The increasing use of information and communication technologies (ICT) to help facilitate neuroscience adds a new level of complexity to the question of how ethical issues of such research can be identified and addressed. Current research ethics practice, based on ethics reviews by institutional review boards (IRB) and underpinned by ethical principalism, has been widely criticised and even called ‘imperialist’. In this paper, we develop an alternative way of approaching ethics in neuro-ICT research, based on discourse ethics, which implements responsible (...) research and innovation through dialogues. A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. Thomas Kuhn’s book Black-Body Theory and the Quantum Discontinuity has come to be seen as something like the odd man out among his oeuvre. In particular, while the book has undoubtedly made a significant impact on the historiography of the discovery of the quantum, reconstructive accounts of Kuhn’s philosophy of science have generally paid little attention to Black-Body Theory. This is a lacuna I will attempt to rectify in part in this article. I will argue that Black-Body Theory (...) raises a number of interesting questions vis-à-vis Kuhn’s philosophy of science: specifically, that although Black-Body Theory can be said to partially mesh with the picture of science set forth in Structure, there are other parts of the account of the quantum revolution that fail to gel with the model of science set out in Structure. Globally there is a shortage of organs available for transplant resulting in thousands of lives lost as a result. Recently in the United Kingdom 457 people died as a result of organ shortage in just 1 year. 1 NHS Blood and Transplant suggest national debates to test public attitudes to radical actions to increase organ donation should be considered in addressing organ shortage. The selling of organs for transplant in the United Kingdom is prohibited under the Human Tissue Act 2004. (...) This discussion paper considers five ethical objections raised in the United Kingdom to paid donation and discusses how these objections are addressed within the only legal and regulated paid living unrelated renal donation programme in the world in Iran, where its kidney transplant list was eliminated within 2 years of its commencement. This article discusses whether paid living unrelated donation in Iran increases riskier donations and reduced altruistic donation as opponents of paid donation claim. The paper debates whether objections to paid donation based upon commodification arguments only oppose enabling financial ends, even if these ends enable beneficent acts. Discussions in relation to whether valid consent can be given by the donor will take place and will also debate the objection that donors will be coerced and exploited by a paid model. This article suggests that exploitation of the paid donor within the Iranian model exists within the legally permitted framework. However, paid living kidney donation should be discussed further and other models of paid donation considered in the United Kingdom as a radical means of increasing donation. (shrink)

Advances in neuroscience and other disciplines are producing large-scale brain data consisting of datasets from multiple organisms, disciplines, and jurisdictions in different formats. However, due to the lack of an international data governance framework brain data is currently being produced under various contextual ethical and legal principles which may influence key stakeholders involved in the generation, collection, processing and sharing of brain data thereby raising ethical and legal challenges. In addition, despite the demand for a brain data governance framework that (...) accounts for culture, there is a gap in empirical research and actions to understand how key stakeholders around the world view these issues using neuroscientists who are affected by these ethical and legal principles. Therefore, using the research question how do ethical and legal principles influence data governance in neuroscience? we attempt to understand the perceptions of key actors on the principles, issues and concerns that can arise from brain data research. We carried out interviews with 21 leading international neuroscientists. The analytical insights revealed key ethical and legal principles, areas of convergence, visibility, and the contextual issues and concerns that arise in brain data research around these principles. These issues and concerns circulate around intimately connected areas which include ethics, human rights, regulations, policies and guidelines, and participatory governance. Also, key contextual insights around animal research and ethics were identified. The research identifies key principles, issues, and concerns that need to be addressed in advancing the development of a framework for global brain data governance. By presenting contextual insights from neuroscientists across regions, the study contributes to informing discussions and shaping policies aimed at promoting responsible and ethical practices in brain data research. The research answers the call for a cross cultural study of global brain data governance and the results of the study will assist in understanding the issues and concerns that arise in brain data governance. Purpose The purpose of this paper is clearly illustrate this convergence and the prescriptive recommendations that such documents entail. There is a significant amount of research into the ethical consequences of artificial intelligence. This is reflected by many outputs across academia, policy and the media. Many of these outputs aim to provide guidance to particular stakeholder groups. It has recently been shown that there is a large degree of convergence in terms of the principles upon which these guidance documents are (...) based. Despite this convergence, it is not always clear how these principles are to be translated into practice. Design/methodology/approach In this paper, the authors move beyond the high-level ethical principles that are common across the AI ethics guidance literature and provide a description of the normative content that is covered by these principles. The outcome is a comprehensive compilation of normative requirements arising from existing guidance documents. This is not only required for a deeper theoretical understanding of AI ethics discussions but also for the creation of practical and implementable guidance for developers and users of AI. Findings In this paper, the authors therefore provide a detailed explanation of the normative implications of existing AI ethics guidelines but directed towards developers and organisational users of AI. The authors believe that the paper provides the most comprehensive account of ethical requirements in AI currently available, which is of interest not only to the research and policy communities engaged in the topic but also to the user communities that require guidance when developing or deploying AI systems. Originality/value The authors believe that they have managed to compile the most comprehensive document collecting existing guidance which can guide practical action but will hopefully also support the consolidation of the guidelines landscape. The authors’ findings should also be of academic interest and inspire philosophical research on the consistency and justification of the various normative statements that can be found in the literature. This paper is an attempt to advances research on walking, at a neighbourhood level of analysis for people with disabilities, by proposing a theoretical model that combines the knowledge of two disciplines: traffic planning and environmental psychology. The aim is to provide a guidance for a discussion and a planning of future interdisciplinary investigations, by proposing a model that accounts for the dynamic interaction between environmental characteristics, human processes, and walking experience among individuals with a disability. For this purpose, traffic (...) planners and environmental psychologists came together to discuss theories, concepts, and thematic of relevance in a series of focus group meetings. These meetings led to the selection of the Human Environment Interaction (HEI) model, originally developed from the field of environmental psychology, and operationalised to describe how walking experiences result from the interplay between individual abilities, emotional processes and physical and social characteristics of the environment (Küller, 1991). The proposed model aims to sustain interdisciplinary discussion and research planning around the topic of neighbourhood walking for people with disabilities. By operationalising each dimension in the model, a good fit between groups with disabilities and individual differences associated with walking experiences is assumed, which in turn will have the potential to provide a more conscious analysis of wellbeing-related outcomes such as, usability of the environment, frequency of mobility, and quality of life. However, to improve understanding of urban walking at a neighbourhood level for people with disabilities, empirical studies must be carried out to test the proposed model. (shrink)

This article provides a conceptual framework for studying the influence of mood on managerial ethical decision making. We draw on mood-congruency theory and the affect infusion model to propose that mood influences managerial ethical decision making through deliberate and conscious assessments of the moral intensity of an ethical issue. By accounting for proscriptive and prescriptive morality—i.e., harmful and prosocial behavior, respectively—we demonstrate that positive and negative mood may have asymmetrical and paradoxical effects on ethical decision making. Specifically, our analysis suggests (...) that individuals in a positive mood will be more likely to engage in prosocial behavior but less likely to refrain from activities that have harmful consequences for others, whereas individuals in a negative mood will be more likely to avoid activities that put others at risk or harm but at the same time less prone to engaging in activities that have positive consequences for others. Importantly, we account for the context within which managers make their decisions by examining how situational strength may moderate the influence of mood on managerial ethical decision making. Finally, we discuss how organizations can leverage the double-edged sword effect of mood on ethical decision making and prevent, control and manage the risk of unethical decision making on the part of managers. Guidelines orient best practices in medicine, yet, in health care, many real world constraints limit their optimal realization. Since guideline implementation problems are not systematically anticipated, they will be discovered only post facto, in a learning curve period, while the already implemented guideline is tweaked, debugged and adapted. This learning process comes with costs to human health and quality of life. Despite such predictable hazard, the study and modeling of medical guideline implementation is still seldom pursued. In this article (...) we argue that to systematically identify, predict and prevent medical guideline implementation errors is both an epistemic responsibility and an ethical imperative in health care, in order to properly provide beneficence, minimize or avoid harm, show respect for persons, and administer justice. Furthermore, we suggest that implementation knowledge is best achieved technically by providing simulation modeling studies to anticipate the realization of medical guidelines, in multiple contexts, with system and scenario analysis, in its alignment with the emerging field of implementation science and in recognition of learning health systems. It follows from both claims that it is an ethical imperative and an epistemic responsibility to simulate medical guidelines in context to minimize harm in health care, before guideline implementation. Deep brain stimulation (DBS), a surgical procedure involving the implantation of electrodes in the brain, has rekindled the medical community’s interest in psychosurgery. Whereas many researchers argue DBS is substantially different from psychosurgery, we argue psychiatric DBS—though a much more precise and refined treatment than its predecessors—is nevertheless a form of psychosurgery, which raises both old and new ethical and legal concerns that have not been given proper attention. Learning from the ethical and regulatory failures of older forms of psychosurgery (...) can help shed light on how to address the regulatory gaps that exist currently in DBS research. To show why it is important to address the current regulatory gaps within psychiatric DBS, we draw on the motivations underlying the regulation of earlier forms of psychosurgery in the US. We begin by providing a brief history of psychosurgery and electrical brain stimulation in the US. Against this backdrop, we introduce psychiatric DBS, exploring current research and ongoing clinical trials. We then draw out the ethical and regulatory similarities between earlier forms of psychosurgery and psychiatric DBS. As we will show, the factors that motivated strict regulation of earlier psychosurgical procedures mirror concerns with psychiatric DBS today. We offer three recommendations for psychiatric DBS regulation, which echo earlier motivations for regulating psychosurgery, along with new considerations that reflect the novel technologies used in DBS. There has been much debate whether computers can be responsible. This question is usually discussed in terms of personhood and personal characteristics, which a computer may or may not possess. If a computer fulfils the conditions required for agency or personhood, then it can be responsible; otherwise not. This paper suggests a different approach. An analysis of the concept of responsibility shows that it is a social construct of ascription which is only viable in certain social contexts and which serves (...) particular social aims. If this is the main aspect of responsibility then the question whether computers can be responsible no longer hinges on the difficult problem of agency but on the possibly simpler question whether responsibility ascriptions to computers can fulfil social goals. The suggested solution to the question whether computers can be subjects of responsibility is the introduction of a new concept, called “quasi-responsibility” which will emphasise the social aim of responsibility ascription and which can be applied to computers. Many studies have emphasized the importance of medical, insurance, and workplace systems treating individuals fairly in work disability prevention and return-to-work. However, ethical theories and perspectives from these different systems are rarely discussed in relation to each other, even though in practice these systems constantly interact. This paper explores ethical theories and perspectives that may apply to the WDP–RTW field, and discusses these in relation to perspectives attributed to dominant stakeholders in this field, and to potential differences in different jurisdictional (...) contexts. Literature was sought primarily in biomedical ethics, business ethics, and public administration ethics. In biomedical ethics, four ethical principles are dominant: autonomy, beneficence, nonmalevolence, and justice. Business ethics involve theories on Corporate Social Responsibility, social contracts, and organizational justice. Public administration ethics focus on constitutional theory, citizenship, social equity, virtue, and public interest. Several concepts were identified as relevant for ethical analyses in the WDP–RTW field, including justice; individual autonomy; nonmalevolence; economic and social responsibility; and social contracts. These concepts provide a vocabulary that may be used to analyze stakeholders’ actions and interactions in RTW processes. It was also noted how the power balance between stakeholders will influence which ethical perspectives will influence RTW. Jurisdictional differences that influence RTW processes with regard to stakeholder responsibilities were identified, as well as varying beliefs as to who is the client in different compensation systems. A social contractual approach may inform an analysis of cultural and legal differences. (shrink)

In this paper I will show how the medical image, presented to the patient by the physician, participates in medicine's cold culture of abstraction, objectification and mandated normativity. I begin by giving a brief account of the use of anatomical imaging since the Renaissance to show how images have historically functioned in contrast to how they are currently used in medical practice. Next, I examine how contemporary medical imaging techniques participate in a kind of knowledge production that objectifies the (...) human body. Finally, I elucidate how physicians ought to place the medical image within the context of the lived body so as to create a healing relationship with the patient. In all this I hope to show that the medical image, far from a piece of objective data, testifies to the interplay of particular beliefs, practices and doctrines contemporary medicine holds dear. To best treat her patient, the physician must appreciate the influence of these images and appropriately place them within the context of the patient's lived experience. (shrink)

Theories of recognition often acknowledge that some forms of recognition can be ideological. Only recently have authors also begun to ask whether all ideological phenomena involve a more basic form of misrecognition of epistemic agents. I argue that an expressivist reconstruction of the Marxian theory of ideology can help us to understand what forms of misrecognition are involved in ideology. According to this understanding, ideological discourses reflect the rules of hierarchical social practices and impose limits on the capacity of subjects (...) to challenge dominant conceptual distinctions. While rational epistemic subjects will tend to experience such limits as misrecognition, this does not require any negative interpersonal attitudes on the part of others. Therefore, at least some forms of ideology involve primarily structural, rather than interpersonal, misrecognition. I argue that ideologies that persist without involving widespread false beliefs can best be understood in this way and that neoliberalism is a paradigmatic example of such an ideology. (shrink)

Significant challenges arise for clinical care teams when a patient or surrogate decision-maker hopes a miracle will occur. This article answers the question, “How should clinical bioethicists respond when a medical decision-maker uses the hope for a miracle to orient her medical decisions?” We argue the ethicist must first understand the complexity of the miracle-invocation. To this end, we provide a taxonomy of miracle-invocations that assist the ethicist in analyzing the invocator's conceptions of God, community, and self. After the (...) ethicist appreciates how these concepts influence the invocator's worldview, she can begin responding to this hope with specific practices. We discuss these practices in detail and offer concrete recommendations for a justified response to the hope for a miracle. (shrink)

Purpose – The purpose of this paper is to give an introduction to the special issue by providing background on the ETHICOMP conference series and a discussion of its role in the academic debate on ethics and computing. It provides the context that influenced the launch of the conference series and highlights its unique features. Finally, it provides an overview of the papers in the special issues. Design/methodology/approach – The paper combines an historical account of ETHICOMP and a review of (...) the existing papers. Findings – ETHICOMP is one of the well-established conference series focused on ethical issues of information and computing. Its special features include: multidisciplinary and diversity of contributors and contributions; explicit outreach to professionals whose work is to design, build, deploy and maintain specific computing applications in the world at large; creation of knowledge that is accessible and relevant across fields and disciplines; intention of making a practical difference to development, use and policy of computing principles and artefacts; and creation of an inclusive, supportive and nurturing community across traditional knowledge silos. Originality/value – The paper is the first one to explicitly define the nature of ETHICOMP which is an important building block in the future development of the conference series and will contribute to the further self-definition of the ETHICOMP community. This book uses insights from disability studies to understand in a deeper way the ethical implications that genetic technologies pose for Christian thought. Theologians have been debating genetic engineering for decades, but what has been missing from many theological debates is a deep concern for persons with genetic disabilities. In this ambitious and stimulating book, Devan Stahl argues that engagement with metaphysics and a theology of nature is crucial for Christians to evaluate both genetic science and the moral use (...) of genetic technologies, such as human genetic engineering, gene therapy, genetic screenings, preimplantation genetic diagnosis, and gene editing. Using theological notions of creation ex nihilo and natural law alongside insights from disability studies, the book seeks to recast the debate concerning genetic well-being. Following the work of Stanley Hauerwas, Stahl proposes the church as the locus for reimagining disability in a way that will significantly influence the debates concerning genetic therapies. Stahl's project in "genethics" proceeds with an acute awareness of her own liberal Protestant tradition's early embrace of the eugenics movement in the name of scientific and medical advancement, and it constructively engages the Catholic tradition's metaphysical approach to questions in bioethics to surpass limitations to Protestant thinking on natural law. Christianity has all too frequently been complicit in excluding, degrading, and marginalizing people with disabilities, but the new Christian metaphysics developed here by way of disability perspectives provides normative, theological guidance on the use of genetic technologies today. As Stahl shows in her study, only by heeding the voices of people with disabilities can Christians remain faithful to the call to find Christ in "the least of these" and from there draw close to God. Currently, boys growing up in urban poverty remain severely under-represented in Australian higher education. To explore this phenomenon, we draw on recent research with boys in Year 12 who will potentially be first-in-family as well as their teachers. The overarching research question framing the chapter is: “How do the school experiences of marginalized young men, living in one of the poorest urban regions in Australia, influence their transition to university?” Research on social mobility has documented that schooling plays a (...) significant role in how students transition to university, where school experiences can significantly influence the success of students from disadvantaged backgrounds. We draw on case study data from one school site, Chipple Senior College, located in the western suburbs of Sydney, to show how certain learner identities are cultivated through institutional tracking as well as teacher–student relationships concerning career guidance counselling and mentorship. Specifically, we identify certain divergences between how teachers view the transition journey of these boys, compared with how the boys themselves see it. The findings indicate discourses of gender—as well as institutional practices—play a significant role in orienting these young men toward their futures. (shrink)

PurposeThe purpose of this paper is to investigate the emancipatory promises and realities of information and communication technology in Egypt.Design/methodology/approachThe combination of Habermasian and Foucauldian ideas implemented by a critical discourse analysis of the Egyptian Information Society Policy and interviews with employees of local decision support systems employees. Promises and rhetoric are contrasted with findings and questioned with regards to their validity.FindingsOn the policy level, analysis shows that the emancipating rhetoric of ICT is not followed through. ICT is mostly seen (...) as a means of attracting foreign direct investment. Neither political participation nor educational benefits are promoted seriously. On the local level, culture and organisational realities prevent individuals from exploiting the emancipatory potential of the technology.Originality/valueThe combination of the Habermasian and Foucauldian approach exposes the problems of ICT use in developing countries. It shows that emancipation is used to legitimise ICT policies but is not taken seriously on a policy level in Egypt. Local implementations also fail to deliver on their promise. In order to have emancipatory effects, ICT policy and use will need to be reconsidered. (shrink)

An important question one can ask of ethical theories is whether and how they aim to raise claims to universality. This refers to the subject area that they intend to describe or govern and also to the question whether they claim to be binding for all (moral) agents. This paper discusses the question of universality of Luciano Floridi’s information ethics (IE). This is done by introducing the theory and discussing its conceptual foundations and applications. The emphasis will be placed (...) on the ontological grounding of IE. IE’s claims to universality will be contrasted with those raised by discourse ethics. Critical research is becoming increasingly accepted as a valid approach to research in information systems. It is deemed to be particularly suitable for situations where researchers want to address conspicuous injustice, such as in areas of development or the digital divide. Critical research in information systems (CRIS), I will argue, is a possible approach to some of the ethical problems arising in the context of information and communication technology (ICT). It can be sensitive to the question of culture and (...) therefore suitable for researching cross-cultural ethical questions in ICT. It is often unclear, however, what exactly critical research stands for and to what extent critical approaches are applicable across cultural boundaries. This paper will address these problems by proposing a definition of critical research as focused on changing the status quo and aiming for emancipation. It will then look at the question whether different cultures are compatible and comparable and what the role of culture in research on information systems is. The paper will then return to the question whether the critical intention to emancipate and empower humans is an expression of cultural imperialism or whether there are valid ways of promoting emancipation across cultural divides. The hope for a better future can, and frequently does, motivate political action. Political hope is therefore often considered a positive force. However, not all forms of political hope are beneficial. Some scholars and activists claim that some kinds of hope also function as an ideology. I argue that we can give a precise meaning to the notion of ‘ideological hope,’ and I argue that to say of a given instance of hope that it is ‘ideological’ means more than that (...) it is irrational or immoral. I distinguish two forms of ideological hope: forms where the ideological nature of hope derives from underlying ideological beliefs and judgments, and structural forms. One potent and frequently discussed antirealist argument has been Larry Laudan’s (...) “pessimistic induction”: Historically, all scientific theories, especially in physics, have been proven false. Hence, all contemporary scientific theories will be proven false and science cannot represent reality. This pessimistic induction relies on knowledge of the history of science, on historiographic realism. Luckily for the pessimistic induction, the history of historiography, the scientific representation of the human past, supports an optimistic induction: Since the revolutions associated with Ranke in historiography, Lyle in geological history, and Darwin in biological history, the historical sciences have made progress but have not [End Page 368] overhauled the founders’ representations of the past. We know more about the human past than Ranke did and much more about the biological past than Darwin did, but the modern historical sciences have not overturned their theories and conclusions. Though there are many new methodologies, historians still go to the archives to compare primary sources, and biologists still study fossils and assume natural selection.Though scientific antirealism assumes historiographic realism, it has received scant philosophic attention. Often it is perceived or presented as a naive “empiricist” concept of historiography that imagines historians “observe” history and then describe it in historiography. Radical antirealist theories of historiography that reduce it to fiction, myth, or manipulative ideology use this image of realism as naive empiricism to dialectically support its equally naive antirealist antithesis. Both ignore the evidential, mostly testimonial, justifications of historiography.Adam Timmins’s project is to articulate and justify a sophisticated historiographic realism that fits historiographic practices and premises. He argues that historiography is “successful in providing information and understanding about the historical past that is constrained by and reflects what actually happened in the past itself.”Timmins’s historiographic realism springs out of the philosophy of language rather than epistemology or philosophy of science. This distinguishes it from Murray Murphey’s historiographic realism, which argued that historiographic ontology is theoretical. Famously, Murphey compared George Washington to the electron as two well-corroborated but unobservable theoretical entities. Timmins retorts that Washington is a proper name and not a theoretical concept, and it is impossible to conduct experiments with Washingtons. Timmins inquires how the language historians use may be interpreted as referring to past events and how historiography can represent history. He does not devote much attention to how historians justify their statements about history to a degree that may warrant a realistic interpretation of historiography. Rather, Timmins assumes so. He proceeds through polemical dialogues with philosophers of historiography who took antirealist stances like Leon Goldstein, Frank Ankersmit, and Jouni Kuukkanen.Timmins’s realism is founded on the belief in a universally accepted core of historiographic facts. He does not inquire about the theoretical foundations of historiographic inferences that allow the emergence of such a consensus. Rather than consider historiographic epistemology, the critical methods of historiography, Timmins considers linguistic communities and entrenched uses of language. He confronts the problem of reference to the past in the absence of its perception by asserting that historiographic representations are of “mental files” that have names (for example, “the Renaissance,” “the Second World War”) and evolving core facts about those historical events (for example, Petrarch and Da Vinci in the Renaissance, the main battles in the war). Though the exact contents of these files may differ between historians, they still refer to the same events and have the same labels. Traditional arguments for privacy in public suggest that intentionally public activities, such as political speech, do not deserve privacy protection. In this article, I develop a new argument for the view that surveillance of intentionally public activities should be limited to protect the specific good that this context provides, namely democratic legitimacy. Combining insights from Helen Nissenbaum’s contextualism and Jürgen Habermas’s theory of the public sphere, I argue that strategic surveillance of the public sphere can undermine the capacity of citizens (...) to freely deliberate in public and therefore conflicts with democratic self-determination. In the controversy that arose between Gottfried Wilhelm Leibniz and Georg Ernst Stahl following the publication of the latter’s Theoria medica vera, both theoreticians strove to distance themselves from what they took to be the classical conception of the vegetative soul, while relating and partly reducing their opponent’s doctrine to it. I shall first attempt to establish their respective meanings for such a soul and the reasons why they would challenge the relevance of that notion for physiology. I shall (...) then try to show how they nevertheless integrated explanatory functions equivalent to those attributed to that metaphysical entity into the theoretical frameworks they proposed and favoured. As a consequence of alternative interpretations of this kind, eighteenth-century physiologists will tend to link vegetative life either with “organic mechanism” or with various kinds of “vital principle,” akin to Stahl’s anima. This book discusses the concept of immanent critique, i. e. whether there is a form of critique which neither just applies empirically accepted standards nor independently justified norms but rather reconstructs norms which are immanent to social practices. -/- It surveys both political theories of criticism (Walzer, Taylor, MacIntyre) and contemporary critical theories (Habermas, Honneth) for how they describe such forms of critique and develops a new model of immanent critique. For this purpose, it takes up both contemporary social ontology (...) theories and the discussion about rule-following. The book argues that we can speak of immanent rules as far as persons can practically recognize each other as members of rule-governed practices if they attribute each other defeasible normative authority. -/- Finally, it describes the consequences of the adoption of such a model for our description of a practice of critique and analyzes both first-order immanent critique and the second-order critique of reification. ArgumentIn this essay, I sketch a problem-based framework within which I locate the concept of “organism” in the system theories of Georg Ernst Stahl, Théophile Bordeu, and Paul-Joseph Barthez. Around 1700, Stahl coins the word “organism” for a certain concept of order. For him, the concept explains the form of order of living bodies that is categorically different from the order of other bodies or composites. At the end of the century, the “organism” as a specific form of (...) order becomes a major topos in many discourses. I will not so much focus on experiments and objects as on basic problems that contribute to the general framework of the concept of organism as a key concept of the vitalist movement between 1700 and 1800. For this purpose, I will investigate the combination of three explanatory tools. These tools refer to regulating agents, functional interactions, and stimulus-reactions-schemes within individual organic systems of forces. They are related to various themes – especially to energy, sensibility, and sympathy. I will retrace some aspects of these relations. (shrink)

The link between the right to privacy and the right to democratic self-determination is often understood to imply that privacy rights have only instrumental value for democratic participation, and that they consist solely in the possibility to retreat from participation in a public. I examine three arguments for an internal link between both sets of rights: The right to privacy protects political public spheres from epistemic inequality, it protects groups in public from a loss of their deliberative autonomy and it (...) blocks the colonisation of deliberative publics by strategic action orientations. The problem of the social foundations of normativity can be illuminated by discussing the narrower question whether rule-following is necessarily a social matter. The problems with individualistic theories of rule-following seem to make such a conclusion unavoidable. Social theories of rule-following, however, seem to only push back one level the dilemma of having to choose either an infinite regress of interpretations or a collapse into non-normative descriptions. The most plausible of these models, Haugeland's conformism, can avoid these objections if it (...) is supplemented with an ontologically reasonable concept of the collective attitude of a group. Groups of individuals who are bound to shared norms by recognizing each other as equipped with a standard authority of criticism have the necessary properties for ascribing to those groups such collective attitudes. Given such a weak notion of a collective attitude, there is hope for a plausible collectivist theory of rule-following. (shrink)

This paper discusses recent evidence that violations of core knowledge offer special learning opportunities for infants and young children. Children make predictions about the world from the youngest ages. When their fail to match observed data, they show an enhanced drive to seek and retain new information about entities that violated their expectations. Finally, the authors draw comparisons between children and adults, and with other species, to explore how surprise shapes thought more broadly.

Computer-based design environments for skilled domain workers have recently graduated from research prototypes to commercial products, supporting the learning of individual designers. Such systems do not, however, adequately support the collaborative nature of work or the evolution of knowledge within communities of practice. If innovation is to be supported within collaborative efforts, thesedomain-oriented design environments (DODEs) must be extended to becomecollaborative information environments (CIEs), capable of providing effective community memories for managing information and learning within constantly evolving collaborative contexts. Thomas Kuhn has been seen as the preeminent philosopher in the so-called historicist turn in the philosophy of science, with others—including Michael Polanyi—relegated to his slipstream. Yet the supersession of Polanyi seems curious in a way, as his Personal Knowledge—published just 3 years before Structure—contains many of the same ideas that Kuhn put to use in his philosophy of science. Why is it, therefore, that history has seen Structure supersede Personal Knowledge?

The role of power in healthcare can raise many ethical challenges. Power is ownership, whether given, ceded, or taken of another person’s autonomy. When a person has power over someone else, they can control or strongly influence the decision-making freedom of that person. From the principalist perspective1,2 of healthcare ethics, denying a person their freedom to choose, should only occur when justifying conditions related to beneficence and nonmaleficence are sufficiently satisfied. In healthcare, it is rare to be able to identify (...) situations where paternalism is justified. Empirical research into the ethics of emerging technologies, often involving foresight studies, technology assessment or application of the precautionary principle, raises significant epistemological challenges by failing to explain the relative epistemic status of contentious normative claims about future states. This weakness means that it is unclear why the conclusions reached by these approaches should be considered valid, for example in anticipatory ethical assessment or governance of emerging technologies. This paper explains and responds to this problem by proposing an account of (...) how the epistemic status of uncertain normative claims can be established in ethical and political discourses based on Jürgen Habermas’ discourse ethics. To better understand the nature of the problem, the relationship between norms, facts and the future is explored in light of potential meta-ethical fallacies faced in the field of empirical ethics. Weaknesses of current approaches to anticipatory ethical assessment and governance are then explored, including the Precautionary Principle and Technology Assessment. We argue that the epistemic status of uncertain normative claims can be understood within Habermas’ approach to political discourse, which requires ‘translation’ of uncertain claims to be comprehensible to other stakeholders in discourse. Translation thus provides a way to allow for uncertain normative claims to be considered alongside other types of validity claims in discourse. The paper contributes a conceptual account of the epistemic status of uncertain normative claims in discourse and begins to develop a ‘methodology of translation’ which can be further developed for approaches to research and ethical assessment supporting anticipatory evidence-based policy, governance and system design.
