Ahmed Mâhir, who was born in Kastamonu in 1860-70, is one of the last period Ottoman scholars and is known by the penname "Ballıkızâde". He lived in the 19th century, during the Constitutional Monarchy period when the West progressed in many directions and the Ottoman Empire began to lose land alongside its reforms. After taking lessons from the scholar Ahmed Hicâbî, he also gave lectures and educated many students, and taught tafsir and theology for thirteen years at Daru'l-Fünûn Faculty of (...) Theology and Medresetü'l-Vâizîn. In addition to this, the scholar, who has served as a member of the Supreme Court, a judge, and a deputy, also appears as a political personality. Mâhir, who has four published works, is one of the important personalities that Kastamonu raised in religious, political, and literary fields. In this study, the Constitutional Era and the position of the science of tafsir in this period are discussed. Secondly, after transferring information about Ahmed Mâhir's life, his exegesis method on the works of "Mu'cizât-ı Kur'âniyye" and "al-Fâtiha fî Tefsîri'l-Fâtiha" was examined. The qualitative research method and document analysis technique wasused for this study. In addition, the data were analyzed with the help of description, sampling and association techniques. The fact that Ahmed Mâhir has both a political and religious personality and that we have four works about him today makes it important to research him. In this context, the study aims to reveal Ahmed Mâhir's exegesis based on his works. A doctoral thesis on him, in which his mystical aspect was emphasized, and an article by the same person, again, two master's theses were made about the work he wrote in the field of Sufism. Some sources provide concise information about his life and works, and brief information given in some biographical or literature studies. But his works named "Mu'cizât-ı Kur'âniyye" and "al-Fâtiha fî Tefsîri'l-Fâtiha" have not been studied academically. This situation made this study important. In addition, the existence of various interpretations on whether the author's interpretation of Surah Fâtiha is original or not has caused us to consider this issue as a problem. As a result of our analysis, Ahmed Mâhir has conveyed the negative political or religious situations of his period, especially in his work "Mu'cizât-ı Kur'âniyye". Based on the idea that the Qur'an is perfect and contains everything, he used the verses to correct these situations. His work "el-Fâtiha fî Tefsîri'l-Fâtiha" shows us both the traces of the Ottoman tafsir accumulation of that period and that this scholar has a scientific tradition on tafsir, hadith, and literature. Faith has a great place in the epistemology of Augustine, who adopted the phrase “you will not understand unless you believe (_nisi credideritis, non intellegetis_).” This situation has led to the comments by the philosophers that reason is insufficient or has no importance in Augustine, but according to Augustine, reaching the truth is only possible with the working of reason and belief together, and it cannot happen without any of them. The rational part of the soul (_animus_), which is at (...) the top of it, is like a door to God, but faith is essential for this to be possible. According to Augustine, the reason why faith is necessary for the realization of divine illumination, which is the only way to reach the truth, is that the will, polluted by original sin, hinders the mind, and that which will enable the mind to grasp all mysteries is the purification of the will by faith. The comprehensive analysis of international media coverage investigates the interplay of linguistic and thematic choices in shaping narratives. With a dual focus on macro and micro levels of discourse, the study uncovers diverse approaches among foreign media outlets. Each outlet adopts a distinctive thematic approach at the macro level, emphasizing key figures and sociopolitical contexts. Al Jazeera spotlights competition, BBC underscores post-election polarization, CNN focuses on Erdogan's victory, and Euronews provides insights into national challenges. Visual elements, like photographs, contribute significantly to framing events, offering nuanced political messaging. Micro-level analysis explores linguistic choices, syntax, and rhetoric, emphasizing the active voice to underscore leaders' agency. Deliberate use of the passive voice in presenting election results maintains a neutral tone. The way sentences are structured and the cause-and-effect connections help readers understand political developments by providing context. Suffering repeated experiences of moral distress in intensive care units due to applications of futility reflects on nurses’ patient care negatively, increases their burnout, and reduces their job satisfaction. This study was carried out to investigate the levels of job satisfaction and exhaustion suffered by intensive care nurses and the relationship between them through the futility dimension of the issue. The study included 138 intensive care nurses. The data were obtained with the futility questionnaire developed by the researchers, Maslach Burnout (...) Inventory and Minnesota Satisfaction Questionnaire. It was determined that nurses who agreed to the proposition that the application of futility demoralizes health-care professionals had low levels of job satisfaction but high levels of depersonalization. It was determined that nurses had moderate levels of job satisfaction, emotional exhaustion, and personal achievements but high levels of sensitivity. Nurses’ job satisfaction and sensitivities are positively affected when they consider that futility does not contradict the purposes of medicine. (shrink)

SummarySir William Willcocks (1852–1933) was a prominent British irrigation engineer who served in various British colonies. Best known as the chief designer of the Old Aswan Dam, Willcocks was born and trained in India, achieved prominence with his contribution to the development of centralized and perennial irrigation in Egypt, and was hired at the end of his career by the Ottomans to restore the ancient irrigation works of Mesopotamia (which was then on the verge of being acquired by the British). In this article, I follow Willcocks' voyages across the British Empire and show how hydraulic science moved from one colonial centre to another, and how this movement contributed to the construction and maintenance of colonialism on the ground. Often sent to newly acquired territories with ambitious projects to redesign the landscapes of property and agriculture, Willcocks and other engineers who gained their expertise in the colonies relied on lessons from their day-to-day struggle with the land and other social actors' competing agendas to develop the daily techniques that helped establish colonial rule. As the reception of Willcocks' work in London illustrates, it was in the metropole that engineers' practices were translated into a colonial symbolism that had large-scale technical systems as the right tools for the job of subordinating unruly waters and Nature writ large. Moral distress is the distress experienced by a professional when he or she cannot fulfill the correct action due to several obstacles, although he or she is aware of what it is. The level of moral distress experienced by nurses working in intensive care units varies from one country/culture/institution to another. However, in Turkey, there is neither a measurement tool used to assess moral distress suffered by (...) nurses nor a study conducted on the issue.Aim/objective:The study aims to (a) validate the Turkish version of the Moral Distress Scale–Revised to be used in intensive care units and to examine the validity and reliability of the Turkish version of the scale, and (b) explore Turkish intensive care nurses’ moral distress level.Method:The sample of this methodological, descriptive, and cross-sectional design study comprises 200 nurses working in the intensive care units of internal medicine and surgical departments of four hospitals in three cities in Turkey. The data were collected with the Socio-Demographic Characteristics Form and The Turkish Version of Moral Distress Scale–Revised.Ethical considerations:The study proposal was approved by the ethics committee of the Faculty of Medicine, Cumhuriyet University. All participating nurses provided informed consent and were assured of data confidentiality.Results:In parallel with the original scale, Turkish version of Moral Distress Scale–Revised consists of 21 items, and shows a one-factor structure. It was determined that the moral distress total and item mean scores of the nurses participating in the study were 70.81 ± 48.23 and 3.36 ± 4.50, respectively.Conclusion:Turkish version of Moral Distress Scale–Revised can be used as a reliable and valid measurement tool for the evaluation of moral distress experienced by nurses working in intensive care units in Turkey. In line with our findings, it can be said that nurses suffered low level of moral distress. However, factors which caused the nurses in our study to experience higher levels of moral distress are inadequate communication within the team, working with professionals they considered as incompetent, and futile care. Understanding the developments in the early period when Ṣūfism became widespread in the Islamic society, both necessitates studies on other disciplines from Ṣūfism, and also requires the consideration of Ṣūfism from the perspective of other religious sciences. In this regard, one of the important names is the famous Ḥanbalī scholar Abū Yaʿlā al-Farrā. Abū Yaʿlā al-Farrā who was interested in ḥadīth, Islamic law and tafsīr as well as Ṣūfism and theological issues, has an important place especially with his works in (...) the Ḥanbalī tradition. Abū Yaʿlā, who grew up in a period when the Sunnī theology schools were formed, spread and exercised its influence, he maintained the Ḥanbalī viewpoint and criticized both some schools of kalām and the Ṣūfis by using the kalām method. Therefore, analyzing his views is important for understanding the formative conditions of the first period of religious science tradition, as well as giving clues about the relationship between Ṣūfism and Ḥanbalī tradition. In this article, his views of zuhd, tawakkul and Ṣūfism in general is examined in the context of his works Kitāb al-Muʿtamad fī uṣūl al-dīn and Kitāb al-tawakkul, and his importance in understanding the relationship between Ṣūfism and Ḥanbalī tradition is emphasized. In this paper, I will try to address the question of how to conceptualise a form of life that is better than others, by putting Rahel Jaeggi’s pragmatism inspired critical theory and Giorgio Agamben’s genealogical perspective in conversation. I argue that for both authors the critique of forms of life is intertwined with “the critique of how”. Not restricting itself to ethical abstinence, and without imposing certain norms upon forms of life, “the critique of how” focuses on the reflexive capacity (...) of forms of life, or their ability to question how they become what they are, which gives rise to an increased perception of the connections and continuities of activities in which they are engaged. In this sense, it may become possible to free the present in order to open it to contingency, and to see the glimpses of a better form of life. (shrink)

İnsan özgürlüğü konusunda genellikle iki çeşit yaklaşım söz konusudur: Bunlardan birincisi filozofların getirmiş oldukları yaklaşım diğeri ise dinlerin getirmiş oldukları yaklaşımdır. Hürriyet kavramı katı bir tarif/tanımlama kalıbına kolayca sığabilen bir kavram değildir. Mantıkçıların “ağyârını mâni‘ efrâdını câmi‘” diye nitelendirdikleri tam ve tümel bir tanım yapılamamıştır. Dolayısıyla filozoflar, bilginler kendi çağlarının düşünce ortamına, entelektüel birikime göre (...) hürriyet kavramını temellendirmeye çalışmışlardır. Yukarıda da ifade edildiği gibi hürriyet meselesi çözümü zor bir konudur. Bu nedenden dolayı bu çalışmamızda öncelikle hürriyet kavramının etimolojik tahlilini, tanımını yaptıktan sonra Mâtürîdî kelâm düşünürlerinin hürriyet problemine yaklaşım tarzları, çözüm önerileri ve tanımlama biçimleri değerlendirilmeye çalışılacaktır. In this paper reling on Agamben’s genealogical endeavour with regard to the concept of oath, I shall try to discuss how he renders the relation between language and the destituent power that will lead me to address ‘the new experience of the word’, namely, pistis (faith), which is placed at the centre of the messianic announcement. In order to open up this point, I will take into consideration Jacques Derrida’s arguments related to faith and language which appear to be one (...) of the main addressees of Agamben’s critical undertaking, even though he is never mentioned in Agamben’s later book The Sacrament of Language, in which he elaborates the contours of the relation between language and pistis. For Derrida the opening of language is based on an oath, a promise of saying ‘yes’ and thus, speaking is an act of faith. However, it is this functioning of language that has to be suspended according to Agamben, since it is this very dispositif that is connected to sovereign power. It is through this suspension the living being who has language may cease to be homo sacer before language and sovereign power. (shrink)

This study aims to investigate the experiences and problems of foreign nationals in Turkey, concerning microaggressions. Thus, it was aimed to find out which types of microaggressions -and at what frequency- are experienced by people who come to Turkey for different reasons like education, pursuit of a better life or escaping from war. The study was conducted in five different cities of Turkey. Students from primary school to university, teachers, parents and doctors took part in the study. The participants were (...) asked the single question “Do you ever experience deliberate or undeliberate insults, whether verbal or behavioral, targeting your ethnic identity and diversity in Turkey?” The results of the study show that microaggression is a very serious problem in Turkey. It can be gathered from the findings that Turkish people are not as tolerant to foreign people as they used to be. Behaviors that make people of foreign origin feel like second-class citizens and alienated take place quite often. Foreigners are usually connected with negative occurrences and they are reminded that they are not welcome in this country. These people are also accused of causing many misfortunes in the country. The study also exhibits that foreign nationals suffer greatly from prejudices about their cultures and they become the target of explicit and direct insults particularly regarding their race. Background: Determination of the factors affecting missed nursing care and the impact of ethical leadership is important in improving the quality of care. Aim: This study aims to determine the missed nursing care and its relationship with perceived ethical leadership. Research design: A cross-sectional study. Participants and research context: The sample consisted of 233 nurses, of whom 92.7% were staff nurses and 7.3% were charge nurses, who work in three different hospitals in Turkey. The study data were collected using a (...) personal and professional characteristics data form, the Missed Nursing Care Survey, and the Ethical Leadership Scale. Ethical considerations: The study was approved by the non-interventional ethics committee of Dokuz Eylül University Ethics Committee for Noninvasive Clinical Studies. All participants’ written and verbal consents were obtained. Findings: The most missed nursing care practices were ambulation, attending interdisciplinary care conferences, and discharge planning. According to the logistic regression analysis, sex, the number of patients that the nurse is in charge of giving care, the number of patients discharged in the last shift, and satisfaction with the team were determined as factors affecting missed care. No significant relationship was found between ethical leadership and missed nursing care, and a weak but significant relationship was found between the clarification of duties/roles subscale and missed nursing care. Discussion: Ethical leaders should collaborate with policy-makers at an institutional level to particularly achieve teamwork that is effective in the provision of care, to control missed basic nursing care, and to organize working hours and at the country level to determine roles and to increase the workforce. Conclusion: The results of this study contribute to the international literature on the most common type of missed nursing care, its reasons, and the relationship between the missed care and ethical leadership in a different cultural context. The International Covenant on Economic, Social and Cultural Rights was signed by Turkey in 2000 and has been in force since September 23rd, 2003. For this reason, the Covenant is considered as act of parliament in our domestic law, and unlike the general procedure of application of the law, it can not be alleged to contradict the Constitution (According to Article 90 of the Turkish Constitution). The article 12 of the Covenant defines the right to health and its content. In (...) the article 12 of the Covenant, in its General Comment No. 14 published in 2000, the right to the highest attainable standard of health was interpreted and commented upon. This document contains a detailed description of the right to health, its content, and its obligations to State parties. Although this Comment of the Covenant is not binding, it is a document to which the State parties refer when taking measures related to health services. Every publication and comment on the right to health was based on the General Comment 14 of the Covenant. The Article 12 was reinterpreted by the Covenant on May 2nd, 2016 in the context of rights to sexual and reproductive health. İit has been emphasized that legal, procedural, practical and social barriers limit the access of individuals to full range sexual and reproductive health services. It has also been pointed out that accessibility of sexual and reproductive health services is a distant target for women and girls. Moreover, it has been stated that discrimination that increases exclusion in legislation and practice limits lesbian, gay, bisexual, transgender and intersex (LGBTI) individuals and disabled people'senjoyment of sexual and reproductive health rights. For this reason, it is stated that although commenting on the rights of sexual health and reproductive health is included in 14 comments, it is important to make an interpretation about them. This comment is an interpretation of a binding Convention. Therefore; It is a document that will provide guidance on measures to be taken by States Parties in respect of their rights to sexual health and reproductive health. At the same time, obstacles to discrimination in medical practice bring important approaches in terms of respect for autonomy and respect for private life. In our article, information about the content of the ESKHK's interpretation and possible reflections of this content in the field of medical law and ethics will be given. (shrink)

It is this reasoning that informs the popular association of “anarchy” with “chaos.” Anarchists believe that when freed from the debasing influence of oppressive social and political institutions, individuals will lean toward harmonious co‐existence. SAMCRO's degeneration from what John Teller originally intended does not mean that anarchism is an unrealizable ideal. J.T.'s idealized version of (...) anarchism is certainly seductive as it offers escape from life's constraints and promises a freedom which we all at one time or another long for. The club has become increasingly unworthy of its name‐unless we take “anarchy” in its colloquial sense of “chaos” or “disorder.” Once we understand what being a Son of Anarchy should entail, it is clear that SAMCRO is not living up to its name. Why is American punishment so cruel? While in continental Europe great efforts are made to guarantee that prisoners are treated humanely, in America sentences have gotten longer and rehabilitation programs have fallen by the wayside. Western Europe attempts to prepare its criminals for life after prison, whereas many American prisons today leave their inhabitants reduced and debased. In the last quarter of a century, Europe has worked to ensure that the baser human inclination toward vengeance is not reflected by state (...) policy, yet America has shown a systemic drive toward ever increasing levels of harshness in its criminal policies. Why is America so short on mercy? In this deeply researched, comparative work, James Q. Whitman reaches back to the 17th and 18th centuries to trace how and why American and European practices came to diverge. Eschewing the usual historical imprisonment narratives, Whitman focuses instead on intriguing differences in the development of punishment in the age of Western democracy. European traditions of social hierarchy and state power, so consciously rejected by the American colonies, nevertheless supported a more merciful and dignified treatment of offenders. The hierarchical class system on the continent kept alive a tradition of less-degrading "high-status" punishments that eventually became applied across the board in Europe. The distinctly American, draconian regime, on the other hand, grows, Whitman argues, out of America's longstanding distrust of state power and its peculiar, broad-brush sense of egalitarianism. Low-status punishments were evenly meted out to all offenders, regardless of class or standing. America's unrelentingly harsh treatment of trangressors--this "equal opportunity degradation"-- is, in a very real sense, the dark side of the nation's much vaunted individualism. Here I speak in favor of the view that life's meaning can be found in the pursuit of pleasure. I first present an argument for this view that is grounded in a traditional concept of meaning. To help ease remaining concerns about accepting it, I then draw attention to four things the view does not imply: (1) that we have a reason to take hedonistic theories of meaning seriously; (2) that meaning can be found in the deeply immoral, the deeply (...) ignorant, or the deeply repulsive pursuit of pleasure; (3) that there is a significantly easier route to meaning than the pursuit of morality, the pursuit of knowledge, or the pursuit of art; and (4) that meaning can be found in pursuits that involve only baser aspects of human nature. Ayrıca kültüre ve sanata yönelik sert yaklaşımı, İslam medeniyeti açısından nihilist bir bakışı ifade etmektedir. Sünnî dünyada Selefilik ile ilgili bir kafa karışıklığı göze çarpmaktadır. Résumé En taxant le travail apologétique de Ferdinand Brunetière d’« accueillant et généreux», le théologien Edgar Janssens reprenait, en des termes moins dévalorisants, l’idée développée par Charles Maurras selon laquelle les constructions théoriques du directeur de la Revue des Deux Mondes étaient intellectuellement des plus fragiles. Du reste, la grande majorité des philosophes et théologiens qui évaluèrent l’apologétique de Brunetière restèrent dubitatifs devant cette tentative de convoquer la philosophie d’Auguste Comte pour la défense du catholicisme. Pourtant, Brunetière s’insérait dans un (...) mouvement plus vaste de rapprochement de certains courants intellectuels catholiques avec le positivisme dans les années 1890-1900. Des deux aspects essentiels de cette apologétique, l’un épistémologique et l’autre sociologique, c’est le premier qui suscita pour l’essentiel les réserves des intellectuels catholiques. En effet, en pleine crise moderniste, il était difficile, comme le faisait Brunetière, de mettre en avant une théorie relativiste de la connaissance et de baser les conditions de possibilité de la science sur l’Inconnaissable de Spencer. Mais la logique de Brunetière n’était pas celle des théologiens. Sa stratégie d’occupation de l’espace public, les modalités de sa gestion des polémiques ne pouvaient s’éloigner d’un certain nombre de références communes avec ceux-là mêmes qu’il entendait combattre. Political philosophers often draw their conclusions on how political systems ought to be by first investigating human nature and then proposing recommendations extrapolating from those investigations. They attempt to do this by creating a hypothetical ‘state of nature’ where human beings would be unaffected by social, political, and cultural paradigms and can act freely in pursuit of their instincts, thereby revealing their true nature. English philosopher Thomas Hobbes followed this method of investigation and found that human beings are naturally violent, (...) individualistic, warlike and therefore concluded that political theory ought to be as such to prevent human beings from acting out their baser impulses through draconian authoritative measures when necessary. In this paper, I challenge Hobbes’s claim on human nature by citing contemporary research on cognitive sciences which demonstrates that human beings have a natural predisposition to believe in supernatural agency (God/s) and therefore in the state of nature must behave in such a way as contemporary psychologists discovered investigating the effect of religiosity on human beings such as increased cooperation, selfless behavior towards genetically unrelated strangers, reduced crime rate deterred by supernatural punishment, etcetera. I argue that if we take into account the human propensity to believe in the supernatural agency then the state of nature hypothesized by Hobbes would need to be modified and therefore so would his political theory. Given the integration of cognitive science of religion into the state of nature, I conclude that the ideal political system must be centered around religion. We should seek an ethic internal to marketing arising from marketing's societal function, rather than imposing some add-on ethic. This suggests that marketing should enhance the information and the freedom the potential customer brings to the market transaction. Defining and achieving this information and freedom is difficult, but marketers suggest that the market itself drives out major violators, a suggestion less persuasive concerning increasingly complex goods and services. Marketing also is tempted to appeal to our baser, darker side. These problems (...) are better addressed through self-regulation guided by a vision of advertising and business in the service of society, and by the marketer's own sense of integrity than through external regulation. Nylig igangsatte FN Post-2015, sin nye utviklingsagenda. Sentralt er en global kamp for bedret helse, hvor det å leve et menneskeverdig liv står i sentrum. Imidlertid er forståelsen av selve helsebegrepet omstridt. Noen mener at det bør knyttes an til jus og menneskerettigheter, mens andre foreslår etikk og menneskeverd. Dette hviler i sin tur på motstridende menneskesyn i den globale helseetiske diskursen, nemlig mennesket som enten autonomt eller avhengig. I artikkelen analyserer jeg denne debatten ut fra det jeg hevder er (...) Martha Nussbaums globale helseetikk, som baseres på hennes kapabilitetstilnærming så vel som begrep om ‘helse som livskvalitet’. Some believe that it should be linked to law and the human rights, while others suggest ethics and human dignity. Which in turn rests on conflicting stands in the global health ethical discourse regards to the view of humanity, namely either as autonomous or dependent. In the paper I analyse this discourse, in which my point of departure is Martha Nussbaum’s capabilities approach as well as her concept of health as life quality. This I read exactly as a global health ethics. KimballIntroductionDoes the ability to feel pity toward the unfortunate represent one of humanity's better instincts, on par with the capacity for love, compassion, and forgiveness? Or is pity actually one of our morally baser emotions, like jealousy, envy, or hatred, because pity can include contempt for its object and an attitude of morally reprehensible superiority on the part of the pitier? Surprisingly, there is (...) little philosophical consensus on this issue, with informed opinion nearly equally divided. That the same emotion can elicit such contrary evaluations shows how elusive a clear understanding of pity can be.Furthermore, is there something wrong—either logically or morally—with attempting to arouse the emotion of pity in others when they do not already feel it themselves (or do not feel it as intensely as we want them to)? Should appeals to pity be rejected because any emotion is inimical to clear thinking or simply irrelevant to the justification of action? Or is there something particularly morally reprehensible about trying to manipulate another's emotions and actions specifically on the basis of pity? Alternatively, at least in some cases could an exhortation to pity be an acceptable, even desirable, aspect of moral education or an often-necessary reminder to care about the misfortunes of others and not just to pursue our own self-interests? La création récente du diagnostic de trouble dysphorique prémenstruel (TDPM) dans le DSM-5 a été contestée sous de multiples angles. Les principales critiques mettent en avant les lacunes en faveur de la validité du TDPM, ainsi que le risque de pathologisation et de stigmatisation des changements physiques et comportementaux vécus par les femmes pendant leur phase prémenstruelle. Pour éclairer cette controverse, j’emprunte certains outils du cadre conceptuel des injustices épistémiques (IE) développé par Miranda Fricker. Plus précisément, je vais me baser (...) sur de récents travaux qui ont tenté d’appliquer ce cadre aux processus de catégorisation en médecine et en psychiatrie. Cela me permettra de mettre au jour un angle mort du débat actuel sur le TDPM, soit les perspectives des personnes touchées par ces symptômes. Ces points de vue ont été généralement négligés, mais le cadre des IE nous permet de recentrer le débat sur les intérêts et les besoins des personnes affectées par les processus de catégorisation psychiatrique. La possibilité de transplantation d’organes a posé de nouveaux problèmes à l’éthique médicale aussi bien qu’à la médecine clinique. Deux systèmes tentent de résoudre l’un de ces problèmes, celui qui concerne l’approvisionnement en organes. Nombre d’États ont adopté le système « optin » qui cherche à répandre la conscience du problème et du choix personnel de l’individu de faire le don de ses organes. Un autre système, appelé « optout » ou « accord tacite », où tous les membres de (...) la société sont considérés comme donateurs potentiels, a été introduit dans certains pays. Dans ce système, les individus doivent indiquer explicitement qu’ils ne souhaitent pas donner leurs organes, faute de quoi ils sont considérés comme donateurs. En essayant de baser notre argumentaire sur les diverses justifications, nous soutenons que le système « optout » est plus juste, compte tenu du droit à l’accès aux soins médicaux nécessaires. L'étude des faits, dont nous n'avons pu donner que quelques échantillons, ne laisse pas de doute sur la découverte tardive de la notion de hasard et la formation progressive du raisonnement probabiliste. On aurait pu s'attendre à trouver une intuition de la probabilité: la realité quotidienne offre le spectacle d'un mélange inextricable de faits et de séquences causales. Ce n'est qu'en théorie ou encore dans une certaine mesure en laboratoire que les faits et relations causales sont simplifiés et dissociés au (...) point de nous permettre des déductions certaines. Dans la vie courante on est plus souvent réduit à deviner et à baser ses prévisions sur des fréquences empiriques que sur des lois et équations simples et rigoureuses. Et pourtant l'expérimentation psychologique prouve que l'attitude probabiliste, quoique suggérée et entretenue par les faits, n'est pas primitive; bien au contraire, elle ne se construit qu'à partir d'un certain niveau de raisonnement et en interdépendance étroite avec celui-ci. La notion de hasard est étrangère à toute mentalité primitive, aussi bien celle du jeune enfant que celle dite du „primitif” et de l'obsédé en état de régression pathologique, qui chargent volontiers les événements fortuits de significations subjectives et miraculeuses. La notion de hasard et le raisonnement probabiliste en général ne sont accessibles qu'à une mentalité objective et rationnelle, capable de discerner, grâce à des mécanismes opératoires, le domaine du déductible de celui du fortuit et à structurer ce dernier par la méthode combinatoire en un système de probabilités, dont la méthode génétique permet d'analyser le processus et l'évolution. Die verbalen oder begrifflichen Unterschiede führen uns zu der falschen Annahme, dass den Elementen, welchen im Denken oder im sprachlichen Ausdruck weniger Bedeutung zugemessen wird, auch weniger Bedeuten in Wirklichkeit zukommen, oder dass sie weniger real sind.Die bedeutendste Anwendung (...) dieser Lehre auf die Biologie betrifft die Interpretation des „Individuellen”. Soll man das Individuum als eine Einheit verstehen, oder kommt der Begriff der Einheit einerseits den Teilen zu, wie z. B. Zellen, Molekülen und Atomen, oder andererseits höheren und synthetischen Einheiten wie z.B. Klassen, Arten, dem „élan vital”, u.s.w. ? Cet article explore les conséquences pour le libéralisme politique de considérer l’existence d’un pluralisme raisonnable au sujet des différentes conceptions du juste. Comment une conception publique de la justice peut se développer malgré un désaccord raisonnable et profond sur les termes mêmes de cette justice ? En comparant le libertarisme, la justice comme équité et l’égalitarisme strict, il sera montré que les concepts fondamentaux de ces conceptions du juste sont essentiellement contestés. En guise de solution, deux conditions seront suggérées afin (...) de faire en sorte que la conception publique de la justice en soit une de tolérance politique : premièrement, elle devra se baser sur une liste de droits minimaux reconnus par les différentes conceptions raisonnables du juste; et deuxièmement, si la conception publique de la justice a pour ambition de se développer au-delà du dénominateur commun, elle devra offrir des mesures compensatoires à ceux supportant des conceptions du juste plus restrictives. À certains égards, cette problématique et ces accommodements s’apparentent à ce qui est déjà proposé au sujet de multiculturalisme. (shrink)

La position résolument extensionaliste de Quine a été appuyée par des arguments de nature différente, dans ses multiples articles destinés à rejeter le projet de logique modale. On peut classer ces arguments en trois catégories : un argument naturaliste, où l’auteur tente de baser le langage scientifique sur une notation tâchée de décrire la “structure ultime de la réalité” ; un argument esthétique, où Quine fait allusion à des raisons de clarté et d’efficacité démonstrative pour privilégier la théorie des fonctions (...) de vérité ; un argument pratique, dans la mesure où Quine défend la logique classique sur la base du “principe de mutilation minimum”. A travers une étude de ses écrits relatifs aux attitudes propositionnelles, nous montrerons que la philosophie de la logique de Quine a prolongé la partie épistémologique de son oeuvre, optant finalement pour une stratégie de réduction naturaliste des intensions, à l’image du mouvement engagé par Word and Object et prolongé par From Stimulus to Science. Ce projet se soldera par un échec relatif, et Quine résumera cette désillusion par un fossé entre les structures du langage et du monde : la thèse du “monisme anomal” de Davidson sera le dernier mot, amer, du défenseur acharné de la logique classique. Quoique leibniz donne l'apprence de baser sa philosophie sur le principe de l'identite, c'est pourtant sur celui de la raison suffisante qu'il insiste le plus dans son oeuvre. ce principe de la raison suffisante joue un role majeur parce que leibniz derive sa conception de la substance d'une analogie entre le sujet et les attributs des propositions et les concepts de substance et leurs attributs. cette analogie mene a une theorie de retenue de la verite et a une autre qui (...) affirme que les attributs sont inherents a la substance: theories compatibles avec la raison suffisante mais non avec celle de l'identite. leibniz n'a ps compris la conception de la substance chez spinoza dans laquelle les attributs sont identiques a la substance. le raisonnement de leibniz contre spinoza n'est donc guere convainquant. je suggere que la raison de ce malentendu ne releve pas uniquement de la logique de leibniz, mais aussi d'une theologie basee sur une ame d'une immortalite qui persiste et sur la theorie d'une morale vengeresse. I Norge er ikke surrogati tillatt, og myndighetene fraråder norske statsborgere å benytte seg av surrogati i utlandet. I denne artikkelen fokuserer vi på kommersiell gestational surrogati og stiller spørsmålet: Bør man tillate at norske statsborgere benytter seg av surrogati i India? De etiske problemstillingene rundt surrogati er mange og sammensatte og blir spesielt utfordrende når tjenesten tilbys i et land med store kulturelle og økonomiske forskjeller både internt og i forhold til Norge. Vi baserer analysen og drøftingen av dette (...) etisk utfordrende spørsmålet på Beauchamps og Childress sin veletablerte metodiske tilnærming innen biomedisinsk etikk. Vi anvender de fire allmennmoralske prinsipper: respekt for autonomi, velgjørenhet, ikke-skade og rettferdighet på sakskomplekset for å synliggjøre spenningene involvert i dette etiske dilemmaet. Med full bevissthet om at det ikke finnes noen lettvinte og omkostningsfrie løsninger på dilemmaer generelt og dette spesielt, konkluderer vi med at interessene til de berørte parter, og spesielt surrogatmødrenes, kan bli bedre ivaretatt om surrogati tillates under omfattende reguleringer. Dersom man velger å gjøre praksisen illegal, vil man også miste mulighetene til å påvirke prosessen og sikre rettighetene til de involverte partene.Nøkkelord: surrogati, Norge–India, utnyttelse, autonomi, regulering av prosessenEnglish summary: Should Norwegian citizens be permitted to use surrogacy in India?Surrogacy is not permitted in Norway, and the government strongly advises against Norwegian citizens travelling abroad to have children through the use of the surrogacy industry. In this article, we focus on commercial gestational surrogacy and debate the question: Should Norwegian citizens be permitted to use surrogacy in India? The ethical concerns regarding surrogacy are complex and are especially challenging when the service is offered in a country with big cultural and economic differences both internal and in comparison to Norway. We base our analysis of this ethical, challenging question on Beauchamp’s and Childress’s well-established approach within biomedical ethics. We apply the four principles of respect for autonomy, beneficence, nonmaleficence and justice to shed light on the conflicts of interests in this ethical dilemma. With full awareness that there are no simple and correct solutions to dilemmas in general and on this issue, especially, our conclusion is that the interests of the involved parties, and especially those of the surrogate mothers, might be better attended to if surrogacy is allowed with extensive regulations. If this practice is made illegal, the opportunity to influence the process and secure the rights of the involved parties is lost. (shrink)

Typically the justification of criminal statutes is based on "liberty-limiting principles" -- e.g., the Harm Principle, the Offense Principle, Legal Paternalism, Legal Moralism, etc. Two philosophers of the criminal law, however -- Richard J. Arneson and Cass R. Sunstein -- take an entirely different tack. Both countenance the use of the criminal law to foreclose one's future options, seeking to preserve one's "true self" from the temptations of one's baser desires. (For reasons which become clear, I call this "community self-paternalism".) (...) In this paper, I take a careful look at "community self paternalism"; scrutiny reveals that this proposed justification of criminalization is quite different from its initial appearance. Revealing its true character dispels much of its initial appeal. I then argue for its rejection; of necessity, "community self-paternalism" treats some individuals as means merely, and not as ends in themselves. (shrink)
