Les autrices étudient le mouvement de féminisation de la profession d’avocat·e, dans la double dimension d’un important accroissement quantitatif, analogue à celui observé dans d’autres professions, notamment la magistrature, mais aussi d’un beaucoup plus lent progrès qualitatif assurant réellement l’égalité entre les femmes et les hommes et supprimant les discriminations liées au genre. Elles étudient ainsi notamment l’évolution des termes désignant les professionnel·le.s, la place des femmes dans les organisations représentant la profession et dans les structures d’exercice, mettant en évidence (...) des biais de répartition et d’importants écarts en faveur des hommes dans les responsabilités comme dans les revenus, corrélés à des différences de spécialités, tendant à écarter les femmes des plus lucratives. Considérant ces phénomènes comme reflétant la permanence de structures et de représentations sociales patriarcales, elles en montrent, dans une dernière partie, également l’effet dans la prise en (mé)compte des violences faites aux femmes dans un système pénal, qui, malgré des efforts récents, reste lui aussi héritier de schémas culturels hostiles aux femmes. We propose to develop the problems of selfness, of the tension between the other and the same, and of the singularity, by questioning the philosophies of Kant, Levinas and Stirner, and by reading them trough the theoretical eyes of Jacques Derrida. We will reflect on the irreducibility of the Levinasian other, trying to find out how, to what extent and with what difficulties, the emphasis on singularity can open a dialogical field between, on the one hand, the demand for ethical (...) transcendence required by the encounter with the other, and, on the other hand, the unconditional nature of the moral law in Kantian practical philosophy. After having underlined the limits of the latter, we will compare the non-conceptual and un-graspable character of the other with the radical Stirnerian uniqueness and his need to open the way to what escapes any logocentric chain. The relation between language, singularity and encounter will follow a resumption of Levinasian alterity under a more critical perspective. (shrink)

In order to promote better practices and communication around end-of-life decision-making, several Canadian hospitals in the province of Quebec have developed a tool called “Levels of Intervention”. No work to date has been published demonstrating improvement since these forms were implemented. The purpose of the present study was to obtain information about the use of LOI forms across Quebec hospitals and to identify gaps in practice as well as areas for improvement. A retrospective study was undertaken of 299 charts of (...) patients who had died in three Quebec hospitals with a LOI ordered. Results were analysed through a principlism ethical framework. High compliance with the level of intervention ordered at the time of death was recorded, as well as high involvement of patient and/or family, demonstrating the efficiency of LOI in promoting respect for autonomy. Other results show delays in end-of-life care discussions in the course of the hospitalization. Only a small proportion of patients who died had a palliative care consultation, which may reflect equity issues in access to care. This study highlights the importance of the LOI in Quebec and the role it is playing in respect for end-of-life preferences as well as in the involvement of patients and families in the decision-making process. Training specific to end-of-life decision-making conversations would help support the LOI form’s use, as would developing provincial or national guidelines on the use of LOI to standardize organizational policies and practice around end-of-life care. The paper aims at detecting and evaluating Deleuze’s symptomatological and minoritarian concepts at work within his transcendental theory. By using these two philosophical items, the paper refers to the Nietzschean posture Deleuze develops within the transcendental field and to the N-1 formula that accompanies his conceptual path. In this vein, the essay retakes the issue highlighted by Rametta in his essay «The Transcendental and its Metamorphoses in Modern Thinking». In particular, if Rametta insists on Deleuze’s reading of Kant as a (...) kind of deconstruction of the relationships between philosophical concepts and the primacy of Representation, but also on the freeing of multiplicities that such a deconstruction allows, the present essay proposes three minoritarian paths that Deleuze takes from the history of philosophy and lead to transcendental empiricism. The first path is focused on “experience”, the second on “forces and violence”, while the third on “events and concepts”. (shrink)

Marjolaine Deschênes | : C’est surtout de Joan C. Tronto que les ambassadrices du care se réclament en France, davantage que de Carol Gilligan. Je montre ici qu’une certaine tendance du discours français sur le care peut être diagnostiquée comme le symptôme d’une culture désenchantée, dépouillant le monde non de ses dieux, mais de ses dimensions esthétique, artistique et imaginative. Le renversement que ce discours tend à opérer, de la figure morale de l’autonomie à celle de la vulnérabilité, illustrerait (...) ce « symptôme ». C’est plus précisément l’idée du care comme « maintien du monde » chez Tronto que je critique, puisque l’auteure exclut de ces activités les domaines esthétique, artistique et intellectuel. Je discute trois auteures ayant déjà critiqué cette notion de care, qui chacune font progresser mon propos vers ce que je considère être un oubli du monde « existentiellement » habitable chez la philosophe. Enfin je contribue à combler ce qui manque dans la théorie de Tronto, soit un horizon esthétique et une réflexion sur le langage qui s’encastre dans une herméneutique du soi. Je me penche alors sur un care qui consiste à veiller sur la « fragilité du langage politique » chez Paul Ricoeur. Je conclus que s’agissant de faire du care une valeur publique à la fois féministe et soucieuse non seulement de la vie, mais aussi du monde, les activités artistiques, intellectuelles et éducationnelles sont de loin les plus efficaces, contrairement à ce que Tronto semble penser. | : In France, the ambassadresses of care ethics mainly align themselves with Joan C. Tronto’s theory—rather more than with Carol Gilligan’s. Here I want to state that a certain tendency of French discourse of “care” might be diagnosed as a symptom of a disenchanted culture, since it strips the world of its aesthetic, artistic, and imaginative dimensions. I contend that we can find the best illustration of this symptom when that discourse tends to shift from the moral figure of autonomy to the moral figure of vulnerability. More precisely, I aim to challenge Tronto’s idea of “care” as a “maintaining of the world”, since she excludes from it the areas of aesthetics, the arts, and intellectual activities. I shall discuss three authors who have already criticized Tronto’s notion of “care”. Each of them presents an opportunity for me to refine my reflection on what I consider to be Tronto’s disregard for an existentially liveable world. Finally, I help to fill in what is lacking from Tronto’s theory —that is to say, an aesthetic horizon and a real reflection on language, a reflection framed by a hermeneutics of the self. To this end, I focus on a “care” consisting in keeping watch over the “political language’s fragility” in Paul Ricoeur. I conclude by stating that if we really want to make “care” a public value, this feminist value should be concerned not only with life, but also with world. Dans Parcours de la reconnaissance, « se reconnaître dans le lignage » est conçu comme la première expérience de reconnaissance de soi paisible. Traitant de filiation, Ricoeur cite deux auteurs peu compatibles entre eux : Françoise Héritier et Pierre Legendre. Cet article élucide ce passage, montrant que ce double appel est motivé chez Ricoeur par un souci de voir l’« ordre des places » filiales rester intact. La référence à Héritier exprime un féminisme en germe chez Ricoeur, différencialiste, plaidant pour (...) un binarisme des sexes sans hiérarchie. Quant à la référence à Legendre, elle sert de propédeutique à la phénoménologie ricoeurienne du don « sans prix », mais dénote aussi l’appréhension de Ricoeur quant à certaines demandes contemporaines de reconnaissance. Dans le parcours ricoeurien de la reconnaissance-identité, où « se reconnaître dans le lignage » paraît essentiel, trouve-t-on la place pour des personnes intersexuées, transsexuelles, transgenres ou issues de familles monoparentales, homoparentales, alloparentales? En plus de répondre à cette question, j’explique pourquoi Ricoeur rejette le lacanisme de Legendre, et comment il critiquerait le structuralisme d’Héritier s’il avait pris le temps de le faire. This article indicates a reflective paradigm generally ignored in feminist research regarding the sex/gender debate, as presented in the work of Judith Butler ( Gender Trouble ). First, I address the fact that Butler’s philosophy is inscribed in the hermeneutical tradition of suspicion. Second, I put into relief the implicitly Platonic concept of mimesis , which is central to the anticipated subversion of gender, but uncriticized by Butler and others who follow her line of thought. Third, since Butler’s feminism can’t (...) ward off dualism, nor consider idem and ipse identity , I emphasize Paul Ricoeur ’s concept of triple mimesis and narrative identity, which allows us to depart from dichotomies and hierarchies. Following the path of Ricoeur and Françoise Heritier, I finally defend a feminist hermeneutical point of view, which is differentialist and universal. (shrink)

This paper builds on previous work that investigated anticancer drugs as ‘informed materials’, i.e., substances that undergo an informational enrichment that situates them in a dense relational web of qualifications and measurements generated by clinical experiments and clinical trials. The paper analyzes the recent transformation of anticancer drugs from ‘informed’ to ‘informing material’. Briefly put: in the post-genomic era, anti-cancer drugs have become instruments for the production of new biological, pathological, and therapeutic insights into the underlying etiology and evolution of (...) cancer. Genomic platforms characterize individual patients’ tumors based on their mutational landscapes. As part of this new approach, drugs targeting specific mutations transcend informational enrichment to become tools for informing their targets, while also problematizing the very notion of a ‘target’. In other words, they have become tools for the exploration of cancer pathways and mechanisms. While several studies in the philosophy and history of biomedicine have called attention to the heuristic relevance and experimental use of drugs, few have investigated concrete instances of this role of drugs in clinical research. Through his theory of the iconic difference, Boehm has emphasized the differential character of the image. This has led some researchers to relate Boehm’s approach to the thought of Jacques Derrida. Following that line of interpretation, we propose a deconstructive approach to Boehm’s theory about the iconic difference. This means, specifically, that we will bring out internal tensions in Boehm’s proposal between emphases directed towards the differential character of the image, on the one hand, and dualistic approaches, as well as (...) hierarchical distinctions that could cover up such character, on the other hand. Starting from these tensions, we attempt to radicalize the orientation towards the differential structure of the image by incorporating Derrida’s proposals, but making clear, at the same time, the challenges that this would bring to Boehm’s theory and the open questions that would arise therefrom. The paper aims to describe the stakes of a Nietzschean influence on Deleuze's reflections on the transcendental and conversely to highlight the Deleuzian operation of politicising Nietzsche by ‘minorising’ him. In order to further understand such a complex relationship of becoming between Deleuze and Nietzsche, the first objective of the paper is to focus on active and reactive forces, which seem to be the core of this very relation. Thus, the paper suggests that micropolitics has its conditions of possibility in (...) the Nietzschean corpus and, in particular, in the symptomatology of decadence, resentment and nihilism. In this sense, now the title of the paper reveals its meaning: the whole Deleuzian operation could be summarised as the passage from the criticism and questioning of an image of Nietzsche ‘forbidden to minors’, typical of the interpretations of the first half of the twentieth century, to a becoming-minor of these very same Nietzschean concepts. It is precisely through such a becoming-minor that Nietzsche's diagnosis and concepts are translated in a political and emancipatory key, in order to give power to minorities. (shrink)

Cette étude constitue la première publication complète de tous les éléments associés à l’autel des Césars au cœur de l’agora de Thasos : les vestiges architecturaux, la dédicace à Lucius César et la tête sculptée mises au jour lors de la fouille du monument. L’identification de l’édifice à un autel est désormais assurée et l’appartenance du bloc inscrit à ce dernier confirmée. La présence d’une seconde dédicace, vraisemblablement à Caius César, est rendue très probable par la structure du monument, dont (...) une restitution est proposée pour la première fois. L’association à la construction de l’autel des deux soubassements de bases qui le flanquent à l’Est est démontrée, ce qui conforte l’identification de la tête à l’un des deux princes de la jeunesse, dans lequel il faut reconnaître Caius plutôt que Lucius. Ces nouveaux éléments permettent de dater précisément le monument entre 4 et 6 apr. J.‑C. et de lui donner sa juste place dans l’histoire des relations entre Thasos et la famille impériale. (shrink)

Scholars for Syria originated at a small university in southern Indiana. This grassroots response to the turmoil in Syria bridges the gap between a seemingly distant crisis and a midwestern city in the United States. The unique pedagogical and curricular dimensions of the case study work as a helpful framing device for facilitating exploration of debates about the shape (...) of GCE, as well as providing new ways in which to imagine GCE curriculum, pedagogy, and embedding ethics into wider university initiatives. The Origin of Scientific Notions in the Circle of the Roman Accademia della Virtù around 1550. Between c. 1537 and 1555 a group of humanists, clerics, architects and philologists known as the so‐called Accademia della Virtù got together in Rome to work on a program which was formulated in a letter by the Sienese humanist Claudio Tolomei in 1542 and published in 1547. Starting out with the intention to understand the only surviving antique book on architecture and architectural theory – (...) Vitruvius’ De architectura libri decem – the program describes a series of 24 books, eleven containing the classical text and its translation with commentaries, 13 books systematically illustrating and documenting all known and available material remains from Roman antiquity. This program for a scientific classical archaeology in a modern sense was not only intended to serve the intellectual curiosity of some humanist antiquarians but to help architects and their patrons to develop a new architecture of the same high quality as the idealized Roman examples. To achieve this practical as well as theoretical goal it was obviously necessary to re‐create the antique vocabulary of architecture and its rules as well as to unify the contemporary usage of notions and norms in a canon. The first results of this project seem to be the In decem Libros M. Vitruvii Pollionis de Architectura Annotationes by Guillaume Philandrier (Rome, 1544) – up to this day a very valuable explanation of ambiguous parts in the Vitruvian text. Until the 1980s, it was believed that this book was the only outcome of the ambitious project; but then two codices of drawings after antique reliefs were identified as preparations for one of the other 23 volumes – and, because of their systematic approach, regarded as the ‘first systematic archaeological book’. Now it seems that there are some other corpora of manuscripts and drawings documenting antique artifacts that should be regarded as results of the Accademia’s work, too, showing antique buildings, inscriptions and coins. Other results of the unfinished project may be the theoretical and practical works of the two most influencial architects of the sixteenth century: Jacopo Barozzi da Vignola and Andrea Palladio. A partire dalla metà del Novecento, dopo una modernità dominata da prospettive di stampo deontologistico o utilitaristico, la filosofia pratica contemporanea ha visto il sorgere di una ripresa di interesse per un’etica “in prima persona”, in grado di offrire una prospettiva integrale sul soggetto e centrata sullo sviluppo del suo carattere e della sua personalità; in breve, si è assistito a un nuovo potente ingresso in scena dell’idea del bene, e, con essa, della virtù quale via maestra per conseguire il (...) fine adeguato della vita umana. Il volume si propone di rendere conto – anche in correlazione al ruolo delle emozioni, ma non solo – del percorso filosofico della virtù: dall’indagine delle sue fonti “classiche”, all’inizio del suo declino nella modernità, al risorgere della sua vitalità negli ultimi decenni nelle diverse aree linguistico-culturali, tenendo anche conto delle differenti discipline con cui si è interfacciata. Este trabajo es una reconstrucción hipotética de la desaparecida iglesia románica medieval de Samper de Calanda, que se basa en las fuentes documentales conservadas y en los materiales procedentes de su fábrica, reutilizados en la iglesia barroca actual. Destacan sendos dinteles de puerta insertos en las paredes norte y sur, cuyo diseño se debe al arquitecto Giacomo de Vignola, que fechamos en el siglo xvii.
