In Death and Nonexistence, Palle Yourgrau defends what he calls the principle of Prior Possibility: nothing comes to exist unless it was previously possible that it exists. While this seems like a plausible principle, it’s not strong enough; it allows the impossible to come to exist. I argue for a stronger principle: nothing exists unless its existence has always been possible. Further, I argue that we then have reason to accept a surprising result: nothing exists unless its existence is always (...) possible. BackgroundWhile ethicists have for many years called for human subject trial participants and, in some cases, local community members to benefit from participation in pharmaceutical and other intervention-based therapies, little is known about how these discussions are impacting the practice of research ethics boards that grant ethical approval to many of these studies.MethodsTelephone interviews were conducted with 23 REB members from across Canada, a major funder country for human subject research internationally. All interviews were digitally recorded and transcribed verbatim. After (...) coding, the data was analyzed to identify central themes and topics. Themes were identified, application of the themes was confirmed, and these themes were then used to populate the findings of this manuscript.ResultsOur analysis of the interviews identified two primary themes when considering what benefits are owed to research participants and their communities. 1) Most study participants felt that given that these studies are led by persons in the role of researcher rather than health care provider, they had a limited obligation to provide benefits to study participants. 2) These REB members were all working in Canada, a high income country where most residents enjoy high levels of access to health care. As a result of this context, the study participants tended to focus on ethical concerns including obtaining informed consent and avoiding undue inducement to participate in research rather than ensuring that study participants directly benefit from successful trials.ConclusionsResearch on REB members’ attitudes toward what benefits are owed to study participants and community members is needed in other countries in order to determine how context affects these attitudes. Income inequality in democratic societies with market economies is sizable and growing. One reason for this growth can be traced to unequal forms of compensation that employers pay workers. Democratic societies have tackled this problem by enforcing a wage standard that all workers are paid regardless of education, skills, or contribution. This raises a novel question: Should there be equal pay for all workers? To answer it, we need to investigate some factors that are relevant to the unequal conditions of (...) power and authority in which wage offers are made. By clarifying these, we can determine whether wage inequality is morally permissible. If not, then a case might be made to pay all workers the same regardless of education, skills, or contribution. Even if it is permissible, another question worth considering is whether there are limits to how much inequality is acceptable. The argument here proceeds along the following lines. First, I summarize the economic and non-economic factors that determine the value of wages in labor markets. Second, I examine a particular problem that concerns whether the conditions of wage labor are coercive because they restrict alternatives or otherwise include threats to the welfare of workers. If there is coercion, we have good reasons to establish a standard that improve these conditions. Finally, I claim that establishing this standard requires increasing the value of low-wage work. Doing so will not only expand alternatives that are available to these workers, it will also diminish the potential threat to their welfare. (shrink)

There is currently no international consensus around post-trial obligations toward research participants, community members, and host countries. This literature review investigates arguments and attitudes toward post-trial access. The literature review found that academic discussions focused on the rights of research participants, but offered few practical recommendations for addressing or improving current practices. Similarly, there are few regulations or legislation pertaining to post-trial access. If regulatory changes are necessary, we need to understand the current arguments, legislation, and attitudes towards post-trial access (...) and participants and community members. Given that clinical trials conducted in low-income countries will likely continue, there is an urgent need for consideration of post-trial benefits for participants, communities, and citizens of host countries. While this issue may not be as pressing in countries where participants have access to healthcare and medicines through public schemes, it is particularly important in regions where this may not be available. John Dewey developed a pragmatic theory of inquiry to provide intelligent methods for social progress. He believed that the logic and attitude of successful scientific inquiries, properly conceived, could be fruitfully applied to morals and politics. Unfortunately, his project has been poorly understood and his logic of inquiry neglected as a resource. Contemporary pragmatists, like Richard Rorty, for example, dismiss his emphasis on method and avoid judgments of moral progress that are in any way independent of the biases of particular (...) cultures. In this article, I argue that Dewey’s theory of inquiry indeed provides intelligent methods and intellectual criteria for engaging moral and political matters. Inquiry, as Dewey conceives it, issues in judgments that are increasingly objective, reliable and refined in application. These judgments are rooted in particular times and places, in actual ‘situations’, but are not entirely hostage to specific cultures. I then apply Dewey’s theory to two standard moral problems to demonstrate how it works. The conclusion is that Dewey’s theory of inquiry gets it just right: it provides solid ground for criticism and moral progress while remaining acutely sensitive to cultural differences and changing circumstances. Although widely recognized as founder and key figure in the current re-emergence of pragmatism, Charles Peirce is rarely brought into contemporary dialogue. In this book, Kory Sorrell shows that Peirce has much to offer contemporary debate and deepens the value of Peirce’s view of representation in light of feminist epistemology, philosophy of science, and cultural anthropology. Drawing also on William James and John Dewey, Sorrell identifies ways in which bias, authority, and purpose are ineluctable constituents of shared representation. He nevertheless (...) defends Peirce’s realistic account of representation, showing how the independently real world both constrains social representation and informs its content. Abstract In this paper, I pursue the question whether extending democratic rights to work is good in the broadest possible sense of that term: good for workers, firms, market economies, and democratic states. The argument makes two assumptions in a broadly consequentialist framework. First, the configuration of any relationship among persons in which there is less rather than more coercion makes individuals better off. Second, extending democratic rights to work will entail costs and benefits to both the power and authority (...) of employers and meaningful work for employees. These costs and benefits cannot be determined in advance because they are largely empirical, but there are still good reasons for expanding worker participation all-things-considered. First, I examine the parallel case for extending democratic rights to the workplace based on several similarities between politics and work organization. In addition, I consider the objections from voluntariness and efficiency. Although both objections raise interesting problems I believe that a properly formulated conception of democratic workplaces can answer them. In the final section, I sketch a minimal conception of these rights at the level of the firm that does not require a large-scale transformation of the market economy. (shrink)

The main response to the multiple crises besetting Western societis in the past decades has been the attempt of the academic and scientific as well as political circles to gain a sense of orientation—and of social cohesion—by two main modes of thinking: identity politics and evidence-based knowlegde. Regarding the latter, I argue that if scientific knowledge is reduced to facts, data and numbers, as the basis for political decisions without any alternatives, it would become a dogma propagating the truth—that is, (...) a new religion. Politicians will no longer have to struggle with other perspectives, once there is a consensus about following the line that “the numbers or the facts speak for themselves.” While many people would perhaps find in this new religion a guarantee of security in an insecure world, this sense would be illusionary. I argue that the role intellectuals should play in a spiritual crisis of this kind is paradoxically to cultivate a sense of more security by strengthening a culture of “insecureness” or docta ignorantia against the dogmas within science and religion. To create and encourage a new art of questioning and listening, and of learning to appreciate non-knowledge as the basis of coming together. This notion is found in the Greek and Christian as well as the Jewish tradition of European thought, and it continues in the works of modern thinkers such as Paul Ricoeur, Hermann Cohen, Martin Buber, Hartmut Rosa, and of philosophers who focus on the question of the ineffable. My aim is to present this quality of certainty within uncertainty by examples from different fields, including philosophy, art and psychotherapy, and to elaborate on the paradoxical question: does a troubled Geist need more trouble in order to help us find a sense of orientation through disorientation? Empathy is the ability to infer and share the feelings, intentions, and goals of other persons.1 It provides the basis for our extraordinary capacity to help others, including strangers we may never meet, without interest in personal benefit. Its extent has been controversial, but recent studies in neuroscience, empirical psychology, and primatology support a highly empathic understanding of human nature. Conditionals pervade every aspect of our thinking, from the mundane and everyday such as ‘if you eat too much cheese, you will have nightmares’ to the most fundamental concerns as in ‘if global warming isn’t halted, sea levels will rise dramatically’. Many decades of research have focussed on the semantics of conditionals and how people reason from conditionals in everyday life. Here it has been rather overlooked how we come to such conditionals in the first place. In many cases, they (...) are learned through testimony: someone warns us about the ill-effects of cheese. Any full account of the conditional must consequently incorporate such learning. Here, we provide a new formal account of belief change in response to a testimonial conditional. (shrink)

The present paper argues that a right to work, defined as social and legal guarantees to fair conditions of employment, should be an essential part of a democratic state with market arrangements. This argument proceeds along the following lines. First, I reconstruct an account of rights that defends the “correlativity” thesis of rights and duties. The basic idea is that a social member’s legitimate demand to something of value, such as gainful employment, implies duties on the part of others to (...) respect and fulfill it. These duties include the following with regard to that demand: avoiding actions that cause the harm, protecting it against standard threats, and otherwise providing aid in case it is deprived. Second, I sketch an outline of what a right to work will entail in terms of the correlative duties just described. This means that respect and fulfillment of the demand will require both social members and the democratic state alike to guarantee fair conditions of employment: first, by forbearing from actions that deprive members of access to work; and second, by protecting members against threats of deprivation and aiding them when they are so deprived. Third, I answer some ethical and empirical objections to the idea of a right to work: that it violates the legal rights of owners and employers, fails to impart self-respect, lacks economic efficiency, and erodes human capital by undermining competitive incentives. Finally, I make some concluding observations that a democratic right to work so conceived is ethically and economically superior to alternative arrangements that neither respect nor fulfill these correlative duties to avoid harm, protect against threats, and provide aid in cases of deprivation. There is a prima facie conflict between the semantical theory of direct reference and an intuitively plausible view often called 'individualism'. Direct reference theory is the view that certain expressions pick out their referent directly, without any intervening semantical mechanism. In order to describe the meaning of a sentence which contain such an expression, we have to mention the referent itself. Individualism is a view that mental states are individuated without reference to the subject's environment, either social or physical, and (...) therefore without mentioning an external object of reference. ;I argue that there is no conflict because it is a mistake to carry over the results of a semantical theory into a theory of mental content. My argument ultimately relies on a certain understanding of the difficult notions of mental content and linguistic meaning, gained in part by a close analysis of the historical context in which the theory of reference emerged out of the parallel work in the theory of intentionality. Fundamentally, the elucidation of these concepts is the principal aim of the dissertation, rather than the dismantling of an apparent conflict between two currently accepted views. ;There are two ways in which the conflict may be thought to arise. One argument relies on the identification of linguistic meaning with mental content. Against this I argue that we cannot hold both direct reference and the thesis, crucial to the argument, that linguistic meaning is identical to the thought-content of a competent. The short argument for conflict, therefore, fails. ;The second argument for the conflict is less direct. There are some thoughts, called De Re, which are said to constitute a direct connection between thinker and object. It is often thought that such thoughts are the ones attributed correctly using directly referential expressions. But what we attribute in such cases are just mental states whose attribution essentially involves the extra-mental objects of thought themselves, pace individualism. I argue that this argument depends on a conception of De Re, inherited from W. V. O. Quine, which mistakenly collapses issues of mental content with those of thought-attribution. (shrink)

This essay focuses on the role relationships of authority play in the communal production of knowledge. The author draws on recent developments in feminist epistemology and the pragmatism of John Dewey to show that not only is authority representation ineluctable, but is desirable if held properly accountable.

ABSTRACT This article defends Charles Peirce's “doctrine of immediate perception.” This realistic view holds that conscious agents, due to the work of unconscious mind, directly perceive the world and often know objects, events, and persons as they truly are, independently of how we might prefer to think of them. The doctrine provides a promising alternative to more recent views insisting that all experience of the world and other persons is ineluctably mediated by language, along with the categories and biases language (...) inevitably imposes. Peirce's view is further explicated in terms of what neuroscientists now call the “new” unconscious and supported by recent work in both neuroscience and empirical psychology, especially experiments involving infants. The article supports the conclusion that, while much experience is mediated by language, direct access to a world that informs and often surprises us persists throughout conscious experience. I argue that there is nothing in Kant’s moral theory that legitimates condemnation of same-sex relations and that the arguments from natural ends Kant relies on in doing so are unjustified by the constraints placed upon morality to avoid the empirical determination of judgments. In order to make clear why same-sex activity does not contradict the requirements of the moral law, we need to understand Kant’s account of legitimate sexual activity. I provide this reconstruction in the first section, drawing upon (...) the Lectures on Ethics and Metaphysics of Morals. In the second section, I critique the first kind of argument that grounds Kant’s assessment, that from natural ends. I show how it is based upon underlying teleological premises and raise doubts concerning Kant’s reliance on “regulative ideas” in making a consistent ethical theory. In the third section, I argue that same-sex activity that conforms to the conditions of the moral law, especially given the concepts of consent and reciprocity, are in conformity with Kant’s formal requirement of the law of pure practical reason, and therefore cannot justifiably be condemned on those grounds. Finally, I conclude with some discussion about Rawls and political liberalism. I hope to show how the present Kantian revival in ethical theory can place itself in opposition to the conservative and homophobic hysteria surrounding debates on political and legal issues such as same-sex “marriage.”. A common view in both philosophy and the vision sciences is that, in human vision, wavelength information is primarily ‘for’ colouring: for seeing surfaces and various media as having colours. In this article we examine this assumption of ‘colour-for-colouring’. To motivate the need for an alternative theory, we begin with three major puzzles from neurophysiology, puzzles that are not explained by the standard theory. We then ask about the role of wavelength information in vision writ large. How might wavelength information (...) be used by any monochromat or dichromat and, finally, by a trichromatic primate with object vision? We suggest that there is no single ‘advantage’ to trichromaticity but a multiplicity, only one of which is the ability to see surfaces and so on as having categorical colours. Instead, the human trichromatic retina exemplifies a scheme for a general encoding of wavelength information given the constraints imposed by high spatial resolution object vision. Chromatic vision, like its partner, luminance vision, is primarily for seeing. Shape and locomotion of tissue cells depend on the interaction of elements of the cytoskeleton, adhesion to the substrate and an intracellular hydrostatic pressure. The existence of this pressure becomes obvious from increase in cell volume on cessation of contractile forces and from observations with ultrasound acoustic microscopy. Wherever such an internal pressure is established, it is involved in generation of shape and driving force of cell locomotion. Therefore each hypothesis on cell shape and locomotion must consider this property of (...) a living cell. So impassioned is the debate on occasion, and so high the feelings, that even the tools of regulatory analysis have become part of the combat.To some, the term cost-benefit analysis, for example, is virtually a swearword, a nefarious tool used by big business to undermine regulations aimed at benefiting the people at large. To others, it is the mechanism for achieving more effective regulation (...) at less cost.This new book on the subject of reforming regulation is aimed at increasing the light and turning down the heat. It consists of an introduction and nine chapters written by scientists, public policy analysts, and economists on various aspects of regulation and regulatory analysis.The book advances the latest knowledge and evidence on risk analysis, cost-benefit analysis, and related techniques for improving regulation--all based on experience and data accumulated over the quarter century since regulation in the areas of environment, health, and safety became a major player on the governmental stage. The strengths and limitations of those analytical tools are an important part of the portrait that is painted, but a common thesis is that, properly used, the tools can be helpful in getting better regulatory results.
