This paper explores an increasingly prevalent element of board-level commitment to sustainability. We propose a theoretical framework under which the existence and associated actions of board-level sustainability committees are motivated by shared value creation, where the interests of a diverse group of stakeholders are satisfied and sufficient profit is achieved. Using hand-collected data, we find that sustainability committees are heterogeneous in focus and vary in their effectiveness. Specifically, we disaggregate the sustainability committee construct based on stakeholder group focus and find (...) that associations between sustainability committees and performance outcomes are stronger when committees focused on a specific stakeholder group are paired with relevant performance outcomes. We generally find that sustainability committees are effective at impacting relevant strengths, but do not mitigate relevant concerns. These results are consistent with the shared value framework, where committees both generate value by pursuing sustainability-related opportunities and protect value by monitoring, but not necessarily mitigating sustainability-related risks. Univariate tests suggest that effective committees are also larger, more independent, and meet more frequently. Finally, we propose a new method to classify industries based on their sensitivity to certain stakeholder groups and find that the effectiveness of committees focused on specific stakeholders is more pronounced in industries that are sensitive to these stakeholders. This paper examines whether independent directors who have social ties to management (inside directors) can effectively perform their fiduciary duty to monitor management on behalf of shareholders. Ex ante, it is not clear whether social ties will enhance or obstruct the quality of board performance. Theory suggests that directors who are socially tied to management are ineffective and would make decisions favoring management. However, social ties can increase trust and information sharing between management and independent directors, improving directors' ability and (...) effectiveness in governing the company (Westphal, J. D.: 1999, The Academy of Management Journal 42(1), 7-24). To examine these contradicting predictions I use social network analysis and construct proxies for social ties between management and independent board members. Using these proxies, I first demonstrate that social ties are associated with higher managerial compensation. Further analyses reveal that these results are driven by social ties that include members of the compensation committee. Conversely, I demonstrate that financial reporting quality is improved when social ties exist. Specifically, I find that the likelihood of material weaknesses in internal controls and the likelihood of financial restatements are lower in companies with social ties. I further observe that this improved quality of financial reporting holds only when social ties include members of the audit committee. I conclude that ethically, socially tied independent directors should disqualify themselves from serving on compensation committees where social independence is essential. However, in tasks where collaboration with management is essential, directors with social links to each other can be of added value to shareholders. (shrink)

The emergence of the German Jewish philosopher Ernst Cassirer as the object of scholarly attention has been both surprising and rapid. In the decades since his early death while in exile in the United States, Cassirer never fell into complete oblivion. His works remained known to specialists in German intellectual history; his participation in a famous 1929 debate with Martin Heidegger in Davos, Switzerland, one of the most iconic moments in modern Continental thought, made his name familiar to most students (...) of modern philosophy. Yet Cassirer lacked the widespread recognition given to contemporaries such as Heidegger or Walter Benjamin, and his work never became the center of historical or philosophical study. This neglect stemmed, in part, from dismissal by his peers; as Edward Skidelsky explains in his new study, Rudolf Carnap found him “rather pastoral,” Isaiah Berlin dismissed him as “serenely innocent,” and Theodor Adorno thought he was “totally gaga”. The last few years, however, have seen the rise of a remarkable new interest in Cassirer in both Germany and the English-speaking world. Among this recent literature, Edward Skidelsky's and Peter Gordon's works lead the small “Cassirer renaissance” and offer the best English-language introduction to his thought. Both Gordon and Skidelsky ambitiously seek to relocate Cassirer at the forefront of modern German and European thought. Gordon goes as far as to call him “one of the greatest philosophers and intellectual historians to emerge from the cultural ferment of modern Germany” and one of the most important thinkers of the twentieth century. In making such bold statements, Gordon and Skidelsky clearly set their sights beyond the person himself; they aspire to highlight a central strand of thought that enjoyed a powerful presence in early twentieth-century Germany but fell into neglect in the postwar era. In doing so, they seek to reevaluate the nature and legacy of Weimar thought, its complex relationship with the period's unstable politics, and its relevance today. (shrink)

The aim of this paper is to examine the philosophical sources of some of the criticisms made in the second half of the 20th century to the practices and the main assumptions of historiography. In particular, the influence of the writings by Nietzsche dedicated to European Historicism on the renewed concept of history which is imposed in the twentieth century from the thought of Heidegger and Foucault. The divergent concepts of historical time and existential temporality, as well as those of (...) narrative unity and continuity of historical events, are the concepts that mainly fall under the critical scrutiny of these thinkers. Archaeological investigations that Foucault devotes to institutions and procedures of the European past are mentioned as examples of the critical review of traditional historiography. (shrink)

Is it tautological to call an action "wrongful discrimination?" Some philosophers and political theorists answer this question in the affirmative and claim that the term "discrimination" is intrinsically evaluative. Others agree that "discrimination" usually conveys the action’s moral wrongness but claim that the term can be used in a purely descriptive way. In this paper, we present two corpus studies and two experiments designed to test whether the folk concept of discrimination is evaluative. We demonstrate that the term has undergone (...) a historical development and is nowadays no longer used purely descriptively. Further, we show that this evaluation cannot be cancelled without yielding a contradiction. We conclude that the descriptive use of "discriminatory" is a thing of the past. (shrink)

Abstract:This essay reviews Giorgio Agamben’s Omnibus Homo Sacer, a monumental project of nine books that was recently completed after two decades. Alongside outlining the project’s key claims, the essay reflects on its uneven reception: it seeks to explain why Agamben’s claims on politics, law, and violence received enormous attention, while his writings on economics and religion were largely ignored. The essay in particular discusses the values and limits of Agamben’s work for historians.

This paper deals with the role of Judaism in Walter Benjamin's famous 1921 essay on violence and law, Zur Kritik der Gewalt. Despite the intense attention devoted to this essay, the role of Jewish myth in it has not yet been thoroughly explained. This study contends that the association between what Benjamin termed revolutionary violence and the Jewish messianic tradition, which plays a central role in the evaluation of Benjamin's text, is far more problematic than has hitherto been assumed, and (...) poses a serious challenge, which has not been fully examined in its historical context. Second, this essay claims that the subversive elements that many have supposedly found in Benjamin's text and the attempts to link these elements to messianic traditions are also unconvincing. Third, the paper contextualizes Benjamin's thought within the framework of the Jewish political–theological debate of the period. It contends that Benjamin's theory of law and justice should be understood not as a revolutionary, anti-republican text, as has been generally accepted, but as a secularized conservative orthodox one. In doing so, it seeks to shed light not only on Benjamin's early thinking and its influences, but also on the neglected element of Jewish orthodoxy within the broader topic of political theology. In this paper I identify two different lockean concepts of justice - "proprietary justice" and "justice as fairness" - and examine the relationship between each of them and charity in John Locke´s theory of property. As I try to show, in both cases Locke considers that charity may have priority over justice. This undermines the classical interpretation of Locke as a defender of unlimited capitalistic appropriation and provides additional evidence supporting Locke´s acceptation of a minimal redistributive system which should guarantee (...) the material welfare of non-appropriators. El presente trabajo aborda el pensamiento educativo de John Locke desde una perspectiva poco frecuentada: sus vínculos con la teoría lockeana de la propiedad. Como se pone de relieve, Locke discrimina entre la educación de los hijos de propietarios y la de los hijos de no propietarios. La finalidad primaria de la primera es cultivar una serie de valores morales estrechamente vinculados con la propiedad –como la liberalidad y la justicia. Nietzsche no perdió la ocasión de menospreciar a Mill como el típico inglés de mentalidad pasiva, en cambio los intérpretes actuales de Nietzsche son cautelosos en este aspecto, pues el filósofo alemán leyó muy minuciosamente a Mill, en particular su obra Sobre la libertad. Cuando él propicia que Zaratustra hable acerca de «el más frío de todos los monstruos fríos», lo hace con una promesa de futuro: «Allí, donde el Estado acaba, ahí comienza el ser humano que no es superfluo (...) […]. Allí, donde el Estado acaba, — ¡miradme de este modo hacia allá hermanos míos! ¿No los veis, al arcoíris y los puentes del suprahumano?». El presente trabajo establece una comparativa entre la visión de Dios y del Estado en la época moderna y la reflexión que hace Friedrich Nietzsche en Así habló Zaratustra acerca del Estado como algo monstruoso. Para este propósito se utilizarán respectivamente pasajes de la obra de Georg Wilhelm Friedrich Hegel, Arthur Schonpenhauer, Friedrich Leopold Stolberg, Karl Marx, Max Sterner, Wilhelm von Humboldt y John Stuart Mill. Cet article offre une vue d’ensemble sur les Éléments pour la généalogie de la morale de Nietzsche. La genèse de l’œuvre est d’abord présentée, puis les sources que Nietzsche a exploitées pour ses réflexions sont examinées. Cet examen des sources est suivi d’une analyse de la conception, de la structure et du contenu de l’« écrit polémique » de Nietzsche. Les sections du livre sont présentées et commentées dans leur succession.

Con frecuencia la teoría política trata a la familia como un hecho incuestionable de la vida social. Sin embargo, y especialmente en el marco del liberalismo político, vale la pena preguntarse por su justificación. En el presente trabajo analizo la teoría de la justicia de John Rawls buscando reconstruir no sólo lo que efectivamente dice sobre esta cuestión sino también el potencial que encierra para propocionar respuestas más contundentes. Rawls parece suscribir una explicación puramente instrumental del valor de la familia, (...) centrada en su utilidad para la reproducción y estabilidad de una sociedad bien ordenada. Sin embargo, como señalaré, aunque Rawls no explora esta alternativa, una aplicación consecuente del “primer principio”, que pauta la distribución de libertades y derechos básicos de los individuos, abre el camino para una justificación normativa más concluyente. En el presente trabajo abordo el problema de la incompatibilidad normativa entre dos principios ampliamente aceptados entre los liberales igualitarios -el principio de igualdad de oportunidades y el de autonomía familiar- en el marco de la teoría de la justicia de Rawls. Luego de hacer explícitas las diferentes vías por las cuales la autonomía de la familia inexorablemente conduce a la desigualdad de oportunidades entre los individuos, me dedico a explorar dos soluciones al problema sugeridas por Rawls en Una teoría (...) de la justicia y a mostrar por qué las mismas son fallidas. This essay analyzes the problem of the normative incompatibility between two principles which are widely accepted by liberals -the principle of equality of opportunities and that of family autonomy- and this within the framework of Rawls´s theory of justice. After specifying different ways in which the autonomy of the family necessarily leads to inequality of opportunities between individuals, I examine two different solutions suggested by Rawls in A Theory of Justice and I intend to demonstrate why they are wrong. Consent governs innumerable everyday social interactions, including sex, medical exams, the use of property, and economic transactions. Yet little is known about how ordinary people reason about the validity of consent. Across the domains of sex, medicine, and police entry, Study 1 showed that when agents lack autonomous decision-making capacities, participants are less likely to view their consent as valid; however, failing to exercise this capacity and deciding in a nonautonomous way did not reduce consent judgments. Study 2 found that (...) specific and concrete incapacities reduced judgments of valid consent, but failing to exercise these specific capacities did not, even when the consenter makes an irrational and inauthentic decision. Finally, Study 3 showed that the effect of autonomy on judgments of valid consent carries important downstream consequences for moral reasoning about the rights and obligations of third parties, even when the consented-to action is morally wrong. Overall, these findings suggest that laypeople embrace a normative, domain-general concept of valid consent that depends consistently on the possession of autonomous capacities, but not on the exercise of these capacities. Autonomous decisions and autonomous capacities thus play divergent roles in moral reasoning about consent interactions: while the former appears relevant for assessing the wrongfulness of consented-to acts, the latter plays a role in whether consent is regarded as authoritative and therefore as transforming moral rights. In the second half of the nineteenth century, France was the main site of the controversy around the so-called eoliths, supposedly human-made tools of Tertiary Europe. In contrast to the more common situation where scientists have to make sure that an object stabilized in a laboratory is not an artifact of the lab but a natural object, in the eoliths debates the opposite was the case. The eolith proponents tried to render plausible the object's artificial, that is human, origin. In (...) their case, the objects would only be of scientific interest if they were artifacts not geofacts (naturally flaked stones). The paper ties in with existing literature on the French eoliths movement and investigates the successive eoliths debates in Britain. In Bruno Latour's terms, eoliths as archaeological evidence for Tertiary Man in Europe could gain in reality through a successful enlisting of the collaboration of human and non-human actors such as scientists, theories, publications, taxonomies, technologies, institutions, etc. Indeed, networks were established among scientists, preferably of powerful institutions, the 'tools' were integrated or denied a place in existing taxonomies of prehistoric artifacts, experiments were carried out to demonstrate their chance or designed origin, and their convergence or incompatibility with a certain theoretical framework was discussed. Arguments often revolved around questions of negative evidence, since both proponents and opponents of eoliths as tools were aware of the fact that the eoliths' strongest tie to reality would be evidence of the toolmakers themselves. Several known hominid fossils, among them those of doubtful age, were thus proposed as Tertiary shapers of the 'tools'. These hypothetical 'Englishmen' and their supposed artifacts were enmeshed in particular theories of human evolution, marked as they were by the racism and nationalism widespread at the time. abstract G. A. Cohen argues that egalitarians should compensate for expensive tastes or for the fact that they are expensive. Ronald Dworkin, by contrast, regards most expensive tastes as unworthy of compensation — only if a person disidentifies with his own such tastes (i.e. wishes he did not have them) is compensation appropriate. Dworkinians appeal, inter alia, to the so‐called ‘first‐person’ or ‘continuity’ test. According to the continuity test, an appropriate standard of interpersonal comparison reflects people's own assessment of their (...) relative standing: Person A can only legitimately demand compensation from person B if he regards himself as worse off, all things considered, than B. The typical bearer of expensive tastes does not regard herself as being worse off than others with less expensive tastes. Hence, in the typical case, pace Cohen, compensation for expensive tastes is inappropriate. The article scrutinizes this rationale for not compensating for expensive tastes. Especially, we try to bolster the continuity test by relating it to Dworkin's distinction between integrated and detached values, pointing out that an argument for the continuity test can be built on the assumption that equality has integrated value. In brief, the point is that a metric of equality should be assessed, partly, in virtue of its consequences for related ideals. One of these is the kind of justificatory community promoted by the continuity test. We defend this view against an objection to the effect that equality is a detached value. We conclude that the continuity test constitutes a strong foothold for the resourcist egalitarian reluctance to compensate people for their expensive tastes. (shrink)

Their belief that the lot represented the true will of Christ stands at odds with a century which had inherited a changing world view in which a strong confidence in the power of human reason gradually replaced (...) the assumption of God’s providential power. 1 Historian Andrew Fix has traced this intellectual shift as it affected the seventeenth-century Dutch Collegiants, who moved from a spiritualist to a rationalist approach to religious questions. The Moravian Brethren, known in Europe as the Renewed Unity of the Brethren, resisted the triumph of reason over revelation into the late eighteenth century. In this they reflected the general hostility toward the emphasis on science and reason to which George Becker has pointed as a hallmark of the Halle Pietists. 2 This similarity is not surprising given the fact that the Brethren were very much a part of the later Pietist movement and had strong ties with Halle during the formative years of the Unity. Count Nicholas Ludwig von Zinzendorf, the dominant influence in the development of the new Unity, attended the Pädegogium at Halle from 1710 to 1716 and modeled his initial projects on his estate after similar ones in Halle. 3Halle preceded the Brethren in a struggle over the role of reason in spiritual life. In the 1740s the philosophy of Christian Wolff (and hence also of Leibniz) [End Page 267] became popular among many at Halle, despite his having been removed from the faculty in 1722. Although the Halle Pietists did not reject science and reason out of hand, some among the faculty had perceived a distinct threat to faith from Wolff’s particular focus. 4 Through his view of reason as the divine source of human knowledge, Wolff shifted the ultimate test of religious insight from revelation to reason. 5 This same decade saw the Brethren’s piety reach a height of intensely emotional, even sensual, expression. This may have prevented Wolffian ideas from extending their influence into the Unity at that time. By the 1790s, however, it became clear that, at least among many of the lay members of the Unity, the Enlightenment stress on the primacy of reason was winning. Just as the Collegiants had come to view “free prophecy” as a function of human reason, several of the Brethren ultimately saw the lot as something open to human manipulation and objected to its use, arguing that decisions were best left simply to “brotherly reason.” 6Although the emphasis on reason invaded the Unity later than it entered Halle, they shared traits that made them vulnerable. In both cases piety was linked to behavior and a certain level of indoctrination. The tendency to drill young people in proper belief and conduct created a climate in which rival ideas could prove quite seductive. 7 A study of the Unity’s use of the lot and its place within their spiritual life over the course of the century reveals this process. It also reveals something of the nature of authority within the Unity since the change was driven by the laity, while the leadership struggled, largely in vain, to maintain the old order. Most importantly, the debate over the use of the lot shows the dynamics of changing ideas outside of the realm of the university and seminary. By tracing diagrammatic images in the anthropological sciences throughout the 20thcentury, the contributions to this special issue highlight some dominant pictorial traditions for rendering human evolution and diversity visible. Schizophrenics exhibit a deficit in theory of mind (ToM), but an intact theory of biology (ToB). One explanation is that ToM relies on an independent module that is selectively damaged. Phillips & Silverstein's analyses suggest an alternative: ToM requires the type of coordination that is impaired in schizophrenia, whereas ToB is spared because this type of coordination is not involved.

By manipulating the location of prosodic boundary and the semantic bias of the ambiguous “V+N1+de+N2” phrase, which is composed of one verb (V), one noun (N1), one functional word (de), and another noun (N2), this study investigated how prosodic boundary and the semantic bias affect the processing of temporary ambiguous sentences formed by the ambiguous phrase “V+N1+de+N2” through an eye movement experiment. We found the effect of prosodic boundary in the late processing stage and observed an interaction between prosodic boundary (...) and the semantic bias of ambiguous phrases as well. The participants required more time for fixation and more regressions occurred when the meaning of the ambiguous phrase guided by prosodic boundary was inconsistent with context, especially when the ambiguous phrase was biased to the narrative-object phrase. This result suggests that prosodic boundary affects the processing of temporal ambiguous sentences and is influenced by the semantic bias of the ambiguous phrase. These findings provide further evidence from Chinese that indicate that implicit prosody plays a general role in language comprehension. (shrink)
