Legal Realism Regained presents a comparison between the legal realists, a group of pragmatic legal theorists from the 1920s and 1930s, and critical legal studies, a movement of postmodern legal theory during the end of the twentieth century. The book argues for a return to legal realism and the classical pragmatism of John Dewey and William James and for a rejection of the postmodern critique of critical legal studies. It discusses the two movements with respect to three topics: their view (...) of history, their view of social science, and their view of language. Rejecting the claim that critical legal studies can be seen as the heir of legal realism, Legal Realism Regained argues that, with respect to each of these three topics, the realists still present a stronger argument than their more radical descendants. Bertrand Russell’s _Principles of Mathematics_ (1903) gives rise to several interpretational challenges, especially concerning the theory of denoting concepts. Only relatively recently, for instance, has it been properly realised that Russell accepted denoting concepts that do not denote anything. Such empty denoting concepts are sometimes thought to enable Russell, whether he was aware of it or not, to avoid commitment to some of the problematic non-existent entities he seems to accept, such as the Homeric gods and chimeras. In this (...) paper, I argue first that the theory of denoting concepts in _Principles of __Mathematics_ has been generally misunderstood. According to the interpretation I defend, if a denoting concept shifts what a proposition is about, then the aggregate of the denoted terms will also be a constituent of the proposition. I then show that Russell therefore could not have avoided commitment to the Homeric gods and chimeras by appealing to empty denoting concepts. Finally, I develop what I think is the best understanding of the ontology of _Principles of __Mathematics_ by interpreting some difficult passages. (shrink)

In order to develop a model of equitable and sustainable distribution, this paper advocates integrating the ecological space paradigm and the capabilities approach. As the currency of distribution, this account proposes a hybrid of capabilities and ecological space. Although the goal of distributive justice should be to secure and promote people’s capabilities now and in the future, doing so requires acknowledging that these capabilities are dependent on the biophysical preconditions as well as inculcating the ethos of restraint. Both issues have (...) been highlighted from the perspective of the ecological space paradigm. Concerning the scope of distributive justice, the integration can combine the advantages of the ecological space paradigm regarding the allocation of the responsibilities involved in environmental sustainability with the strength of the capabilities approach regarding people’s entitlements. In order to achieve this threshold, ecological space should be provided sufficiently, and the remaining ecological space budget could then be distributed according to the equal per capita principle. Lysophosphatidic acid (LPA) is a lipid mediator with a wide variety of biological actions, particularly as an inducer of cell proliferation, migration and survival. LPA binds to specific G‐protein‐coupled receptors and thereby activates multiple signal transduction pathways, including those initiated by the small GTPases Ras, Rho, and Rac. LPA signaling has been implicated in such diverse processes as wound healing, brain development, vascular remodeling and tumor progression. The closer we come to the subject under scrutiny, the clearer its outlines, fine-grained details, and its dynamics, and the better we reach an explanation and understanding. The closer the approach, however, the higher the chances (...) are of becoming myopic and losing the connections with broader—or higher—perspectives: the view from above. It has been due to philosophical and historical approaches from above to the practices of philosophically inspired psychiatry that we may gain new insights into what is going on on the ground—and underground. This article by Garson provides such a view that may lead to a change in perspective, a new way to draw boundaries on the ground, to discover similarities and dissimilarities through space and time, without thereby losing the lived connection to the problematic ground.Garson proposes to replace a binary opposition of madness (in the sense of sick or insane) versus sanity (in the sense of healthy), with a triad of concepts, sanity, madness, and idiocy, taken from the work of philosophers of psychiatry avant la lettre in the early modern times, Locke, Kant, Wigan, and Heinroth. This triad is to be understood in terms of reason, where idiocy consists of the diminishment of some aspects of reason, while madness would be characterized by a perversion of reason. By examining how this perversion—or more neutrally said, this change—of reason was conceived by the four thinkers, Garson sheds a new light on research and theory within the philosophy of madness and the philosophy of psychiatry today. What ultimately makes them mad, and not reasonable, is that their premises are flawed by the unhinged power of association.” So, with Locke the capacity for inferential logic is not disturbed, and in that sense reason is intact. The unreasonable behavior would be due, according to Locke, to an unbridled increase in imagination and associations, which are taken for reality. Instead of reason the capacity to align imagination and reality is afflicted. When we translate this Lockean view into contemporary terms, we could say that it is not their cognition, their way of processing stimuli that is problematic, but their being overwhelmed by impressions or stimuli. This is akin to “bottom-up” theories: Something is wrong with perception or experience, and ‘higher’ capacities of cognition and reasoning remain intact. Reason may seem ‘perverted,’ but at a closer look, this is a result of their being victim to anomalous experience, too many stimuli or too strong imaginations.Heinroth also explicitly distinguishes madness from idiocy, that is, from a diminishment of mental capacities. This paper reviews the debate on the notion of biological function and on functional explanation as this takes place in philosophy. It describes the different perspectives, issues, intuitions, theories and arguments that have emerged. The author shows that the debate has been too heavily influenced by the concerns of a naturalistic philosophy of mind and argues that in order to improve our understanding of biology the attention should be shifted from the study of intuitions to the study of the (...) actual practice of biological inquiry. Research into the so-called “philosophical” Hermetica has long been dominated by the foundational scholarship of André-Jean Festugière, who strongly emphasized their Greek and philosophical elements. Since the late 1970s, this perspective has given way to a new and more complex one, due to the work of another French scholar, Jean-Pierre Mahé, who could profit from the discovery of new textual sources, and called much more attention to the Egyptian and religious dimensions of the hermetic writings. This article addresses the (...) question of how, on these foundations, we should evaluate and understand the frequent hermetic references to profound but wholly ineffable revelatory and salvational insights received during “ecstatic” states. Festugière dismissed them as “literary fictions”, whereas Mahé took them much more seriously as possibly reflecting ritual practices that took place in hermetic communities. Based upon close reading of three central texts (CH I, CH XIII, NH VI6), and challenging existing translations and interpretations, this article argues that the authors of the hermetic corpus assumed a sequential hierarchy of “levels of knowledge”, in which the highest and most profound knowledge (gnōsis) is attained only during ecstatic or “altered” states of consciousness that transcend rationality. While the hermetic teachings have often been described as unsystematic, inconsistent, incoherent or confused, in fact they are grounded in a precise and carefully formulated doctrine of how the hermetic initiate may move from the domain of mere rational discourse to the attainment of several “trans-rational” stages of direct experiential knowledge, and thereby from the limited and temporal domain of material reality to the unlimited and eternal one of Mind. This article deals with a type of functional explanation, viability explanation, that has been overlooked in recent philosophy of science. Viability explanations relate traits of organisms and their environments in terms of what an individual needs to survive and reproduce. I show that viability explanations are neither causal nor historical and that, therefore, they should be accounted for as a distinct type of explanation.

In recent years, there has been an increasing interest in unethical work behavior. Several types of survey instruments to collect information about unethical work behavior are available. Nevertheless, to date little attention has been paid to design issues of those surveys. There are, however, several important problems that may influence reliability and validity of questionnaire data on the topic, such as social desirability bias. This paper addresses two important issues in the design of online surveys on unethical work (...) behavior: the response scale for questions regarding the frequency of certain types of unethical work behavior and the location of the background questions in an online survey. We present the results of an analysis of a double split-ballot experiment in a large sample (n = 3,386) on governmental integrity. We found that, when comparing response scales that have labels for all categories with response scales that only have anchors at the end, the latter provided answers with higher validity. The study did not provide support for the conventional practice of asking background questions at the end. (shrink)

This article is about changes in dominant modes of social conduct, particularly involving relationships between the sexes. Changes in behavioural codes and ideals were noted in the course of a comparative analysis of etiquette books published in the Netherlands from 1930 to 1985. There was a gap of approximately thirteen years during which, with one exception, no books on this subject were published. There was, however, an upsurge of books on liberation and self-realization, coupled with a relative loosening of behavioural (...) codes and ideals. Since the start of the 1980s, there appears to have been a tightening of these codes and ideals, both as regards relationships between men and women and in general. These changes are presented as developments in the sense of informalization and formalization, aspects of civilizing processes. The article commences with a short elaboration upon the concepts of informalization and formalization, goes on to present the results of the comparative analysis of the etiquette books, and concludes that nowadays a formalization of preceding informalization is taking place, a stage in the long-term process of informalization. This article introduces the methodology of the ‘Ontology Explorer’, a semantic method and JavaScript-based open-source tool to analyse data models underpinning information systems. The Ontology Explorer has been devised and developed by the authors, who recognized a need to compare data models collected in different formats and used by diverse systems. The Ontology Explorer is distinctive firstly because it supports analyses of information systems that are not immediately comparable and, secondly, because it systematically and quantitatively supports discursive analysis of (...) ‘thin’ data models – also by detecting differences and absences through comparison. When applied to data models underpinning systems for population management, the Ontology Explorer enables the apprehension of how people are ‘inscribed’ in information systems: which assumptions are made about them, and which possibilities are excluded by design. The Ontology Explorer thus constitutes a methodology to capture authorities’ own imaginaries of populations and the ‘scripts’ through which they enact actual people. Furthermore, the method allows the comparison of scripts from diverse authorities. This is exemplified by illustrating its functioning with information systems for population management deployed at the European border. Our approach integrates a number of insights from early infrastructure studies and extends their methods and analytical depth to account for contemporary data infrastructures. By doing so, we hope to trigger a systematic discussion on how to extend those early methodical innovations at the semantic level to contemporary developments in digital methods. (shrink)

Although the UN and EU focus their climate policies on the prevention of a 2 8C global mean temperature rise, it has been estimated that a rise of at least 4 8C is more likely. Given the political climate of inaction, there is a need to instigate a bottom-up approach so as to build domestic support for future climate treaties, empower citizens, and motivate leaders to take action. A review is provided of the predominant top-down cap-and-trade policies in place (...) – the Kyoto Protocol and EU Emissions Trading Scheme (EU ETS) – with a focus on the grandfathering of emissions entitlements and the possibility of offsetting emissions. These policies are evaluated according to two criteria of justice and it is concluded that they fail to satisfy them. Some suggestions as to how the EU ETS can be improved so as to enable robust climate action are also offered. (shrink)

I do, and whoever is committed to the construction of a solid legal order for the international community, finds himself constantly torn between hope and despair. Signs of hope in recent years include the approval of a statute for the International Criminal Court in Rome on July 17, 1998; the Pinochet decisions of the House of Lords of November 1998 and March 1999; and the coming into force of the Ottawa agreement on anti-personnel mines in March of 1999. Yet who could witness the course of events during the NATO bombing campaign in Yugoslavia, and the long period of UN inaction against the violence that broke out in East Timor following the referendum, without feeling some sense of desperation? The mood of the present day, however, should not prevent us from taking a long-term perspective. What kind of international legal order are we moving towards on the threshold of the twenty-first century? Building up a solid international legal order is probably one of the greatest challenges facing humanity at present. Our national legal systems are strongly developed and during the last fifty years, Western Europe has succeeded in constructing an EU legal order which has made possible a peaceful society, welfare and the integration of peoples in Europe. But where do we stand on the world level? Is international law not all too slowly limping behind globalization? And yet, the century we are looking back on has been the century in which international law and the law of international organizations flourished: in the framework of the League of Nations, and then the UN, we have succeeded in codifying, consolidating and developing international law in numerous multilateral treaties ranging from human rights and maritime law to international labour, trade and environmental norms. Never before had the world witnessed such an extensive network of international organizations . Rituals in dying and mourning have a social and a psychic aspect: they have the twin function of diminishing the danger of succumbing to intense emotions (fear, despair, powerlessness and grief) by evoking a feeling of solidarity, and of enhancing the sense of being connected to a larger community, on which basis these emotions are acknowledged as well as dimmed and kept under control. As the changes in mourning ritual of the last half of the 20th century demonstrate, the relation (...) or balance between these social and psychic functions of mourning rituals has been changing. From the 1960s onward, many traditional rituals came under suspicion and were pushed aside. Since the 1980s, a quest for new rituals has emerged. The article will address the question of what has changed in the social and individual regulation of these feelings by comparing old, mostly religious rituals, to more recent ones. The latter will be interpreted as part of a highly individualized quest for societal recognition and solidarity, demonstrating how processes of individualization, `solidarization' and globalization are interconnected. We present a developmental perspective regarding the difference in perceptions toward privacy between young and old. Here, we introduce the notion of privacy conceptions, that is, the specific ideas that individuals have regarding what privacy actually is. The differences in privacy concerns often found between young and old are postulated as the result of the differences found in their privacy conceptions, which are subsequently linked to their developmental life stages. The data presented have been obtained through a questionnaire distributed (...) among adolescents, young adults, and adults and provide support for this developmental perspective. This study is one of the first to include adolescents when investigating the privacy concerns among young and old. The results show that the privacy conceptions held by adolescents indeed differ from those held by young adults and adults in keeping with the expectations as seen from a developmental perspective. In addition, the areas in which the differences in privacy conceptions are found also reflect the strongest relationship with concerns. As such, these findings present an alternative perspective to the commonly held notion that young people are less concerned about privacy. (shrink)

Social epistemologists should be well-equipped to explain and evaluate the growing vulnerabilities associated with filter bubbles, echo chambers, and group polarization in social media. However, almost all social epistemology has been built for social contexts that involve merely a speaker-hearer dyad. Filter bubbles, echo chambers, and group polarization all presuppose much larger and more complex network structures. In this paper, we lay the groundwork for a properly social epistemology that gives the role and structure of networks their due. In (...) particular, we formally define epistemic constructs that quantify the structural epistemic position of each node within an interconnected network. We argue for the epistemic value of a structure that we call the (m,k)-observer. We then present empirical evidence that (m,k)-observers are rare in social media discussions of controversial topics, which suggests that people suffer from serious problems of epistemic vulnerability. We conclude by arguing that social epistemologists and computer scientists should work together to develop minimal interventions that improve the structure of epistemic networks. (shrink)

Recent findings necessitate revision of the traditional view of G protein‐coupled receptor (GPCR) signaling and expand the diversity of mechanisms by which receptor signaling influences cell behavior in general. GPCRs elicit signals at the plasma membrane and are then rapidly removed from the cell surface by endocytosis. Internalization of GPCRs has long been thought to serve as a mechanism to terminate the production of second messengers such as cAMP. However, recent studies show that internalized GPCRs can continue to either (...) stimulate or inhibit cAMP production in a sustained manner. They do so by remaining associated with their cognate G protein subunit and adenylyl cyclase at endosomal compartments. Once internalized, the GPCRs produce cellular responses distinct from those elicited at the cell surface. (shrink)

Scholars have long debated whether welfare policymaking in industrialized democracies is responsive to citizen preferences and whether such policymaking is more responsive to rich than to poor citizens. Debate has been hampered, however, by difficulties in matching data on attitudes toward particular policies to data on changes in the generosity of actual policies. This article uses better, more targeted measures of policy change that allow more valid exploration of responsiveness for a significant range of democracies. It does so by (...) linking multicountry and multiwave survey data on attitudes toward health, pension, and unemployment policies and data on actual policy generosity, not just spending, in these domains. The analysis reveals that attitudes correlate strongly with subsequent changes in welfare generosity in the three policy areas and that such responsiveness is much stronger for richer than for poorer citizens. Representation is likely real but also vastly unequal in the welfare politics of industrialized democracies. (shrink)

Traditional theory of mind (ToM) accounts for social cognition have been at the basis of most studies in the social cognitive neurosciences. However, in recent years, the need to go beyond traditional ToM accounts for understanding real life social interactions has become all the more pressing. At the same time it remains unclear whether alternative accounts, such as interactionism, can yield a sufficient description and explanation of social interactions. We argue that instead of considering ToM and interactionism as mutually (...) exclusive opponents, they should be integrated into a more comprehensive account of social cognition. We draw on dual process models of social cognition that contrast two different types of social cognitive processing. The first type (labeled Type 1) refers to process es that are fast, efficient, stimulus-driven, and relatively inflexible. The second type (labeled Type 2) refers to processes that are relatively slow, cognitively laborious, flexible, and may involve conscious control. We argue that while interactionism captures aspects of social cognition mostly related to Type 1 processes, ToM is more focused on those based on Type 2 processes. We suggest that real life social interactions are rarely based on either Type 1 or Type 2 processes alone. On the contrary, we propose that in most cases both types of processes are simultaneously involved and that social behavior may be sustained by the interplay between these two types of processes. Finally, we discuss how the new integrative framework can guide experimental research on social interaction. (shrink)

Religion can affect public support for the European Union. However, specifying the circumstances under which religion may become a stronger predictor of EU-support has so far been neglected. This article shows that the media play a role in this process and it is investigated to what extent the presence or absence of references to religious issues in EU news coverage primes people's religious attitudes to contribute to their evaluation of the EU. For this purpose, a content analysis of the (...) amount of religious news items in EU coverage in German and Dutch newspapers between 1997 and 2007 was conducted. Two points in time were chosen — 1998, when only a small amount of religious news items appeared in EU coverage, and 2005, when religious items reached a peak. Eurobarometer data were used to test the media priming proposition. The findings show that an increasing religious dimension in media coverage about the EU primes a linkage between religious and political considerations and thus influences the strength of the impact of religion on attitudes towards the EU. There is an increasing call for preventive state interventions in so-called families at risk—that is, interventions before any overt harm has been done by parents to their children or by the children to a third party, in families that are statistically known to be liable to harm children. One of the basic principles of liberal morality, however, is the citizen's right to be free from state intervention so long as no demonstrable harm has been done. On the other (...) hand, Joel Feinberg interprets the harm principle as a harm prevention principle, so that the risk of harm also might be a reason for interference. The question that needs to be asked, therefore, is whether enforced preventive intervention in the cases where families are judged to be at risk can be justified within the limits of liberalism. There is a well-established relationship between isolation and both morbidity and mortality in the context of addiction recovery, yet the protective effects of intimate and familial relationships have not been adequately assessed. The current paper uses the European Life In Recovery database to assess the association between relationship status and living with dependent children on recovery capital of people in recovery from drug addiction, operationalised by the Strengths And Barriers Recovery Scale. The study participants were drawn from the REC-PATH (...) study and supplemented by a second sample recruited by the Recovered Users Network across various European countries, resulting in a combined sample of 1,313 individuals completing the survey, primarily online. The results show that, in recovery, those who are married or co-habiting reported significantly greater recovery strengths and fewer barriers to recovery, and reported greater gains in recovery capital across their recovery journeys. Similar associations are found for participants who have dependent children living with them. There is also some indication that this association is stronger for female than for male participants. Finally, having more people that one can rely on and a greater proportion of people in recovery in the social network are both linked to greater recovery capital and greater self-reported growth in recovery capital. We conclude that this study provides further evidence in favour of a “social cure” in recovery, in which close familial ties are associated with stronger recovery resources. (shrink)

Language-related potentials are increasingly used to objectify adaptive neuroplasticity in stroke-related aphasia recovery. Using preattentive [mismatch negativity ] and attentive phonologically related paradigms, neuroplasticity in sensory memory and cognitive functioning underlying phonological processing can be investigated. In aphasic patients, MMN amplitudes are generally reduced for speech sounds with a topographic source distribution in the right hemisphere. For P300 amplitudes and latencies, both normal and abnormal results have been reported. The current study investigates the preattentive and attentive phonological discrimination ability (...) in 17 aphasic patients at two timepoints during aphasia recovery. Between the two timepoints, a significant improvement of behavioral language performance in both languages is observed in all patients with the MMN latency at timepoint 1 as a predictive factor for aphasia recovery. In contrast to monolinguals, bilingual aphasic patients have a higher probability to improve their processing speed during rehabilitation, resulting in a shortening of the MMN latency over time, which sometimes progresses toward the normative values. There is an increasing call for preventive state interventions in so-called families at risk—that is, interventions before any overt harm has been done by parents to their children or by the children to a third party, in families that are statistically known to be liable to harm children. One of the basic principles of liberal morality, however, is the citizen’s right to be free from state intervention so long as no demonstrable harm has been done. On the other (...) hand, Joel Feinberg interprets the harm principle as a harm prevention principle, so that the risk of harm also might be a reason for interference. The question that needs to be asked, therefore, is whether enforced preventive intervention in the cases where families are judged to be at risk can be justified within the limits of liberalism. Both the concept of a Darwinian tree of life (TOL) and the possibility of its accurate reconstruction have been much criticized. Criticisms mostly revolve around the extensive occurrence of lateral gene transfer (LGT), instances of uptake of complete organisms to become organelles (with the associated subsequent gene transfer to the nucleus), as well as the implications of more subtle aspects of the biological species concept. Here we argue that none of these criticisms are sufficient to abandon the valuable TOL (...) concept and the biological realities it captures. Especially important is the need to conceptually distinguish between organismal trees and gene trees, which necessitates incorporating insights of widely occurring LGT into modern evolutionary theory. We demonstrate that all criticisms, while based on important new findings, do not invalidate the TOL. After considering the implications of these new insights, we find that the contours of evolution are best represented by a TOL. (shrink)

The implementation of international human rights laws at the national and local levels relies on the framing of norms. Recent research has shown that international norms regarding child marriage have shifted from setting a minimum age limit to building the agency of girls to resist the practice, which can be either active or passive. Active agency requires taking action for its purpose, whereas passive agency involves acting in situations with limited options. The dominant discourse on child marriage often portrays girls (...) as victims, and this article adds to the existing literature on how child brides exert agency utilizing semiotics approach. Based on an extended qualitative study conducted at _Quarit Woreda_, the Amhara Regional State of Ethiopia, the article explores how the girls have been exerting transformative agency to resist the practice, or at least exercise limited agency to enforce their marital choice. It also contrasts them with female parents, where the latter are found to uphold mythical signification being one among the central norm holders. By doing so, the contribution seeks to understand the semiotic system—the structural resources that support versus socio-cultural factors that constrain their agency. This article also discusses the multifaceted difficulties faced by girls in challenging the well-established norm and the creative strategies they use to overcome impediments through networking and collaboration pathways. Lastly, the article suggests potential future interventions that aim to enhance girls’ transformative agency which in turn supports the effective enforcement of child marriage law in the study area. Considerable attention has been given to the accessibility of legal documents, such as legislation and case law, both in legal information retrieval (query formulation, search algorithms), in legal information dissemination practice (numerous examples of on-line access to formal sources of law), and in legal knowledge-based systems (by translating the contents of those documents to ready-to-use rule and case-based systems). However, within AI & law, it has hardly ever been tried to make the contents of sources of law, and (...) the relations among them, more accessible to those without a legal education. This article presents a theory about translating sources of law into information accessible to persons without a legal education. It illustrates the theory by providing two elaborated examples of such translation ventures. In the first example, formal sources of law in the domain of exchanging police information are translated into rules of thumb useful for policemen. In the second example, the goal of providing non-legal professionals with insight into legislative procedures is translated into a framework for making available sources of law through an integrated legislative calendar. Although the theory itself does not support automating the several stages described, in this article some hints are given as to what such automation would have to look like. (shrink)

The Quaestio in particular explores Scotus's distinction between a science "in itself" and one "for us" and, going beyond Scotus's own doctrine, shows how this distinction is applicable to metaphysics.The book is divided into three parts. Part 1 offers a critical edition of the Quaestio de cognitione Dei, which has hitherto been available in a plain transcription published by C. R. S. Harris in 1927. Harris's text was based on a single manuscript from the fifteenth century (Oxford, Merton College, Ms. 90); Goris bases his edition on a manuscript from the early fourteenth century (Assisi, Biblioteca Comunale, Ms. 172), one that does not attribute the text to Scotus. Goris highlights that the text has significant parallels in the prologue of John of Reading's Scriptum on the first book of the Sentences; there is presently not sufficient evidence for claiming that Reading is the author of the De cognitione Dei, but it does seem clear that either Reading or some other Franciscan friar relying on Reading's Scriptum authored the text between 1316 and 1325. The Quaestio itself consists of two articles. Two appendices to the edition document longer passages from Reading's Scriptum.Part 2 investigates the use of the distinction between a science in itself and one for us in Duns Scotus and some of the early Scotists. Scotus's doctrine developed over time. At Oxford Scotus taught that theology in se is about the divine essence in its particularity; theology for us is about the most perfect concept of God attainable for human beings by natural means, that is, the concept "infinite being." It falls to metaphysics to prove that there is such a kind of being. At Paris Scotus rather taught that both theology in se and theology for us are about the divine essence in its [End Page 549] particularity. The implication is that a strictly demonstrative science about God is possible for human beings in this present life, a knowledge of God that is completely independent of metaphysics. Goris argues that this shift in the view of theology explains the absence of Scotus's famous "twin doctrines" of the univocal concept of being and of being as the first adequate object of the intellect from his theological epistemology of the Parisian period. Not too surprisingly, in the wake of Scotus we find several authors grappling with the relationship between theology and metaphysics. The positions investigated by Goris vary considerably. Richard of Conington distinguishes between human metaphysical knowledge of being and God's own metaphysical knowledge of being; the latter represents a more perfect knowledge of both God himself and creatures as included under the concept of being. Francis of Marchia employs a distinction between a general metaphysics (about being as being) and a special metaphysics (about divine being), but on the level of science for us the special part of metaphysics is subordinated to the general one. Fictional realists maintain that fictional characters are part of the world’s ontology. In an influential article, Anthony Everett argues that the fictional realist is thereby committing herself to problematic entities. Among these are entities that are indeterminately identical. Recently, Ross Cameron and Richard Woodward have answered Everett’s worry using the same strategy. They argue that the fictional realist can bypass the problematic identities by contending that they are merely semantically indeterminate. This paper concisely surveys Everett’s original argument, Cameron’s and Woodward’s (...) responses, and then argues that the strategy employed by Cameron and Woodward fails to satisfactorily answer Everett’s worries. If coherence is to have justificatory status, as some analytical philosophers think it has, it must be truth-conducive, if perhaps only under certain specific conditions. This paper is a critical discussion of some recent arguments that seek to show that under no reasonable conditions can coherence be truth-conducive. More specifically, it considers Bovens and Hartmann’s and Olsson’s “impossibility results,” which attempt to show that coherence cannot possibly be a truth-conducive property. We point to various ways in which the advocates of (...) a coherence theory of justification may attempt to divert the threat of these results. (shrink)

In this paper I consider whether there is a measure of coherence that could be rightly claimed to generalize the notion of logical equivalence. I show that Fitelson’s (2003) proposal to that effect encounters some serious difficulties. Furthermore, there is reason to believe that no mutual-support measure could ever be suitable for the formalization of coherence as generalized logical equivalence. Instead, it appears that the only plausible candidate for such a measure is one of relative overlap. The measure I propose (...) in this paper is quite similar to Olsson’s (2002) proposal but differs from it by not being susceptible to the type of counterexample that Bovens and Hartmann (2003) have devised against it. The introduction of novel diagnostic techniques in clinical domains such as genomics and radiology has led to a rich ethical debate on how to handle unsolicited findings that result from these innovations. Yet while unsolicited findings arise in both genomics and radiology, most of the relevant literature to date has tended to focus on only one of these domains. In this article, we synthesize and critically assess similarities and differences between “scanning the body” and “sequencing the genome” from an ethical (...) perspective. After briefly describing the novel diagnostic contexts leading to unsolicited findings, we synthesize and reflect on six core ethical issues that relate to both specialties: terminology; benefits and risks; autonomy; disclosure of unsolicited findings to children; uncertainty; and filters and routine screening. We identify ethical rationales that pertain to both fields and may contribute to more ethically sound policies. Considerations of preserving public trust and ensuring that people perceive healthcare policies as fair also support the need for a combined debate. (shrink)

Despite the Aristotelian renaissance in the philosophy of education, the development of virtue has not received much attention. This is unfortunate, because an attempt to draft an Aristotelian model of moral development can help philosophers to evaluate the contribution Aristotelian virtue ethics can make to our understanding of moral development, provide psychologists with a potentially richer account of morality and its development, and help educators to understand the developmental phase people are in. In the article, it is argued that the (...) Aristotelian categories of the ‘morally indifferent’, ‘un-self-controlled’, ‘self-controlled’ and ‘properly virtuous’ can be interpreted as the successive stages or levels of a comprehensive developmental model. For each stage, it will be made clear whether people are committed to virtue, whether they act virtuously or not, whether they act with pleasure or pain, and which desires and reasons they have for acting. The article closes with suggestions about what needs to be done if the proposed Aristotelian account of moral development is to become psychologically more realistic and educationally useful. Although climate change jeopardizes the fundamental human rights of current as well as future people, current actions and ambitions to tackle it are inadequate. There are two prominent explanations for this motivational gap in the climate ethics literature. The first maintains that our conventional moral judgement system is not well equipped to identify a complex problem such as climate change as an important moral problem. The second explanation refers to people’s reluctance to change their behaviour and the temptation to shirk (...) responsibility. We argue that both factors are at play in the motivational gap and that they are complemented by crucial moral psychological insights regarding moral disengagement, which enables emitters to dissociate self-condemnation from harmful conduct. In this way, emitters are able to maintain their profligate, consumptive lifestyle, even though this conflicts with their moral standards with respect to climate change. We provide some illustrations of how strategies of moral disengagement are deployed in climate change and discuss the relationship between the explanations for the motivational gap and moral disengagement. On the basis of this explanatory framework, we submit that there are three pathways to tackle the motivational gap and moral disengagement in climate change: making climate change more salient to emitters and affirming their self-efficacy; reconsidering the self-interested motives that necessitate moral disengagement; and tackling moral disengagement directly. If climate change represents a severe threat to humankind, why then is response to it characterized by inaction at all levels? The authors argue there are two complementary explanations for the lack of motivation. First, our moral judgment system appears to be unable to identify climate change as an important moral problem and there are pervasive doubts about the agency of individuals. This explanation, however, is incomplete: Individual emitters can effectively be held morally responsible for their luxury emissions. Second, doubts (...) about individual agency have become overly emphasized and fail to convincingly exonerate individuals from responsibility. This book extends the second explanation for the motivational gap, namely that the arguments for the lack of individual agency do in fact correspond to mechanisms of moral disengagement. The use of these mechanisms enables consumption elites to maintain their consumptive lifestyles without having to accept moral responsibility for their luxury emissions. (shrink)

ABSTRACT This paper aims to offer a new perspective on role modelling by examining adolescents’ own efforts to lead a morally virtuous life. While traditional approaches to moral education emphasize the importance of teachers as role models, this study proposes a shift in focus towards adolescents’ own role models. Drawing on the philosophical concept of moral self-cultivation and psychological insights on identity development and social cognitive learning, it is argued that adolescents have the ability to cultivate their moral character by (...) emulating others. However, empirical evidence suggests that adolescents often do not perceive teachers as their role models. Consequently, moral educational theories are advised to demand less of teachers as role models. Teachers could invest more time in understanding students’ personal role models and encourage them to compare these role models with their own behavior. By acknowledging and addressing students’ role models, teachers can facilitate the moral self-cultivation of adolescents. (shrink)
