What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a "form" that, when applied to different legal themes, would add a "material content" to the three-dimensional theory. We can point out, as a study plan, the distinction between "three" perspectives: Those of the legal norm, of the legal order, and the legal relationship. The literature on autonomous language learning reveals both, scholars’ great enthusiasm for the revolutionary potential of learner autonomy as well as pessimism for its continual depoliticization within higher education. Similar to how ‘learner autonomy’ is still today an unfinished construct that raises considerable confusion among scholars, the critical theory of learner autonomy in the field of language learning remains largely unexplored; and thus, yet to be fully articulated. Building on the relevant literature, this article attempts to provide a coherent and (...) nuanced theoretical framework for the critical practice of learner autonomy in higher education. Results show how the field of language learning is dominated by uncritical and apolitical approaches that render learner autonomy a politically impotent practice. Critical autonomous language learning must be both critically aware—so it can raise students’ awareness of the structural and discursive constraints on their autonomy—and politically active—so it may lead to education reform and social change—, while also aiming at reaching the highest levels of institutional material support and student control possible. This essay assesses Quentin Meillassoux’s numerological approach to Mallarmé’s problematic but formally innovative poem “Un Coup de dés,” using a semiotic methodology to reveal the deficiencies of that approach from the viewpoint of literary theory. Section 1 describes my expanded version of Michael Riffaterre’s semiotic theory of the structure of modern poetry. Poems are generated by two underlying propositions, each of which governs the structure of a set of symbolic images on the textual surface. These “matricial” propositions are linked by (...) a syntagmatic relation. The primary text functions as subject-sign of the Peircean semiotic triad; its object-sign is an intertextual model. The interpretant of these two textual signs is assembled by the reader and has a sociolectic counterpart – or context – which has similar lexical content but contrasting internal structure. This contrast may produce a change in the preconceptions of the reader. Section 2 examines Meillassoux’s approach to Mallarmé’s poem, which is preoccupied with a “number” supposedly encrypted in the text. This is not convincingly related to the propositional structure of the poem. In Section 3, the text is interpreted using a semiotics-based methodology. The poem is generated by two matrices: one concerning the “Master” versus the storm, and the second concerning the power of Chance. The relation linking the matrices is clarified. This analysis is compared with that of Meillassoux throughout. Section 4 resumes the differences between Meillassoux’s concentration on the “number” and the “siren,” and my analysis which centres on the relation between the Master (symbolising traditional poets and their preferred metre) and the Constellation (symbolising the wide range of new future poetic metres and formats). Meillassoux’s approach turns out to be unconvincing. (shrink)

The study of conscious experience per se has not kept pace with the dramatic advances in PET, fMRI and other brain-scanning technologies. If anything, the standard approaches to examining the 'view from within' involve little more than cataloguing its readily accessible components. Thus the study of lived subjective experience is still at the level of Aristotelian science, leading to a widespread scepticism over the possibility of a truly scientific study of conscious experience. Drawing on a wide range of approaches -- (...) from phenomenology to meditation -- The View From Within examines the possibility of a disciplined approach to the study of subjective states. As it is well known, in the forties of the past century, Curry proved that in any logic S closed under Modus Ponens, uniform substitution of propositional variables and the Contraction Law, the naïve Comprehension axiom trivializes S in the sense that all propositions are derivable in S plus CA. Not less known is the fact that, ever since Curry published his proof, theses and rules weaker than W have been shown to cause the same effect as W causes. Among (...) these, the Contraction rule or the Modus Ponens axiom, for example, are to be noted. But, moreover, as Brady has proved, even the Generalized Modus Ponens axiom or the Generalized Contraction rule give rise to “Curry’s Paradox” under the same circumstances as W does. In some previous work by us, “weak relevant model structures” are defined on “weak relevant matrices” by generalizing Brady’s model structure MCL built upon Meyer’s Crystal matrix CL. We have proved that wr-ms only verify logics with the “depth relevance condition”. The aim of this paper is to show how to falsify gMPa and gRW in certain wr-ms. In particular, it will be shown that gMPa is falisfied in any wr-ms and gRW in any wr-ms verifying Routley and Meyer’s basic positive logic B+. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. Sobre el libro: El presente libro recoge las ponencias presentadas en la reunión anual del Seminario Spinoza que tuvo lugar en la Facultad de Filosofía de la UNED los días 13 y 14 de marzo de 2009, así como la presentación del cuadro de Espinosa pintado por Sorolla procedente de la Donación Simarro y perteneciente al fondo artístico de la Universidad Complutense, que tuvo lugar en El Escorial en el verano de 2008. Los trabajos se articulan en cuatro apartados: la (...) política, la ciencia, la proyección de Espinosa en la Ilustración y la iconografía de Espinosa, y sitúan a Espinosa en su siglo, destacando su carácter anómalo en relación con el resto de autores de su entorno. Espinosa no se adaptó a la crisis, sino que se esforzó por comprenderla sin ceder en sus ideales, lo que permitió que las ilusiones renacentistas se desarrollaran en la ilustración, superando el hiato de la crisis barroca. Œuvre de maturité de François Suarez (1548-1617), Des lois et du Dieu législateur a été publié en latin en 1612. Parmi les dix livres que comprend cet ouvrage, nous avons choisi de présenter pour la première fois les deux premiers en langue française. À partir de l'héritage retravaillé de la philosophie politique antique et médiévale, Suarez élabore une théorie originale de la loi et de la communauté en renouvelant leur rapport à l'éthique et à la jurisprudence. Dans une période marquée (...) notamment par la controverse de Valladolid (1550) et la Contre-Réforme, l'auteur redéfinit le contenu et la finalité des concepts fondamentaux de la théorie politique (l'état de nature, le droit naturel, le droit subjectif, la loi naturelle, le pacte social, la souveraineté, l'État et le droit des gens) en les articulant à une compréhension historique de l'homme conçu comme être libre, raisonnable et fini. Suarez instaure ainsi les conditions d'un basculement du théologico-politique dans la modernité dont les effets se feront sentir, entre autres, chez Grotius et l'École du droit naturel. Les conséquences de ce mouvement seront perceptibles jusqu'au XVIIIe siècle avec Wolf. Des lois et du Dieu législateur permet précisément d'apprécier à sa juste mesure la place privilégiée qu'il convient de redonner à la théorie suarézienne de la loi dans l'histoire de la pensée politique. La disidencia marrana se revela como una forma específicamente hispánica de la crítica propia de esa primera modernidad que alcanza su apoteosis con los grandes principios de la Ilustración europea.

O presente texto procura sintetizar dez grandes teses que dão conta dos múltiplos níveis da experiência sobre o corpo. A origem destas considerações é radicalmente filosófica e as suas consequências afetam tanto o âmbito geral das artes quanto o próprio estatuto da filosofia. A fenomenologia é oprincipal marco teórico de referência. As proposições apresentam‑se como um recurso prático para ampliar a reflexão sobre o pensamento e a extensão sobre o corpo vivido, a espacialidade e a espacialização. A distinção, a separação, (...) a distância, a interioridade, a exterioridade, a experiência do corpo interno e do corpo externo e os níveis de espacialidade serão algumas das questões críticas expostas. A distinção fenomenológica entre Phantasia e imaginação será a chave para pensar o desdobramento da subjetividade e do corpo depois da redução fenomenológica. Propomos, aqui, pensar o registo de um corpo intermediário ou de uma subjetividade média, que corresponde ao nível das Phantasias perceptivas, e cujos rendimentos são tanto estéticos quanto éticos, desenvolvidos pela filosofia fenomenológica. The moral enhancement of human beings is a constant theme in the history of humanity. Today, faced with the threats of a new, globalised world, concern over this matter is more pressing. For this reason, the use of biotechnology to make human beings more moral has been considered. However, this approach is dangerous and very controversial. The purpose of this article is to argue that the use of another new technology, AI, would be preferable to achieve this goal. Whilst several (...) proposals have been made on how to use AI for moral enhancement, we present an alternative that we argue to be superior to other proposals that have been developed. (shrink)

Andrea Falcon's work is guided by the exegetical ideal of recreating the mind of Aristotle and his distinctive conception of the theoretical enterprise. In this concise exploration of the significance of the celestial world for Aristotle's science of nature, Falcon investigates the source of discontinuity between celestial and sublunary natures and argues that the conviction that the natural world exhibits unity without uniformity is the ultimate reason for Aristotle's claim that the heavens are made of a special body, unique to (...) them. This book presents Aristotle as a totally engaged, systematic investigator whose ultimate concern was to integrate his distinct investigations into a coherent interpretation of the world we live in, all the while mindful of human limitations to what can be known. This article discusses some of the claims of the earlier and later versions of the Contemporary Theory of Metaphor (CTM) and addresses some of the criticism that has been leveled against it. It is argued that much of this criticism arises from common misconceptions as to the real claims made by the theory. However, CTM is still in need of further exploration and empirical support. In this connection, we identify some areas where research is still needed and supply our own (...) developments. We argue for a more complex classification of metaphor types, which takes into account various complementary taxonomic perspectives, including the nature of source and target and the genericity and complexity of the metaphoric operation. We also explore metaphor in relation to cognitive prominence and conceptual interaction issues. Finally, we deal with the problem of constraints on metaphor and make a proposal for three complementary kinds of constraint. (shrink)
