paradox: Forbes's, Salmon's, and Lewis's. I give new criticisms of Forbes's view and offer new defenses of what I call the "Salmon-Lewis solution". (shrink)

Law is an essential tool for improving public health infrastructure and outcomes; however, existing state statutory public health laws may be insufficient. Built over decades in response to various diseases/conditions, public health laws are antiquated, divergent, and confusing. The Turning Point Public Health Statute Modernization National Collaborative addressed the need for public health law reform by producing a comprehensive model state act. The Act provides scientifically, ethically, and legally sound provisions on public health infrastructure, powers, duties, and practice. This article (...) examines how statutory law can be a tool for improving the public's health, existing needs for public health law reform, themes and provisions of the Turning Point Act, and how it is being used by public health practitioners. This paper presents reasons against semantic relativism. Semantic relativism is motivated by intuitions that are presumed to raise problems for traditional or contextualist semantics in contested domains of discourse. Intuition-based arguments are those based on competent speakers’ putative intuitions about seeming faultless disagreement, eavesdropper, and retraction cases. I will organize the discussion in three parts. First, I shall provide a brief introduction to the intuition-based arguments offered in favor of semantic relativism. Second, I shall indicate that there are ways for (...) contextualism to explain the (appearance of) intuitions that support semantic relativism. Civility is often treated as an essential virtue in liberal democracies that promise to protect diversity as well as active disagreement in the public sphere. Yet the fear that our tolerant society faces a crisis of incivility is gaining ground. Politicians and public intellectuals call for "more civility" as the solution--but is civility really a virtue? Or is it something more sinister--a covert demand for conformity that silences dissent? Mere Civility sheds light on this tension in contemporary political theory and (...) practice by examining similar appeals to civility in early modern debates about religious toleration. In seventeenth-century England, figures as different as Roger Williams, Thomas Hobbes, and John Locke could agree that some restraint on the wars of words and "persecution of the tongue" between sectarians would be required; and yet, they recognized that the prosecution of incivility was often difficult to distinguish from persecution.--. Bioethics committees have issued guidelines that medical interventions should be permissible only in cases of clinically verifiable disease, deformity, or injury. Furthermore, once the existence of one or more of these requirements has been proven, the proposed therapeutic procedure must reasonably be expected to result in a net benefit to the patient. As an exception to this rule, some prophylactic interventions might be performed on individuals “in their best interests” or with the aim of averting an urgent and potentially calamitous (...) public health danger. In order to invoke these exceptions, a stringent set of criteria must first be satisfied. Additionally, where the proposed prophylactic intervention is intended for children, who are unlikely to be able to provide a meaningfully informed consent, a heightened scrutiny of any such measures is required. We argue that children should not be subjected to prophylactic interventions “in their best interests” or for public health reasons when there exist effective and conservative alternative interventions, such as behavioural modification, that individuals could employ as competent adolescents or adults to avoid adverse health outcomes. Applying these criteria, we consider the specific examples of prophylactic mastectomy, immunisations, cosmetic ear surgery, and circumcision. (shrink)

Booker T. Washington (1856?1915), Principal of Tuskegee Institute, delivered an electrifying oration at the Atlanta Exposition in 1895. He drew cheers from white elites in the segregated audience, as also admiration, initially, from many blacks. Washington's ?Atlanta Compromise? speech unilaterally volunteered forfeiture of black political rights in the hope of white endorsement of limited black access to the lower rungs of the economic ladder. Washington's specific program ? prioritising work, vocational education, racial self?help etc. over any quest for political rights (...) ? was not original. His enigmatic ability to sell these notions to mutually opposed constituencies was startling. As Washington quickly rose to become one of the most powerful figures in America, the fortunes of his people, over the same period, spiralled away into the depths. The great imbalance between gain and loss in the ?Compromise? prompts the question whether or in what degree Washington ever shed a ?slave mentality? early imposed by violence and indoctrination. Concepts stand at the centre of human cognition. We use concepts in categorizing objects and events in the world, in reasoning and action, and in social interaction. It is therefore not surprising that the study of concepts constitutes a central area of research in philosophy and psychology, yet only recently have the two disciplines developed greater interaction. Recent experiments in psychology that test the role of concepts in categorizing and reasoning have found a great deal of variation, across individuals and (...) cultures, in categorization behaviour. Meanwhile, philosophers of language and mind have investigated the semantic properties of concepts, and how concepts are related to linguistic meaning and linguistic communication. A key motivation behind this was the idea that concepts must be shared across individuals and cultures. With the dawn of experimental philosophy, the proposal that the experimental data from psychology lacks relevance to semantics is increasingly difficult to defend. -/- This volume brings together leading psychologists and philosophers to advance the interdisciplinary debate on the role of concepts in categorizing and reasoning, the relationship between concepts and linguistic meaning and communication, the challenges conceptual variation poses to communication, and the social and political effects of conceptual change. The idea that one can 'soak up' someone else's mood or sense the tension in a room is familiar - as in 'negative energy'. This ability to borrow or share states of mind is now pathologized, as the author shows in relation to affective transfer in psychiatric clinics.

Logical pluralism is the view that there is more than one right logic. A particular version of the view, what is sometimes called domain-specific logical pluralism, has it that the right logic and connectives depend somehow on the domain of use, or context of use, or the linguistic framework. This type of view has a problem with cross-framework communication, though: it seems that all such communication turns into merely verbal disputes. If two people approach the same domain with different logics (...) as their guide, then they may be using different connectives, and hence talking past each other. In this paper I articulate a possible solution to this problem, without giving up pluralism, which requires adopting a notion of metalinguistic negotiation, and allows people to communicate and disagree across domains/contexts/frameworks. We are logical pluralists who hold that the right logic is dependent on the domain of investigation; different logics for different mathematical theories. The purpose of this article is to explore the ramifications for our pluralism concerning normativity. Is there any normative role for logic, once we give up its universality? We discuss Florian Steingerger’s “Frege and Carnap on the Normativity of Logic” as a source for possible types of normativity, and then turn to our own proposal, which postulates that (...) various logics are constitutive for thought within particular practices, but none are constitutive for thought as such. This paper presents a new view of logical pluralism. This pluralism takes into account how the logical connectives shift, depending on the context in which they occur. Using the Question-Under-Discussion Framework as formulated by Craige Roberts, I identify the contextual factor that is responsible for this shift. I then provide an account of the meanings of the logical connectives which can accommodate this factor. Finally, I suggest that this new pluralism has a certain Carnapian flavour. Questions about the meanings of (...) the connectives or the best logic outside of a specified context are not legitimate questions. (shrink)

To disentangle all this animates the passions of the literary genius. The United States is at a critical crossroads in its foreign policy and its relationship to the international community. Indeed, the very existence of an international community, rooted in the authority of the United Nations and capable of enforcing its resolutions, is from Washington's contemporary perspective an issue of contention. The foreign policy of the administration of George W. Bush has demonstrated, both before and after the tragic events of 11 September 2001, a willingness to undertake major initiatives unilaterally when (...) these are deemed to be in the vital interest of the United States specifically or of international order generally. In light of the inability of the United Nations to exercise collective will in the effort to disarm the aggressive regime of Saddam Hussein in Iraq, 1991-2003, Washington's determination to act alone or in coalitions-of-the-willing to secure international order is a welcome alternative to the international community as it is presently constituted.
