There is increasing interest in determining what impact having women in management positions may have on corporate social responsibility initiatives. Various authors suggest that gender equality practices should be factored into the broader framework of CSR. This paper examines how the presence of women on corporate boards, in top and middle management and as heads of CSR departments, influences gender equality practices in the field of CSR. Using information collected from companies that have signed up to Women's Empowerment Principles in (...) Spain, we show that the presence of women in the aforesaid posts has a positive impact on CSR activities with gender equality objectives. We thus supplement the justice, business and moral arguments with further arguments in support of the incorporation of women into not only corporate boards but all management positions. Finally, we provide a view of how gender equality can be included in the broader framework of CSR. (shrink)

Thanks to his unsurpassed eye and his fearless willingness to take a stand, Clement Greenberg (1909 1994) became one of the giants of 20th century art criticism a writer who set the terms of critical discourse from the moment he burst onto the scene with his seminal essays Avant Garde and Kitsch (1939) and Towards a Newer Laocoon (1940). In this work, which gathers previously uncollected essays and a series of seminars delivered at Bennington in 1971, Greenberg provides his most (...) expansive statement of his views on taste and quality in art, arguing for an esthetic that flies in the face of current art world fashions. Greenberg insists despite the attempts from Marcel Duchamp onwards to escape the jurisdiction of taste by producing an art so disjunctive that it cannot be judged that taste is inexorable. He argues that standards of quality in art, the artist's responsibility to seek out the hardest demands of a medium, and the critic's responsibility to discriminate, are essential conditions for great art. The obsession with innovation the epidemic of newness leads, in Greenbergs view, to the boringness of so much avant garde art. He discusses the interplay of expectation and surprise in aesthetic experience, and the exalted consciousness produced by great art. Homemade Esthetics allows us particularly in the transcribed seminar sessions, never before published to watch the critics mind at work, defending (and at times reconsidering) his theories. The first part of this paper proposes a precise definition of what a worldview is, and why there is a necessity to have one. The second part suggests how to construct integrated scientific worldviews. For this attempt, three general scientific approaches are proposed: the general systems theory as the endeavor for a universal language for science, a general problem-solving approach and the idea of evolution, broadly construed. We close with some remarks about limitations of scientific worldviews.

El vigente proceso de globalización está provocando importantísimas consecuencias en estructuras, instituciones y conceptos clásicos de la política, el estado y el derecho. En el presente trabajo se pretende discutir algunas de esas consecuencias. En tal sentido y tras analizar los aspectos fundamentales que definen al actual proceso de globalización, se cuestiona el papel y el lugar de los estados en el nuevo orden mundial. In this paper, we point out that explainability is useful but not sufficient to ensure the legitimacy of algorithmic decision systems. We argue that the key requirements for high-stakes decision systems should be justifiability and contestability. We highlight the conceptual differences between explanations and justifications, provide dual definitions of justifications and contestations, and suggest different ways to operationalize justifiability and contestability.

Philosophy lacks criteria to evaluate its philosophical theories. To fill this gap, this essay introduces nine criteria to compare worldviews, classified in three broad categories: objective criteria (objective consistency, scientificity, scope), subjective criteria (subjective consistency, personal utility, emotionality), and intersubjective criteria (intersubjective consistency, collective utility, narrativity). The essay first defines what a worldview is and exposes the heuristic used in the quest for criteria. After describing each criterion individually, it shows what happens when each of them is violated. From the (...) criteria, it derives assessment tests to compare and improve different worldviews. These include the is-ought, ought-act, and is-act first-order tests; the critical and dialectical second-order tests; the mixed-questions and first-second-order third-order tests; and the we-I, we-it, and it-I tests. The essay then applies these criteria and tests to a concrete example, comparing the Flying Spaghetti Monster deity with Intelligent Design. Psychologists have emphasized children's acquisition of information through firsthand observation. However, many beliefs are acquired from others' testimony. In two experiments, most 4yearolds displayed sceptical trust in testimony. Having heard informants' accurate or inaccurate testimony, they anticipated that informants would continue to display such differential accuracy and they trusted the hitherto reliable informant. Yet they ignored the testimony of the reliable informant if it conflicted with what they themselves had seen. By contrast, threeyearolds were less selective in trusting a reliable (...) informant. Thus, young children check testimony against their own experience and increasingly recognise that some informants are more trustworthy than others. (shrink)

An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

In this philosophical paper, we explore computational and biological analogies to address the fine-tuning problem in cosmology. We first clarify what it means for physical constants or initial conditions to be fine-tuned. We review important distinctions such as the dimensionless and dimensional physical constants, and the classification of constants proposed by Lévy-Leblond. Then we explore how two great analogies, computational and biological, can give new insights into our problem. This paper includes a preliminary study to examine the two analogies. Importantly, (...) analogies are both useful and fundamental cognitive tools, but can also be misused or misinterpreted. The idea that our universe might be modelled as a computational entity is analysed, and we discuss the distinction between physical laws and initial conditions using algorithmic information theory. The field of computational law has increasingly moved into the focus of the scientific community, with recent research analysing its issues and risks. In this article, we seek to draw a structured and comprehensive list of societal issues that the deployment of automatically processable regulation could entail. We do this by systematically exploring attributes of the law that are being challenged through its encoding and by taking stock of what issues current projects in this field raise. This article adds to (...) the current literature not only by providing a needed framework to structure arising issues of computational law but also by bridging the gap between theoretical literature and practical implementation. Key findings of this article are: (1) The primary benefit (efficiency vs. accessibility) sought after when encoding law matters with respect to the issues such an endeavor triggers; (2) Specific characteristics of a project—project type, degree of mediation by computers, and potential for divergence of interests—each impact the overall number of societal issues arising from the implementation of automatically processable regulation. I discuss some of the speculations proposed by Stewart ( 2010a ). These include the following propositions: the cooperation at larger and larger scales, the existence of larger scale processes, the enhancement of the tuning as the universe cycle repeats, the transmission between universes and the motivations to produce a new universe.

Jan Greben criticized fine-tuning by taking seriously the idea that “nature is quantum mechanical”. I argue that this quantum view is limited, and that fine-tuning is real, in the sense that our current physical models require fine-tuning. Second, I examine and clarify many difficult and fundamental issues raised by Rüdiger Vaas’ comments on Cosmological Artificial Selection.

Accordingly, the essay argues that the method and canons of Conversational Philosophy are very significant to the progressive development of African philosophy. This is because they are fundamentally articulated to promote the constructive criticism, creative emendation, and articulate reconstruction of established positions or received opinions in African (...) philosophy. It buttresses this point using Mesembe Edet’s conversation with Innocent Onyewuenyi on the question of the African belief on reincarnation. This choice stems from the explicit admittance of Edet that his conversation with Onyewuenyi adopts the method of conversationalism and the method of conversationalism is undergirded by the canons of CP. Specifically, this essay explicates how the conscious adoption of conversationalism and adherence to the canons of CP enabled Edet to engage Onyewuenyi in a very critical and creative conversation on the African belief in reincarnation which eventually led to a novel reconceptualization of reincarnation in African philosophy. It unveils the significance of conversationalism and the canons of CP in practice. It is therefore a conversational, expository and argumentative essay. We are caught in an inescapable network of mutuality, tied in a single garment of destiny.” Until this undeniable fact is understood and emphasized our contemporary society is heading towards a state of an uncontrollable wildfire of anarchy. It (...) is obvious that all fingers are not equal but that does not negate the fact that all men irrespective of colour or race are created equal—configured with brain, flesh, water, and blood. Racial discrimination is a moral and systemic sin that must be confronted and vehemently condemned. The main thrust of this paper is to expose various forms of racial discrimination ravaging the contemporary society with a view to postulating ideas geared towards its prevention and possible elimination. Relying on observational and historical methods, relevant data required will be elicited. The paper identified among other things that racism is resurging in the 21st century to a threatening dimension that if a coordinated action is not urgently taken, it will result into an uncontrollable wildfire of anarchy. Humans massively depend on communication with others, but this leaves them open to the risk of being accidentally or intentionally misinformed. To ensure that, despite this risk, communication remains advantageous, humans have, we claim, a suite of cognitive mechanisms for epistemic vigilance. Here we outline this claim and consider some of the ways in which epistemic vigilance works in mental and social life by surveying issues, research and theories in different domains of philosophy, linguistics, cognitive psychology and the social sciences.

Daniel C. Dennett is a brilliant polemicist, famous for challenging unexamined orthodoxies. Over the last thirty years, he has played a major role in expanding our understanding of consciousness, developmental psychology, and evolutionary theory. And with such groundbreaking, critically acclaimed books as Consciousness Explained and Darwin's Dangerous Idea (a National Book Award and Pulitzer Prize finalist), he has reached a huge general and professional audience. In this new book, Dennett shows that evolution is the key to resolving the ancient problems (...) of moral and political freedom. Like the planet's atmosphere on which life depends, the conditions on which our freedom depends had to evolve, and like the atmosphere, they continue to evolve-and could be extinguished. This paper argues that the definition of food justice must be defined in more participatory terms. Current accounts of food justice tend to emphasize distributional inequalities. However, there is broad recognition that these distributional inequalities are the result of participative inequalities and that the participation of marginalized groups in advocacy plays an important role in creating just food systems. In addition, thinking of food justice in more participative terms also suggests a more well-rounded and comprehensive approach to dealing with inequalities (...) within the food system. One manner in which the concept of food justice can be redefined to better capture the importance of participative justice is by considering what is required for informed consent. (shrink)

Driven by the increasing availability and deployment of ubiquitous computing technologies across our private and professional lives, implementations of automatically processable regulation (APR) have evolved over the past decade from academic projects to real-world implementations by states and companies. There are now pressing issues that such encoded regulation brings about for citizens and society, and strategies to mitigate these issues are required. However, _comprehensive yet practically operationalizable_ frameworks to navigate the complex interactions and evaluate the risks of projects that implement (...) APR are not available today. In this paper, and based on related work as well as our own experiences, we propose a framework to support the conceptualization, implementation, and application of _responsible_ APR. Our contribution is twofold: we provide a holistic characterization of what responsible APR means; and we provide support to operationalize this in concrete projects, in the form of leading questions, examples, and mitigation strategies. We thereby provide a scientifically backed yet practically applicable way to guide researchers, sponsors, implementers, and regulators toward better outcomes of APR for users and society. (shrink)

This paper aims at bridging a gap between the history of American animal behavior studies and the history of sociobiology. In the post-war period, ecology, comparative psychology and ethology were all investigating animal societies, using different approaches ranging from fieldwork to laboratory studies. We argue that this disunity in “practices of place” explains the attempts of dialogue between those three fields and early calls for unity through “sociobiology” by J. Paul Scott. In turn, tensions between the naturalist tradition and the (...) rising reductionist approach in biology provide an original background for a history of Edward Wilson’s own version of sociobiology, much beyond the William Hamilton’s papers usually considered as its key antecedent. Naturalists were in a defensive position in the geography of the fields studying animal behavior, and in reaction were a driving force behind the various projects of synthesis called “sociobiology”. Pétrie d’injonctions à s’approprier le temps selon ses propres canons, la prévention semble ne prêter que peu d’attention à la pluralité des temps sociaux, ainsi qu’à leurs contextes de production et d’énonciation. Dans la mesure où les inégalités sociales de santé résident en partie dans la capacité de l’individu à mettre en pratique les normes préventives, et donc à agir aujourd’hui pour sa santé de demain, et où la pauvreté contribue à entraver la projection dans un à venir, nous avons (...) souhaité analyser les positionnements de personnes se trouvant dans différentes situations de précarité face aux discours préventifs et à l’entreprise de leurs propres projets de santé, tout en plaçant la « question » des rapports au temps au cœur de nos travaux. Aussi, selon les contextes socio-économiques, les ressources mobilisables, les perspectives d’ascension ou de déclassement social, les normes préventives ne sont pas appropriées et restituées de la même façon. Il ressort de cet article que sous des revendications apparemment communes, impulsées par le désir d’adhérer à la norme, s’inscrivent en réalité des motivations et des pratiques diverses, largement influencées par des régimes de temporalités socialement différenciés. The authors of the first constitutions of the Spanish-American world, in New Granada, were also scientists who published articles on geography, natural history, political economy, population or medicine. From this observation, the article seeks to show how these scholars understood how to apply the new naturalistic knowledge to the regeneration of society in their constitutional work. This ambition entailed the need to destroy the supposedly artificial and despotic hierarchies of the Ancien Régime, based on the genealogical transmission of dignities and (...) infamy, in order to replace them with others that were "natural". This device did not mean the constitutional triumph of equality, since, to take up a formula of Madame de Staël, equality before the law would mean nothing other than the reestablishment of natural inequalities. The article firstly deals with the works of the Enlightenment of New Granada and of Baron Humboldt to understand the assumptions of their naturalistic anthropology on the "American man", which later served to think, in revolutionary times, about certain political topics such as federalism, the rights of man and the limits of citizenship. It ends with a re-reading of the Discurso de Angostura by showing how this naturalistic knowledge, influenced Bolívar's constitutionalist thought. (shrink)

: Standard ethical frameworks struggle to deal with transhumanism, ecological issues and the rising technodiversity because they are focused on guiding and evaluating human behavior. Ethics needs its Copernican revolution to be able to deal with all moral agents, including not only humans, but also artificial intelligent agents, robots or organizations of all sizes. We argue that embracing the complexity worldview is the first step towards this revolution, and that standard ethical frameworks are still entrenched in the Newtonian worldview. We (...) first spell out the foundational assumptions of the Newtonian worldview, where all change is reduced to material particles following predetermined trajectories governed by the laws of nature. However, modern physical theories such as relativity, quantum mechanics, chaos theory and thermodynamics have drawn a much more confusing and uncertain picture, and inspired indecisive, subjectivist, relativist, nihilist or postmodern worldviews. Based on cybernetics, systems theory and the new sciences of complexity, we introduce the complexity worldview that sees the world as interactions and their emergent organizations. We use this complexity worldview to show the limitations of standard ethical frameworks such as deontology, theology, consequentialism, virtue ethics, evolutionary ethics and pragmatism. Despite the fact that informal labour is a widespread phenomenon, the business ethics literature tends to describe it as a problem that needs to be overcome, rather than contemplating its merits. Informal labour is linked to poor working conditions, low-income and insufficient protection. However, it is also a survival strategy and upholds essential services, such as waste collection and recycling. Through the lens of postmodern ethics, we analyse 45 interviews with formal and informal waste management workers in Kinshasa. The study (...) explores the functioning and limits of recycling services in a metropolis, focusing on the experience of African workers and entrepreneurs. A complex picture of ethical challenges and individual business and survival strategies emerges from the analysis. Our findings demonstrate that labour decisions of voiceless people cannot be reduced to being rational or desperate choices, but that they reflect a careful elaboration of currently available options and strategies for the future. The study contributes to our understanding of entrepreneurship in a post-conflict context, the role of informal labour in the functioning of formal businesses in Africa and the contribution of postmodern theory to the study of businesses in non-Western societies. Crane envisions the speculative conjecture that intelligent civilizations might want and be able to produce black holes in the very far future. He implicitly suggests two main purposes of this enterprise: (i) energy production and (ii) universe production. We discuss those two options. The commentary is obviously highly speculative and should be read accordingly.

This essay proposes ways to extend the concept of _planetary health_, in the framework of major evolutionary transition applied to the planet as a whole. I argue that planetary health can be naturally extended to a fully planetary scale, including issues related to geo- bio- techno- and noo- spheres. I show the need and importance for ethics and governance to become global and I give some examples of physiological and psychological health issues from a planetary perspective.

Teilhard de Chardin developed an evolutionary vision of our planetary future, currently developing from a sphere of life, or biosphere towards a sphere of mind, or noosphere. As a visionary, Teilhard was not only on the brink of formulating the internet, but he also anticipated current academic efforts to understand globalization, as well as human, cultural and technological evolution. However, his ideas are sources of enduring controversies in both scientific and theological circles. Here I uncover some of the core reasons (...) why his ways of thinking and writing are often problematic, and propose a way forward. This note aims to introduce Teilhard’s central article about the noosphere, but can also be read as an independent introduction to Teilhard’s system of thought. Kirby and Paris have exhibited combinatorial algorithms whose computations always terminate, but for which termination is not provable in elementary arithmetic. However, termination of these computations can be proved by adding an axiom first introduced by Goodstein in 1944. Our purpose is to investigate this axiom of Goodstein, and some of its variants, and to show that these are potentially adequate to prove termination of computations of a wide class of algorithms. We prove that many variations of Goodstein's axiom are (...) equivalent, over elementary arithmetic, and contrast these results with those recently obtained for Kruskal's theorem. (shrink)
