Objectives: Efficient procedures for obtaining informed (proxy) consent may contribute to high influenza vaccination rates in nursing homes. Yet are such procedures justified? This study’s objective was to gain insight in informed consent policies in Dutch nursing homes; to assess how these may affect influenza vaccination rates and to answer the question whether deviating from standard informed consent procedures could be morally justified. Design: A survey among nursing home physicians. Setting & Participants: We sent a questionnaire to all (356) nursing (...) homes in the Netherlands, to be completed by one of the physicians. Results: We received 245 completed questionnaires. As 21 institutions appeared to be closed or merged into other institutions, the response was 73.1% (245/335). Of all respondents 81.9% reported a vaccination rate above 80%. Almost 50% reported a vaccination rate above 90%. Most respondents considered herd immunity to be an important consideration for institutional policy. Freedom of choice for residents was considered important by almost all. Nevertheless, 106 out of 245 respondents follow a tacit consent procedure, according to which vaccination will be administered unless the resident or her proxy refuses. These institutions show significantly higher vaccination rates (p < 0.03). Conclusions: In our discussion we focus on the question whether tacit consent procedures can be morally justifiable. Such procedures assume that vaccination is good for residents either as individuals or as a group. Even though this assumption may be true for most residents, there are good reasons for preferring express consent procedures. (shrink)

In this paper we present an executable approach to model interactions between agents that involve sensitive, privacy-related information. The approach is formal and based on deontic, epistemic and action logic. It is conceptually related to the Belief-Desire-Intention model of Bratman. Our approach uses the concept of sphere as developed by Waltzer to capture the notion that information is provided mostly with restrictions regarding its application. We use software agent technology to create an executable approach. Our agents hold beliefs about the (...) world, have goals and commitment to the goals. They have the capacity to reason about different courses of action, and communicate with one another. The main new ingredient of our approach is the idea to model information itself as an intentional agent whose main goal it is to preserve the integrity of the information and regulate its dissemination. We demonstrate our approach by applying it to an important process in the insurance industry: applying for a life insurance. In this paper we will: (1) describe the challenge organizational complexity poses in moral reasoning about informational relationships; (2) propose an executable approach, using software agents with reasoning capacities grounded in modal logic, in which moral constraints on informational relatio nships can be modeled and investigated; (3) describe the details of our approach, in which information itself is modeled as an intentional agent in its own right; (4) test and validate it by applying it to a concrete ‘hard case’ from the insurance industry; and (5) conclude that our approach upholds and offers potential for both research and practical application. Vaccination programmes against infectious diseases aim to protect individuals from serious illness but also offer collective protection once a sufficient number of people have been immunized. This so-called ‘herd immunity’ is important for individuals who, for health reasons, cannot be immunized or who respond less well to vaccines. For these individuals, it is pivotal that others establish group protection. However, herd immunity can be compromised when people deliberately decide not to be immunized and benefit from the herd’s protection. These agents (...) are often referred to as free riders: their omissions are deemed to be unfair to those who do contribute to the collective’s health. This article addresses the unfairness of such ‘free riding’. An argument by Garett Cullity is examined, which asserts that the unfairness of moral free riding lies neither in one’s intentions, nor in one’s reluctance to embrace a public good. This argument offers a strong basis for justifiably arguing that free riding is unfair. However, it is then argued that other considerations also need to be taken into account before simply holding free riding against non-compliers. (shrink)

It has been argued that the Internet and social media increase the number of available viewpoints, perspectives, ideas and opinions available, leading to a very diverse pool of information. However, critics have argued that algorithms used by search engines, social networking platforms and other large online intermediaries actually decrease information diversity by forming so-called “filter bubbles”. This may form a serious threat to our democracies. In response to this threat others have developed algorithms and digital tools to combat filter bubbles. (...) This paper first provides examples of different software designs that try to break filter bubbles. Secondly, we show how norms required by two democracy models dominate the tools that are developed to fight the filter bubbles, while norms of other models are completely missing in the tools. The paper in conclusion argues that democracy itself is a contested concept and points to a variety of norms. Designers of diversity enhancing tools must thus be exposed to diverse conceptions of democracy. (shrink)

For the theorists of crisis, the revolutionary state comes into existence through violence, and due to its inability to provide an authoritative katechon (restrainer) against internal and external violence, it perpetuates violence until it self-destructs. Writing during extreme economic depression and growing social and political violence, the crisis theorists––Joseph de Maistre, Juan Donoso Cortés, and Carl Schmitt––each sought to blame the chaos of their time upon the Janus-faced postrevolutionary ideals of liberalism and socialism by urging a return to pre-revolutionary moral (...) and religious values. They are united by three counterrevolutionary principles, all of which are purported to remedy revolutionary violence: traditional constitutional fidelity, the philosophy of the decision, and opposition to bourgeois liberalism. This essay is followed by the first complete English translation and publication of Donoso’s letter of October 24, 1851, which contains Donoso’s only reference to the “discussing class,” a political entity later popularized by Schmitt in his 1922 work Political Theology. This volume deals with a number of topics that have not previously been specifically addressed before in a single text. A chapter on Sartre and religion talks about his thought in relation to Christianity, Judaism and Buddhism, while one on Sartre and children discusses his work in relation to the issues of freedom, pregnancy and autism. Beyond this, there are an additional seven chapters covering a wide variety of topics by leading scholars in the fields of philosophy, literature psychology, history (...) and political thought. While prior publications on Sartre have generally divided his work into two periods, pre-and post-Marxist, this volume deliberately stresses a middle and final period as well. As representative of the middle period, there is an emphasis on Notebooks for an Ethics, while Sartre's last work, Hope Now, is also treated as being philosophically significant in its own right. This approach helps to cast a new light on what Sartre has to say about authenticity, childhood and consciousness as embodied, among other subjects. The volume also addresses many and diverse issues of current interest, including those of freedom, Marxism and Sartre's relation to ethics. There are sections of the book that deal with history and the historical situations that helped to shape Sartre's thought, as well as articles that deal with Sartre as a specifically French thinker. A chapter deals with Sartre's relation to women , and here the issues of maternity as problematic, plus authentic, adult relationships are discussed. Finally, in addition to authors in philosophy and literature, there are articles by a child psychiatrist and a clinical psychologist to help to provide new insights on Sartre's work. Even as an academic philosopher Sartre always remained an iconoclast and the aim of this book is, at least partially to capture and provide the reader with insight into this spirit. (shrink)

Some theories of goodness are descriptively rich: they have much to say about what makes things good. Neo-Aristotelian accounts, for instance, detail the various features that make a human being, a dog, a bee good relative to facts about those forms of life. Famously, such theories of relative goodness tend to be comparatively poor: they have little or nothing to say about what makes one kind of being better than another kind. Other theories of goodness—those that take there to be (...) absolute goodness—are comparatively rich: they offer grounds for judging some types of things better than others because they have more absolute goodness. Moorean accounts, for example, can tell us that humans and human experiences are superior to bees and blades of grass. But such theories tend to be descriptively poor: they struggle to tell us in virtue of what this is so. In this essay we motivate and flesh out a view that splits the difference between accounts of goodness as relative and accounts of goodness as absolute. Such a view holds promise only if the mechanics of this kind of metaphysics of goodness can be worked out. Here we present a view on which the paradigm for absolute goodness is God and the paradigm for each kind of relative goodness is a divine idea. (shrink)

This term map can be used to get an overview of concepts and topics in the field and to identify relations between information and communication technology concepts on the one hand and ethical concepts on the other hand. To produce the term map, a data set of over thousand articles (...) published in leading journals and conference proceedings in the C&IE field was constructed. With the help of various computer algorithms, key terms were identified in the titles and abstracts of the articles and co-occurrence frequencies of these key terms were calculated. Based on the co-occurrence frequencies, the term map was constructed. This was done using a computer program called VOSviewer. The term map provides a visual representation of the C&IE field and, more specifically, of the organization of the field around three main concepts, namely privacy, ethics, and the Internet. In computer ethics, as in other branches of applied ethics, the problem of the justification of moral judgment is still unresolved. I argue that the method which is referred to as “The Method of Wide Reflective Equilibrium” (WRE) offers the best solution to it. It does not fall victim to the false dilemma of having to choose either case‐based particularist or principle‐based universalist approaches to the problem of moral justification. I claim that WRE also provides the best model of practical (...) moral reasoning available for computer ethics. It does not pretend to provide quasi‐algorithmic procedures for moral decision‐making, but neither does it abandon the regulative ideal of communicative transparency in discursive public justification. Traditional social worlds enable plural modes of self‐expression and communication across both public and private realms. Our identity involves a variety of aspects of self. Moreover, plural and conflicting aspects of self are often presented within the context of one relationship, role, or encounter. The presentation of less chosen aspects of our selves often also provides the object for the expression of certain relational aspects of respect for one another's privacy. Self‐presentation and shared activity in many online social worlds can (...) also enable autonomy and privacy. The online revolutions in access to information and to one another have provided unprecedented opportunities to expand our knowledge, to pursue our social and working lives, and to carry on all sorts of interests and activities. One specific example of how some of our fears about online evils have been claimed to be exaggerated and misguided concerns fears of risks to our children from online sexual predators. (shrink)

In much of the current academic and public discussion, conspiracy theories are portrayed as a negative phenomenon, linked to misinformation, mistrust in experts and institutions, and political propaganda. Rather surprisingly, however, philosophers working on this topic have been reluctant to incorporate a negatively evaluative aspect when either analyzing or engineering the concept conspiracy theory. In this paper, we present empirical data on the nature of the concept conspiracy theory from five studies designed to test the existence, prevalence and exact form (...) of an evaluative dimension to the ordinary concept conspiracy theory. These results reveal that, while there is a descriptive concept of conspiracy theory, the predominant use of conspiracy theory is deeply evaluative, encoding information about epistemic deficiency and often also derogatory and disparaging information. On the basis of these results, we present a new strategy for engineering conspiracy theory to promote theoretical investigations and institutional discussions of this phenomenon. We argue for engineering conspiracy theory to encode an epistemic evaluation, and to introduce a descriptive expression—such as ‘conspiratorial explanation’—to refer to the purely descriptive concept conspiracy theory. Michael Dummett has shown that the fragment ‘17 Kernsätze zur Logik’ is evidence that Frege knew Lotze's Logik Dummett’s dating of this fragment prior to 1879, however, must be rejected.The present paper shows that there are other articles of Frege’s which bear clear traces of Lotze's LogikFirst of all, the expressions Vorstellungsverlauf from ‘Über die wissenschaftliche Berechtigung einer Begriffsschrift’, and veranlassenden Ursachen, from ‘Logik’, certainly are borrowed from Lotze.Second, there are links between ‘Booles rechnende Logik und die Begriffsschrift’ and Lotze's (...) Logik. Furthermore, it is shown that Frege’s ‘Kernsätze’, the ‘Dialog mit Pünjer über Existenz’, and his ‘Logik’ are intimately connected.All of this indicates that these texts were written in roughly the same period, namely the early 1880s.Conclusive evidence for this is that the terms Vorstellung and Vorstellungsverbindung are used indiscriminately in both a psychological and a logical sense in the ‘Begriffsschrift’, a fact which contradicts the ‘Kernsätze’. In discussions about justice, development, well-being and equality, the capability approach (CA)Footnote1 founded by economist Amartya Sen and philosopher Martha Nussbaum attaches central importance to individual human capabilities. These are the effective freedoms or real opportunities of people to achieve valuable ‘beings and doings’ (also called ‘functionings’ by capability theorists). Resources—including technical artifacts—may contribute to the expansion of one’s capabilities, but there may also be all sorts of ‘conversion factors’ in place that prevent this. The approach highlights the ‘multidimensionality’ of (...) well-being and sees people as active agents shaping their own lives. In 1998 Sen won the Nobel Prize in economics for his work, which has deeply influenced the United Nations Development Program (UNDP). In the field of development studies the CA has indeed gained popularity, but this is not the only area of application. (shrink)

It is argued that Pettit’s conception of “contestatory democracy” is superior to deliberative, direct and epistemic democracy. The strong and weak points of these conceptions are discussed drawing upon the work of a.o Bruce Bimber. The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. In addition, we will scrutinize how the discourse is enacted in both the formal and hidden curriculum, and in the larger medical environment. (shrink)

From folk tales to movies, stories possess features which naturally suit them to contribute to the growth of virtue. In this article I show that the fictional exemplars help the learner to grasp the moral importance of internal states and resolves a tension between existing kinds of exemplars discussed by virtue ethicists. Stories also increase the information conveyed by virtue terms and aid the growth of prudence. Stories can provide virtuous exemplars, inform learners as to the nature of the virtues (...) and offer practice in developing situational judgement. As such they are a significant resource for virtue ethics and moral education. (shrink)

The development of ever smaller integrated circuits at the sub-micron and nanoscale—in accordance with Moore’s Law—drives the production of very small tags, smart cards, smart labels and sensors. Nanoelectronics and submicron technology supports surveillance technology which is practically invisible. I argue that one of the most urgent and immediate concerns associated with nanotechnology is privacy. Computing in the twenty-first century will not only be pervasive and ubiquitous, but also inconspicuous. If these features are not counteracted in design, they will facilitate (...) ubiquitous surveillance practices which are widely available, cheap, and intrusive. Arguably no concept is more fundamental to science than that of causality, for investigations into cases of existence, persistence, and change in the natural world are largely investigations into the causes of these phenomena. Yet the metaphysics and epistemology of causality remain unclear. For example, the ontological categories of the causal relata have been taken to be objects (Hume 1739), events (Davidson 1967), properties (Armstrong 1978), processes (Salmon 1984), variables (Hitchcock 1993), and facts (Mellor 1995). (For convenience, causes and effects (...) will usually be understood as events in what follows.) Complicating matters, causal relations may be singular (Socrates’s drinking hemlock caused Socrates’s death) or general (Drinking hemlock causes death); hence the relata might be tokens (e.g., instances of properties) or types (e.g., types of events) of the category in question. Other questions up for grabs are: Are singular causes metaphysically and/or epistemologically prior to general causes or vice versa (or neither)? What grounds the intuitive asymmetry of the causal relation? Are macro-causal relations reducible to micro-causal relations? And perhaps most importantly: Are causal facts (e.g., the holding of causal relations) reducible to non-causal facts (e.g., the holding of certain spatiotemporal relations)? (shrink)
