The purpose of this work is to provide a metaphysical theory of properties and scientific laws. This sentence will require some unpacking. By a ‘metaphysical’ theory here, I mean a theory of what exists in the world. In this investigation I am primarily concerned with a theory of what properties there are in the world and the role they play in scientific laws. This may be contrasted with a linguistic or epistemic project, as it is not primarily about our language, (...) ideas, or theorizing but rather about what is in the world itself. Properties are what we may pre-philosophically think of as the characteristics of an object: such as its height, weight, color, etc. Investigation may cause us to doubt whether some of these pre-philosophical properties are genuine in a metaphysical sense: whether or not the property is actually present as a feature of the world. By scientific laws, I mean the statements we make in the form of exceptionless generalities about the world within the sciences. Here I do not mean to evaluate how science comes about these generalizations, only that they do and how these generalizations may be grounded in a metaphysical theory of properties. The link between these two things: properties and scientific laws, comes about because our scientific laws prominently feature properties: velocity, temperature, charge, viscosity, etc. After a review of some of the theories currently proposed in the philosophical literature along with a treatment of some of the problems that arise out of these theories, I will propose a new theory. This theory, entitled ‘Constitutive Trope Theory’ is a form of a ‘bundle trope theory’ as it proposes that objects in the world are composed entirely out of particularized properties. However, rather than proposing a primitive relation that does the bundling, this theory will propose that, at least for the objects we are familiar with, properties arise out of relations between lower-level properties that instantiate them. For example, a mammal may exist because of the relationship between the organs that lead to its unique properties as a mammal. Those organs in turn exist because of relationships between their cells that lead to their unique properties as a particular kind of organ. And so on down the chain until we hit ‘foundational properties’: properties which are not dependent on any other properties for their existence. I will say very little about these properties as I do not believe that any such properties have currently been found and will argue that such theorizing is premature before such properties have been empirically identified. Following this account, I will consider some of the problems that must be overcome and some final considerations in favor of this theory over other competing theories of properties and scientific laws. In this little volume, Anthony Thiselton makes an impassioned appeal for closer attention to the philosophy of hermeneutics. Emilio Betti provocatively observes that hermeneutics ought to constitute an obligatory course for most degrees in the humanities. Hermeneutics, he insists, teaches patience, tolerance, respect for other views, understanding, and humility, while holding one's own views with firmness and generosity. Yet many teaching institutions do not yet recognize this. With this in mind, Thiselton first considers and responds to those who argue (...) that hermeneutics is not necessary. A distinctive position in contemporary political philosophy is occupied by those who defend the principle of public justification. This principle states that the moral or political rules that govern our common life must be in some sense justifiable to all reasonable citizens. In this article, I evaluate Gerald Gaus’s defence of this principle, which holds that it is presupposed by our moral reactive attitudes of resentment and indignation. He argues, echoing P.F. Strawson in ‘Freedom and Resentment’, that these attitudes are (...) so deep a part of us that we are unable to rationally reject them. I examine and reject this defence of the principle. Considering the nature of our commitment to the moral reactive attitudes, I argue that those attitudes need not be grounded in a commitment to public justification. The availability of alternative grounds for these attitudes shows, contra Gaus, that we can rationally reject the principle of public justification while maintaining a wholehearted commitment to the reactive attitudes. Few issues cause academics to disagree more than gender and race, especially when topics are addressed in terms of biological differences. To conduct research in these areas or comment favorably on research can subject one to scorn. When these topics are addressed, they generally take the form of philosophical debates. Anthony Walsh focuses upon such debates and supporting research. Functionalists hold that the territorial rights of states are grounded solely in their successful performance of their morally mandated functions. In this paper, I defend a distinctive functionalist view of the right of territorial jurisdiction. I develop this view over the course of considering a variety of objections to functionalism that arise from reflection on cases of non- violent and otherwise rights-respecting annexation. Functionalism’s critics argue that it is committed to counterintuitive implications in these cases, as it is unable to (...) explain why the usurper states do not gain rights over the territory they take over. Against these critics, I argue that functionalism can in fact deliver intuitively plausible verdicts regarding: (a) the territorial rights of unsuccessful states; (b) the morality of military occupation; and (c) the appropriate response to past territorial injustices. Was there a major change in Plato's views on the role and importance of law? It can be argued that he held in both 'Republic' and 'Laws' that law and administrators are essential to a state of the best kind, but legislators are not, since legislation has been done by the founders. This interpretation seems to be incompatible with passages in 'Statesman', in which the status and role of law appear to be positively downgraded. The appearance of a contradiction between (...) such passages and the insistence in 'Laws' on the importance of law is created by failure to recognize different uses of 'nomoi', as guiding rules of skill or as rules of law. What Plato says about the contrast between ideal and actual rulers commits him to the distinction, whether or not he had clearly formulated it for himself. Innovation is a key driver of care provision in assisted reproductive technologies (ART). ART providers offer a range of add‐on interventions, aiming to augment standard in vitro fertilization protocols and improve the chances of a live birth. Particularly in the context of commercial provision, an ever‐increasing array of add‐ons are marketed to ART patients, even when evidence to support them is equivocal. A defining feature of ART is hope—hope that a cycle will lead to a baby or that another test (...) or intervention will make a difference. Yet such hope also leaves ART patients vulnerable in a variety of ways. This article argues that previous attempts to safeguard ART patients have neglected how the use of add‐ons in commercial ART can exploit patients’ hopes. The standard view of classical cognitive science stated that cognition consists in the manipulation of language-like structures according to formal rules. Since cognition is ‘linguistic’ in itself, according to this view language is just a complex communication system and does not influence cognitive processes in any substantial way. This view has been criticized from several perspectives and a new framework (Embodied Cognition) has emerged that considers cognitive processes as non-symbolic and heavily dependent on the dynamical interactions between the cognitive system (...) and its environment. But notwithstanding the successes of the embodied cognitive science in explaining low-level cognitive behaviors, it is still not clear whether and how it can scale up for explaining high-level cognition. In this paper we argue that this can be done by considering the role of language as a cognitive tool: i.e. how language transforms basic cognitive functions in the high-level functions that are characteristic of human cognition. In order to do that, we review some computational models that substantiate this view with respect to categorization and memory. Since these models are based on a very rudimentary form of non-syntactic ‘language’ we argue that the use of language as a cognitive tool might have been an early discovery in hominid evolution, and might have played a substantial role in the evolution of language itself. In social and cultural theory, topology has been used to articulate changes in structures and spaces of power. In this introduction, we argue that culture itself is becoming topological. In particular, this ‘becoming topological’ can be identified in the significance of a new order of spatio-temporal continuity for forms of economic, political and cultural life today. This ordering emerges, sometimes without explicit coordination, in practices of sorting, naming, numbering, comparing, listing, and calculating. We show that the effect of these practices (...) is both to introduce new continuities into a discontinuous world by establishing equivalences or similitudes, and to make and mark discontinuities through repeated contrasts. In this multiplication of relations, topological change is established as being constant, normal and immanent, rather than being an exceptional form, which is externally produced; that is, forms of economic, political and cultural life are identified and made legible in terms of their capacities for continuous change. Outlining the contributions to this Special Issue, the introduction discusses the meaning of topological culture and provides an analytic framework through which to understand its implications. This Article analyzes the interaction between the burden of proof and evidentiary discovery rules. Both sets of rules can affect incentives for prospective injurers to invest in evidence technology. This interaction becomes acutely important in the private international law setting, where jurisdictions are split on the question whether the burden of proof should be treated as a substantive or procedural matter. When a tort occurs in Europe, but the case is litigated in American courts, treating the burden of proof as (...) a procedural matter preserves the complementarity of incentives created by the burden of proof and evidentiary rules. Structured argumentation systems, and their implementation, represent an important research subject in the area of Knowledge Representation and Reasoning. Structured argumentation advances over abstract argumentation frameworks by providing the internal construction of the arguments that are usually defined by a set of (strict and defeasible) rules. By considering the structure of arguments, it becomes possible to analyze reasons for and against a conclusion, and the warrant status of such a claim in the context of a knowledge base represents the main (...) output of a dialectical process. Computing such statuses is a costly process, and any update to the knowledge base could potentially have a huge impact if done naively. In this work, we investigate the case of updates consisting of both additions and removals of pieces of knowledge in the Defeasible Logic Programming (DeLP) framework, first analyzing the complexity of the problem and then identifying conditions under which we can avoid unnecessary computations—central to this is the development of structures (e.g. graphs) to keep track of which results can potentially be affected by a given update. We introduce a technique for the incremental computation of the warrant statuses of conclusions in DeLP knowledge bases that evolve due to the application of (sets of) updates. We present the results of a thorough experimental evaluation showing that our incremental approach yields significantly faster running times in practice, as well as overall fewer recomputations, even in the case of sets of updates performed simultaneously. This article aims at contributing to the discussion about the relationships between ICT, computer science and policy-making by focusing on agent-based social simulation. Enabled, from a technical point of view, by the developments of Distributed Artificial Intelligence in the 1990s and by the features of the object-oriented programming paradigm, agent-based social simulations are a tool for the analysis of social dynamics that can be used also to support the design and the evaluation of public policies. After a brief description of (...) social simulation paradigm and of its impact on social sciences, the paper presents a simple agent-based model devised to analyze, even if in a very abstract way, a phenomenon that can rouse the interest of legal scientists: the interplay between damaging behaviors, punishment and social mechanisms of learning and imitation. Our goal is to show how agent-based simulation can be used not only to illuminate basic mechanisms underlying social phenomena but also to reflect, in an innovative way, on how society can deal with them. The standard inferentialist approaches to modal logic tend to suffer from not being able to uniquely characterize the modal operators, require that introduction and elimination rules be interdefined, or rely on the introduction of possible-world like indexes into the object language itself. In this paper I introduce a hypersequent calculus that is flexible enough to capture many of the standard modal logics and does not suffer from the above problems. It is therefore an ideal candidate to underwrite an inferentialist theory (...) of meaning for modal operators. Here I treat specifically the modal logics K, D, T, S4, B, and S5. I show that the calculi are adequate for each set of models, and show that they meet a large set of criteria that are generally thought necessary for a calculus to underwrite a theory of meaning. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. Visual research methods like photography and digital storytelling are increasingly used in health and social sciences research as participatory approaches that benefit participants, researchers, and audiences. Visual methods involve a number of additional ethical considerations such as using identifiable content and ownership of creative outputs. As such, ethics committees should use different assessment frameworks to consider research protocols with visual methods. Here, we outline the limitations of ethics committees in assessing projects with a visual focus and highlight the sparse knowledge (...) on how researchers respond when they encounter ethical challenges in the practice of visual research. We propose a situated approach in relation to visual methodologies that encompasses a negotiated, flexible approach, given that ethical issues usually emerge in relation to the specific contexts of individual research projects. Drawing on available literature and two case studies, we identify and reflect on nuanced ethical implications in visual research, like tensions between aesthetics and research validity. The case studies highlight strategies developed in-situ to address the challenges two researchers encountered when using visual research methods, illustrating that some practice implications are not necessarily addressed using established ethical clearance procedures. A situated approach can ensure that visual research remains ethical, engaging, and rigorous. (shrink)

Human beings possess external stores in which they put all sorts of goods to use them at some later time. In this paper we investigate this typically human adaptation using agent-based simulations. We show that the use of external stores explains many aspects of human life, allowing the agents to reduce their dependence on both the environment and the current state of their body and to be more efficient in extracting the energy contained in the environment. We analyse the spatial (...) behaviour of agents with external stores located in specific positions of the environment and we find that these agents tend to develop a sedentary life. We discuss how stores can be at the origin of many human mental and social phenomena such as the acquisition of a more extended temporal perspective, specialisation in producing different types of goods, and exchange of goods.
