Freiheit ist in der Rechtsordnung kein ungeregelter Zustand und damit eben kein grenzenloses Alleskönnendürfen in einem theoretischen Naturzustand. Umgekehrt bewirkt im Regelfall erst die Normierung von Freiheitsrechten einerseits ihre gerichtliche Durchsetzbarkeit, markiert aber andererseits auch die Grenzen tatsächlich gleicher Freiheit für alle Bürger in einem Rechtsraum. Das gilt heute für die nationale wie europäische Ebene. Freiheitsrechte bilden in liberalen Verfassungsstaaten den Kern der Grundrechtsordnung, sind aber heute mit Gleichheitsrechten und der Menschenwürde verwoben. However, the logical means which Frege, Wittgenstein, Russell, and the generation that succeeded them, had at their disposal were those of classical mathematical logic and set-theory, and these indeed are not very suited for an analysis of other (...) aspects of meaning than those which the slogan covers. A real change in view then had to await the emergence of other concepts, which in due course became available mainly under the influence of developments in computer science and cognate disciplines such as artificial intelligence. And this is one of the reasons why it took almost a century before any serious and successful challenge of the view that meaning equals truthconditions from within logical semantics could emerge. Is it right to convict a person of a crime on the basis of purely statistical evidence? Many who have considered this question agree that it is not, posing a direct challenge to legal probabilism – the claim that the criminal standard of proof should be understood in terms of a high probability threshold. Some defenders of legal probabilism have, however, held their ground: Schoeman (1987) argues that there are no clear epistemic or moral problems with convictions based on purely (...) statistical evidence, and speculates that our aversion to such convictions may be nothing more than an irrational bias. More recently, Hedden and Colyvan (2019, section VI) describe our reluctance to convict on the basis of purely statistical evidence as an ‘intuition’, but suggest that there may be no ‘in principle’ problem with such convictions (see also Papineau, forthcoming, section 6). In this paper, I argue that there is, in some cases, an in principle problem with a conviction based upon statistical evidence alone – namely, it commits us to a precedent which, if consistently followed through, could lead to the deliberate conviction of an innocent person. I conclude with some reflections on the idea that the criminal justice system should strive to maximise the accuracy of its verdicts – and the related idea that we should each strive to maximise the accuracy of our beliefs. Recent developments in Continental philosophy have included the emergence of a school of “speculative realism,” which rejects the human-centered orientation that has long dominated Continental thought. Proponents of speculative realism differ on several issues, but many agree on the need for an object-oriented ontology. Some speculative realists identify realism with materialism, while others accord equal reality to objects that are non-material, even fictional. Several thinkers retain a focus on difference, a well-established theme in Continental thought. This paper looks at speculative (...) realism from the perspective of systems theory. Many of the tenets of speculative realism have long been features of systems metaphysics and are expressed clearly in a systems framework. In this paper I respond to Marcello Di Bello’s criticisms of the ‘normic account’ of the criminal standard of proof. In so doing, I further elaborate on what the normic account predicts about certain significant legal categories of evidence, including DNA and fingerprint evidence and eyewitness identifications.

The phenomenon of altruism extends from the biological realm to the human sociocultural realm. This article sketches a coherent outline of multiple types of altruism of progressively increasing scope that span these two realms and are grounded in an ever-expanding sense of “self.” Discussion of this framework notes difficulties associated with altruism at different levels. It links scientific ideas about the evolution of cooperation and about hierarchical order to perennial philosophical and religious concerns. A moral requirement R1 is said to be lexically prior to a moral requirement R2 just in case we are morally obliged to uphold R1 at the expense of R2 – no matter how many times R2 must be violated thereby. While lexical priority is a feature of many ethical theories, and arguably a part of common sense morality, attempts to model it within the framework of decision theory have led to a series of problems – a fact which is (...) sometimes spun as a ‘decision theoretic critique’ of lexical priority. In this paper, I develop an enriched decision theoretic framework that is capable of modelling lexical priority while avoiding all extant problems. This will involve introducing several new ingredients into the standard decision theoretic framework, including multidimensional utilities, de minimis risks, and the means to represent two different conceptions of risk. Entitlement is defined as a sort of epistemic justification that one can possess by default – a sort of epistemic justification that does not need to be earned or acquired. Epistemologists who accept the existence of entitlement generally have a certain anti-sceptical role in mind for it – entitlement is intended to help us resist what would otherwise be compelling radical sceptical arguments. But this role leaves various details unspecified and, thus, leaves scope for a number of different potential conceptions (...) of entitlement. At one extreme there are conceptions that portray entitlement as a weak, attenuated epistemic status and, at the other, we have conceptions that portray entitlement as something potent and strong. Certain intermediate conceptions are also possible. In this paper, I shall argue that the weak and intermediate conceptions of entitlement do not survive careful scrutiny, and the stronger conceptions – while they do, in a way, strain credulity – are the only conceptions that are ultimately viable. Species spreading beyond their native ranges are important study objects in ecology and environmental sciences and research on biological invasions is thriving. Along with an increase in the number of publications, the research field is experiencing an increase in the diversity of methods applied and questions asked. This development has facilitated an upsurge in information on invasions, but it also creates conceptual and practical challenges. To provide more transparency on which kind of research is actually done in the field, the (...) distinction between invasion science, encompassing the full spectrum of studies on biological invasions and the sub-field of invasion biology, studying patterns and mechanisms of species invasions with a focus on biological research questions, can be useful. Although covering a smaller range of topics, invasion biology today still is the driving force in invasion science and we discuss challenges stemming from its embeddedness in the social context. Invasion biology consists of the building blocks 'theory', 'case studies' and 'application', where theory takes the form of conceptual frameworks, major hypotheses and statistical generalisations. Referencing recent work in philosophy of science, we argue that invasion biology, like other biological or ecological disciplines, does not rely on the development of an all-encompassing theory in order to be efficient. We suggest, however, that theory development is nonetheless necessary and propose improvements. Recent advances in data visualisation, machine learning and semantic modelling are providing opportunities for enhancing knowledge management and presentation and we suggest that invasion science should use these to transform its ways of publishing, archiving and visualising research. Along with a stronger focus on studies going beyond purely biological questions, this would facilitate the efficient prevention and management of biological invasions. (shrink)

The standard of proof applied in civil trials is the preponderance of evidence, often said to be met when a proposition is shown to be more than 50% likely to be true. A number of theorists have argued that this 50%+ standard is too weak – there are circumstances in which a court should find that the defendant is not liable, even though the evidence presented makes it more than 50% likely that the plaintiff’s claim is true. In this paper, (...) I will recapitulate the familiar arguments for this thesis, before defending a more radical one: The 50%+ standard is also too strong – there are circumstances in which a court should find that a defendant is liable, even though the evidence presented makes it less than 50% likely that the plaintiff’s claim is true. I will argue that the latter thesis follows naturally from the former once we accept that the parties in a civil trial are to be treated equally. Charting new routes for film ethics, _Transformational Ethics of Film_ develops a critical account of the ethics of personal transformation at work within the ‘film as philosophy’ debate.

This work is an exceptionally rich account both of the connections and divergences between Levinas and Derrida as ethical thinkers. Against the backdrop of nineteenth and twentieth century philosophy and phenomenology, Srajek draws on Hermann Cohen's ethics of correlation so as to demonstrate how far it is possible to read Levinas and Derrida as constructing similar approaches to ethics.

Discussions often end before the issues that started them have been resolved. For example, in the late sixties and early seventies, a hot topic in philosophical logic was the development of an adequate semantics for the language of modal predicate logic. However, the result of this discussion was not one single system that met with general agreement, but a collection of alternative systems, each defended most ably by its proponents.

The present article deals with issues of social recognition in the global and transnational environment. It deals with the issue of solidarity, a form of recognition that has no adequate parallel beyond nation state borders and manifests itself mainly in the transnational economy. We focus on the articulation of the extraterritorial recognition of social rights-holders at the international and transnational levels of justice. It is clear that conditions in developing countries do not allow the people there to express disapproval in (...) ways that are typical for Western societies. We stress that states should strengthen their influence in global and transnational organizations and equally that the media should improve its informative role and should provide information on what is happening in developing parts of the world. For researchers who study technology designs, the application and execution of so-called design-oriented research projects are a common way of funding their research. Against this background, we propose a new methodical approach with which VSD can easily be implemented in such projects and which we call “value declaration”. We share our experience with this method which we gained in two design-oriented research projects.

Invasion ecology addresses the spread of species outside of their native ranges. A central aim of this field is to find mechanistic explanations for why species are able to establish and spread in an area in which they did not evolve. Usually it remains unclear, however, what exactly is meant by ‘mechanistic explanation’ or ‘mechanism’. The paper argues that the field can benefit from the philosophical discussion of what a mechanism is. Based on conceptions of mechanisms as processes in concrete (...) systems, causal mechanisms can be defined as one type of mechanism, representing recurring networks of causal relationships. With the example of a well-known hypothesized mechanism in invasion ecology, namely enemy release, the paper demonstrates how such causal mechanisms can be depicted as causal network diagrams. This approach could facilitate the development of step-by-step explanations, enhance clear argumentation and allow for more precise linkage of empirical tests to theory. Challenges to assessing the empirical relevance of hypothesized mechanisms are discussed, and suggestions are made concerning how the proposed approach could help in overcoming some of them. Embedding Human Rights in business practice is a challenge many multinational companies have to deal with to avoid reputational risks or to comply with soft law requirements. However, in doing so, the normative concept of corporate human rights obligations is both legally and ethically imprecise and the “UN Guiding Principles on Business and Human Rights” are just partly helpful. Therefore, it is asked and analyzed, if legal respectively ethical dogmatism or specific sustainability market mechanisms can provide guidance and clarity. The (...) examination however reveals legally paradox results. Not legitimized institutions might restrict companies unreasonably. From this perspective, it remains unclear, for which human rights behavior they are held accountable. A corporate human rights approach therefore should be aware of that and thoroughly chosen.
