While many people outside India find the images, sounds, and practices of Indian performing arts compelling and endeavor to incorporate them into the "global" repertoire, few are aware of the central role of religious belief and practice in Indian aesthetics. Completing the trilogy that includes Darsan: Seeing the Divine and Mantra: Hearing the Divine in India and America, this volume focuses on how rasa has been applied in a range of Indian performance traditions. "Rasa" is taste, essence, flavor. How is (...) it possible that a word used to describe a delicious masala can also be used to critique a Bharata Natyam performance? Rasa expresses the primary goals of performing arts in India in all the major literary, philosophical, and aesthetic texts, and it provides the cornerstone of the oral traditions of transmission. It is also essential to the study and production of sculpture, architecture, and painting. Yet its primary referent is cuisine. This book articulates the religious sensibility underlying the traditional performing arts as well as other applications of rasa and examines the relationships between the arts and religion in India today. BACKGROUND Patients with chronic pain face significant barriers in finding clinicians to manage long-term opioid therapy (LTOT). For patients on LTOT, it is increasingly common to have them sign opioid treatment agreements (OTAs). OTAs enumerate the risks of opioids, as informed consent documents would, but also the requirements that patients must meet to receive LTOT. While there has been an ongoing scholarly discussion about the practical and ethical implications of OTA use in the abstract, little is known about how clinicians (...) use them and if OTAs themselves modify clinician prescribing practices. OBJECTIVE To determine how clinicians use OTAs and the potential impacts of OTAs on opioid prescribing. DESIGN We conducted qualitative analysis of four focus groups of clinicians from a large Midwestern academic medical center. Groups were organized according to self-identified prescribing patterns: two groups for clinicians who identified as prescribers of LTOT, and two who did not. PARTICIPANTS 17 clinicians from General Internal Medicine, Family Medicine, and Palliative Care were recruited using purposive, convenience sampling. APPROACH Discussions were recorded, transcribed, and analyzed for themes using reflexive thematic analysis by a multidisciplinary team. KEY RESULTS Our analysis identified three main themes: (1) OTAs did not influence clinicians’ decisions whether to use LTOT generally but did shape clinical decision-making for individual patients; (2) clinicians feel OTAs intensify the power they have over patients, though this was not uniformly judged as harmful; (3) there is a potential misalignment between the intended purposes of OTAs and their implementation. CONCLUSION This study reveals a complicated relationship between OTAs and access to pain management. While OTAs seem not to impact the clinicians’ decisions about whether to use LTOT generally, they do sometimes influence prescribing decisions for individual patients. Clinicians shared complex views about OTAs’ purposes, which shows the need for more clarity about how OTAs could be used to promote shared decision-making, joint accountability, informed consent, and patient education. The structural approach to alternatives :669–690, 2007; Fox and Katzir in Nat Lang Semant 19:87–107, 2011; Katzir in Semantics, pragmatics and the case of scalar implicatures, Palgrave Macmillan, London, pp 40–71, 2014) is the most developed attempt in the literature at solving the symmetry problem of scalar implicatures. Problematic data with indirect and particularised scalar implicatures have however been raised :249–270, 2015). To address these problems, Trinh and Haida proposed to augment the theory with the Atomicity Constraint. Here we show (...) that this constraint falls short of explaining minimal variants of the original problems, and moreover that it runs into trouble with the inferences of sentences involving gradable adjectives like full and empty. We furthermore discuss how the structural approach suffers at times from the problem of ‘too many lexical alternatives’ pointed out by Swanson :31–36, 2010), and at other times from the opposite problem of ‘too few lexical alternatives’. These three problems epitomise the challenge of constructing just enough alternatives under the structural approach to solve the symmetry problem in full generality. Finally, we also sketch another recent attempt at solving the symmetry problem, Bergen et al., 2016), which is based on relative informativity and complexity. We argue that Bergen et al. do not provide a general solution to the symmetry problem either, by pointing to some of the open problematic cases that remain for this approach as well. We conclude that while important progress has been made in the theory of alternatives for scalar implicatures in the last few years, a full solution to the symmetry problem has not yet been attained. Context Opioid treatment agreements (OTAs) are documents that clinicians present to patients when prescribing opioids that describe the risks of opioids and specify requirements that patients must meet to receive their medication. Notwithstanding a lack of evidence that OTAs effectively mitigate opioids’ risks, professional organizations recommend that they be implemented, and jurisdictions increasingly require them. We sought to identify the jurisdictions that require OTAs, how OTAs might affect the outcomes of lawsuits that arise when things go wrong, and instances in (...) which the law permits flexibility for clinicians and health care institutions to adopt best practices. -/- Methods We surveyed the laws and regulations of all 50 states and the District of Columbia to identify which jurisdictions require the use of OTAs, the circumstances in which OTA use is mandatory, and the terms OTAs must include (if any). We also surveyed criminal and civil judicial decisions in which OTAs were discussed as evidence on which a court relied to make its decision to determine how OTA use influences litigation outcomes. -/- Findings Results show that a slight majority (27) of jurisdictions now require OTAs. With one exception, the jurisdictions’ requirements for OTA use are triggered at least in part by long-term prescribing. There is otherwise substantial variation and flexibility within OTA requirements. Results also show that even in jurisdictions where OTA use is not required by statute or regulation, OTA use can inform courts’ reasoning in lawsuits involving patients or clinicians. Sometimes, but not always, OTA use legally protects clinicians from liability. -/- Conclusions -/- Our results show that OTA use is entwined with legal obligations in various ways. Clinicians and health care institutions should identify ways for OTAs to enhance clinician–patient relationships and patient care within the bounds of relevant legal requirements and risks. (shrink)

Genomic research projects that collect tissues from deceased organ and tissue donors must obtain the authorization of family decision makers under difficult circumstances that may affect the authorization process. Using a quasi-experimental design, the Ethical, Legal, and Social Issues (ELSI) substudy of the Genotype-Tissue Expression (GTEx) project compared the recall and understanding of the donation authorization process of two groups: family members who had authorized donation of tissues to the GTEx project (the comparison group) and family members who had authorized (...) organ and tissue donations in years previous, who subsequently participated in two different mock-authorization processes that mimicked the GTEx authorization process (the intervention groups). Participants in the comparison and intervention groups were matched on key demographic characteristics.We found that participants in the intervention groups who experienced a mock-authorization process demonstrated better recall of the tissue donation request than members of the comparison group. Our data indicate that the stress associated with the loss of a loved one limited the ability of family members to recall details about the GTEx project. However, we found a similar lack of knowledge in both the comparison and the intervention group participants, suggesting lack of knowledge may be due to the complexity and unfamiliarity of the information presented to them during the authorization process. We discuss these findings in the context of everyday clinical decision making in cognitively challenging conditions. (shrink)

Background: One of the barriers to interprofessional ethics education is a lack of resources that actively engage students in reflection on living an ethical professional life. This project implemented and evaluated an innovative resource for interprofessional ethics education. Objectives: The objective of this project was to create and evaluate an interprofessional learning activity on professionalism, clinical ethics, and research ethics. Design: The Brewsters is a choose-your-own-adventure novel that addresses professionalism, clinical ethics, and research ethics. For the pilot of the book, (...) a pre-test/post-test design was used. Once implemented across campus, a post-test was used to evaluate student learning in addition to a student satisfaction survey. Participants and research context: A total of 755 students in six academic schools in a health science center completed the activity as part of orientation or in coursework. Ethical considerations: The project was approved as exempt by the university’s Committee for the Protection of Human Subjects. Findings: The pilot study with 112 students demonstrated a significant increase in student knowledge. The 755 students who participated in the project had relatively high knowledge scores on the post-test and evaluated the activity positively. Discussion: Students who read The Brewsters scored well on the post-test and had the highest scores on clinical ethics. Clinical ethics scores may indicate issues encountered in mass media. Conclusion: The Brewsters is an innovative resource for teaching interprofessional ethics and professionalism. Further work is needed to determine whether actual and long-term behavior is affected by the activity. (shrink)

Current evolutionary and cognitive theories of religion posit that supernatural agent concepts emerge from cognitive systems such as theory of mind and social cognition. Some argue that these concepts evolved to maintain social order by minimizing antisocial behavior. If these theories are correct, then people should process information about supernatural agents’ socially strategic knowledge more quickly than non-strategic knowledge. Furthermore, agents’ knowledge of immoral and uncooperative social behaviors should be especially accessible to people. To examine these hypotheses, we measured response-times (...) to questions about the knowledge attributed to four different agents—God, Santa Claus, a fictional surveillance government, and omniscient but non-interfering aliens—that vary in their omniscience, moral concern, ability to punish, and how supernatural they are. As anticipated, participants respond more quickly to questions about agents’ socially strategic knowledge than non-strategic knowledge, but only when agents are able to punish. (shrink)

Background U.S. federal regulations require that certain ethical elements be followed to protect human research subjects. The location and clinical circumstances of a proposed research study can differ substantially and can have significant implications for these ethical considerations. Both the location and clinical circumstances are particularly relevant for research in intensive care units (ICUs), where patients are often unable to provide informed consent to participate in a proposed research intervention. Purpose Our goal is to elaborate on the updated 2013 U.S. (...) Food and Drug Administration (FDA) guidance document regarding an exemption from the requirement of obtaining informed consent from patients or their surrogates and to address certain elements within that document, thereby assisting clinicians in developing a framework for emergency research in accordance with the regulatory bodies at their own institutions and in the United States. Methods Review of the 2011 and updated FDA guidance document on exemption from informed consent. Results The current process of obtaining informed consent within ICUs needs to be revisited, especially for research in which timely informed consent is not likely. In particular, the process of obtaining informed consent may not be appropriate or even ethical for critically ill patients in extremis who require an intervention for which there is no current acceptable standard of care and clinical equipoise exists. We provide clinicians with a viewpoint that further elaborates on the FDA guidance document. Limitations The viewpoints provided herein are those of the authors and are therefore inherently limited by the personal views of a selected few. Other clinicians or researchers may not interpret the FDA guidelines in a similar manner. Moreover, the discussion of a guideline document is a limitation in and of itself. The guidelines set forth by the FDA are precisely that—guidelines. Therefore, they may not be followed as outlined in the guidance document within one’s own institution. Our goal is that, by elaborating on the guidelines for planned research involving human subjects in the ICU, institutional regulatory bodies may gain a better understanding in drafting their own document when faced with a clinician or a researcher who wishes to conduct planned research in an ICU. Conclusions We believe that the interpretations provided will allow clinicians to safely undertake planned research in ICUs without endangering the main tenets of ethical research involving human participants. We can only determine what an emotion is if we first ask whether or not there are intrinsically emotional entities. To ask if there are intrinsically emotional entities is to ask if there are entities that are necessary and sufficient conditions for the correct application of emotion-words. Recently, Robert Solomon has developed a view of the emotions according to which there are intrinsically emotional entities. Specifically, he claims that emotions are a kind of judgment. Our task in this paper is (...) to state and criticize Solomon's view. We argue that he has failed to distinguish emotional and non-emotional judgments. We also argue that Solomon fails to establish his "unitary form" analysis of emotions. He has not, therefore, vindicated the questionable assumption that there are intrinsically emotional entities. These essays examine both Socrates' and modern political philosophers' attempts to answer the question of the right life for human beings, as those attempts are introduced and elaborated in the work of thinkers from Homer and Thucydides to Nietzsche and Charles Taylor.

This book builds on the idea that pragmatics and philosophy are strictly interconnected and that advances in one area will generate consequential advantages in the other area. The first part of the book, entitled ‘Theoretical Approaches to Philosophy of Language’, contains contributions by philosophers of language on connectives, intensional contexts, demonstratives, subsententials, and implicit indirect reports. The second part, ‘Pragmatics in Discourse’, presents contributions that are more empirically based or of a more applicative nature and that deal with the pragmatics (...) of discourse, argumentation, pragmatics and law, and context. The book presents perspectives which, generally, make most of the Gricean idea of the centrality of a speaker’s intention in attribution of meaning to utterances, whether one is interested in the level of sentence-like units or larger chunks of discourse. Richard Rorty does have something ‘to say to [Black Americans]’ and to their racially conscious nonblack allies in the sense that his understanding of liberalism, his prophecies about the future and his urgent appeals to the American Left all paint a picture of a white middle class fully prepared to make life increasingly miserable for Black Americans unless it is ‘protected from catastrophe’. Rorty hopes that this group will undergo a moral transformation that enables it to see past its narrow (...) group interests, but doubts that it will. He, nevertheless, prescribes a politics of hope and appeasement as a hedge against both despair and backsliding. In so doing, he fails to appreciate the availability and the suitability of an alternative ‘racial realist’ (and tragicomic) posture vis-à-vis American liberalism inspired by thinkers like Ralph Ellison, James Baldwin and Derrick Bell. This alternative enables racially conscious Americans to respond to the intransigence of (certain) white Americans with cunning rather than by escaping into fantasies of a ‘dream country’ unmarked by the damage caused by racism and its long-lingering effects. I uncover and explore this alternative through Rorty’s warnings regarding the white middle class, a somewhat surprising consistency between Rorty’s brand of class politics and Bell’s understanding of ‘racial fortuity’, and, finally, through a development of Bell’s ‘racial realist’ posture combined with Baldwin’s ‘uses of the blues’ resulting in a ‘hard-eyed’ tragicomic sensibility sufficient to effectively pair continued struggle with creative consolation and resilience. I criticize Richard Fumerton’s fallibilist acquaintance theory of noninferential justification.

A central claim of Deleuze's reading of Bergson is that Bergson's distinction between space as an extensive multiplicity and duration as an intensive multiplicity is inspired by the distinction between discrete and continuous manifolds found in Bernhard Riemann's 1854 thesis on the foundations of geometry. Yet there is no evidence from Bergson that Riemann influences his division, and the distinction between the discrete and continuous is hardly a Riemannian invention. Claiming Riemann's influence, however, allows Deleuze to argue that quantity, in (...) the form of ‘virtual number’, still pertains to continuous multiplicities. This not only supports Deleuze's attempt to redeem Bergson's argument against Einstein in Duration and Simultaneity, but also allows Deleuze to position Bergson against Hegelian dialectics. The use of Riemann is thereby an important element of the incorporation of Bergson into Deleuze's larger early project of developing an anti-Hegelian philosophy of difference. This article first reviews the role of discrete and continuous multiplicities or manifolds in Riemann's Habilitationsschrift, and how Riemann uses them to establish the foundations of an intrinsic geometry. It then outlines how Deleuze reinterprets Riemann's thesis to make it a credible resource for Deleuze's Bergsonism. Finally, it explores the limits of this move, and how Deleuze's later move away from Bergson turns on the rejection of an assumption of Riemann's thesis, that of ‘flatness in smallest parts’, which Deleuze challenges with the idea, taken from Riemann's contemporary, Richard Dedekind, of the irrational cut. This essay comments on the British Medical Association's recent suggestion that protocols for Elective Ventilation (EV) might be revived in order to increase the number of viable organs available for transplant. I suggest that the proposed revival results, at least in part, from developments in the contemporary political landscape, notably the decreasing likelihood of an opt-out system for the UK's Organ Donor Register. I go on to suggest that EV is unavoidably situated within complex debates surrounding the epistemology and ontology (...) of death. Such questions cannot be settled a priori by medical science, bioethics or philosophical reflection. As Radcliffe-Richards suggests, the determination of death has become a moral question, and therefore, now extends into the political arena. I argue for the conclusion that EV, and wider debates about organ donation and the constitution of the organ donation register, are matters of ‘biocitizenship’ and must, therefore, be addressed as ‘biopolitical’ questions. This article seeks to recover a familiar but unappreciated female voice from English Puritanism of the seventeenth century, that of Margaret Baxter. Various challenges to such recovery are examined, most notably the nature of her relationship to her pastor and husband, Richard. Extant literature from Margaret’s hand focuses on the events surrounding her conversion and life-threatening illness shortly thereafter. The present analysis of these texts and their circumstances concludes that Margaret was a faithful but critical heir of the practical theology (...) of her day, and that in her lived expression of that tradition one observes the enduring scars of the trauma of her conversion. One of the more serious criticisms of the B-theory is that by denying the passage of time or maintaining that passage is a mind-dependent illusion or appearance, the B-theory gives rise to a static, block universe and thereby removes what is most distinctively timelike about time. The aim of this paper is to discuss the R-theory of time, after Russell, who Richard Gale calls “the father of the B-theory,” and explain how the R-theory can respond to the criticisms just raised, (...) and others. In the course of my discussion I shall clarify differences between versions of the A-, B- and R-theories of time, and argue that McTaggart’s conception of the B-series and more specifically, the B-relations that generate it, has been instrumental in misconstruing the A-/B-theory debate resulting in criticisms of the B-theory that can be seen to be fallacious when applied to the R-theory. At the turn of the twentieth century, biologists such as Oscar Riddle, Thomas Hunt Morgan, Frank Lillie, and Richard Goldschmidt all puzzled over the question of sexual difference, the distinction between male and female. They all offered competing explanations for the biological cause of this difference, and engaged in a fierce debate over the primacy of their respective theories. Riddle propounded a metabolic theory of sex dating from the late-nineteenth century suggesting that metabolism lay at the heart of sexual difference. (...) Thomas Hunt Morgan insisted on the priority of chromosomes, Frank Lillie emphasized the importance of hormones, while Richard Goldschmidt supported a mixed model involving both chromosomes and hormones. In this paper, I will illustrate how the older metabolic theory of sex was displaced when those who argued for the relatively newer theories of chromosomes and hormones gradually formed an alliance that accommodated each other and excluded the metabolic theory of sex. By doing so, proponents of chromosomes and hormones established their authority over the question of sexual difference as they laid the foundations for the new disciplines of genetics and endocrinology. Their debate raised urgent questions about what constituted sexual difference, and how scientists envisioned the plasticity and controllability of this difference. These theories also had immediate political and cultural consequences at the turn of the twentieth century, especially for the eugenic and feminist movements, both of which were heavily invested in knowledge of sex and its determination, ascertainment, and command. PRECISELY BECAUSE OF ITS RICHNESS, Richard's Rorty's latest book evokes the question: Is there any relation between the three components of its title, Contingency, Irony and Solidarity?

IN THE VARIOUS WRITINGS of Richard Rorty we encounter a consistent, though fragmentary, reference to Hegel's system. The system is presented as based on the notion that there is no rounded philosophy and that philosophy is essentially immersed in the sequence of historical time or is a manifestation of what goes by the term "spirit of time." It will be our task to attempt to understand that version of Hegel and formulate some critical remarks about the justification for that presentation.

Aristotle's Organon provides an ingeniously systematic way to identify the discrete nature of disciplines that concern human thought and expression. While such an approach helps to understand the unique properties that warrant the recognition of disciplines as discrete, Aristotle's system of classification does not capture well the dynamics, synergy, and symbiotic relationships that appear when disciplines intersect. Perhaps, in fairness to Aristotle, his task was not to explore such relationships, but that does not mean that we should not try to (...) better understand the nature and impact of disciplines such as rhetoric by examining their interplay within the dynamics of social interaction. In "Counting and Indeterminate Identity", N. Ángel Pinillos develops an argument that there can be no cases of `Split Indeterminate Identity'. Such a case would be one in which it was indeterminate whether a=b and indeterminate whether a=c, but determinately true that b≠c. The interest of the argument lies, in part, in the fact that it appears to appeal to none of the controversial claims to which similar arguments due to Gareth Evans and Nathan Salmon appeal. I argue for (...) two counter-claims. First, the formal argument fails to establish its conclusion, for essentially the same reason Evans's and Salmon's arguments fail to establish their conclusions. Second, the phenomena in which Pinillos is interested, which concern the cardinalities of sets of vague objects, manifest the existence of what Kit Fine called `penumbral connections', phenomena that the logics Pinillos considers are already known not to handle well. During the first week of June 1970, Marquette University sponsored a symposium to celebrate the two hundredth anniversary of Hegel’s birth. For many of us who attended the symposium, it was a memorable week. It was among the very best meetings that I have ever attended - the very model of what civilized speech can be. The symposium was beautifully organized by our hosts at Marquette. A rare group of international scholars were invited to participate. In addition to Hegel scholars (...) from the United States and Canada, Otto Pöggeler from Germany, Eric Weil and Jean-Yves Calvez from France, David McLellan from England, Nathan Rotenstreich and Shlomo Avineri from Israel were present. Papers were distributed to all participants, and there was plenty of opportunity for formal and informal discussion. But what made the symposium so unusual was the spirit that pervaded it. There was a collective sense that we were on the threshold of a new era of Hegel scholarship in the Anglo-Saxon world. As Frederick G. Weiss reported in his “Critical Survey of Hegel Scholarship in English: 1962–69,” there was already clear evidence of a renaissance of serious interest in Hegel. If we consider the works bearing on Hegel that have been published since 1970, the evidence is now overwhelming. (shrink)

We sometimes seek expert guidance when we don’t know what to think or do about a problem. In challenging cases concerning medical ethics, we may seek a clinical ethics consultation for guidance. The assumption is that the bioethicist, as an expert on ethical issues, has knowledge and skills that can help us better think about the problem and improve our understanding of what to do regarding the issue.The widespread practice of ethics consultations raises these questions and more:What would it take (...) to be a moral expert?Is anyone a moral expert, and if so, how could a non-expert identify one?Is it in any way problematic to accept and follow the advice of a moral expert as opposed to coming to moral conclusions on your own?What should we think and do when moral experts disagree about a practical ethical issue?In what follows, we address these theoretical and practical questions about moral expertise. A new philosophical analysis is provided of the notorious Sleeping Beauty Problem. It is argued that the correct solution is one-third, but not in the way previous philosophers have typically meant this. Previous commentators have failed to appreciate the significance of the information that Beauty gains upon (...) waking, and which is relevant to the conditional chance of heads: de re acquaintance with the awakening itself and the non-locating knowledge that it is an experimental awakening. David Lewis and company are committed to several unjustifiable and unacceptable probability assessments. Previous commentators have in effect confused the information that Beauty undergoes this particular experimental awakening for the information that she undergoes some experimental awakening or other. Lewis in particular thereby illegitimately tips the scales both in favor of heads and in favor of Monday. The Sleeping Beauty Problem is equivalent to a ball-in-urn word problem in elementary probability theory. (shrink)

I argue that legal punishment is morally wrong because it’s too morally risky. I first briefly explain how my argument differs from similar ones in the philosophical literature on legal punishment. Then I explain why legal punishment is morally risky, argue that it’s too morally risky, and discuss objections. In a nutshell, my argument goes as follows. Legal punishment is wrong because we can never sufficiently reduce the risk of doing wrong when we legally punish people. The “somewhat vague, intuitive” notion from computability theory of an effective procedure (method) or algorithm can be fairly precisely defined even if it is not sufficiently formal and precise to belong to mathematics proper (in a narrow sense)—and even if (as many have asserted) for that reason the Church–Turing thesis is unprovable. It is proved logically that the class of effective procedures is not decidable, i.e., that no effective procedure is possible for ascertaining whether a given procedure is effective. This (...) undecidability result is proved directly from the notion itself of an effective procedure, without reliance on any (partly) mathematical lemma, conjecture, or thesis invoking recursiveness or Turing-computability. In fact, there is no reliance on anything very mathematical. The proof does not even appeal to a precise definition of ‘effective procedure’. Instead, it relies solely and entirely on a basic grasp of the intuitive notion of an effective procedure. Though the result that effectiveness is undecidable is not surprising, it is also not without significance. It has the consequence, for example, that the solution to a decision problem, if it is to be complete, must be accompanied by a separate argument that the proposed ascertainment procedure invariably terminates with the correct verdict. Written across the disciplines of art history, literature, philosophy, sociology, and theology, the ten essays comprising the collection all insist on multidimensional definitions of evil. Taking its title from a moment in Shakespeare's Tempest when Prospero acknowledges his responsibility for Caliban, this collection explores the necessarily ambivalent relationship between humanity and evil. To what extent are a given society's definitions of evil self-serving? Which figures are marginalized in the process of identifying evil? How is humanity itself implicated in the production (...) of evil? Is evil itself something fundamentally human? These questions, indicative of the kinds of issues raised in this collection, seem all the more pressing in light of recent world events. To counter the imbalance in vaccine distribution during the COVID-19 pandemic, Albertsen and more recently Germaniet alhave suggested a new system of taxation coined as ‘VaxTax’ that would force higher-income countries to fund the access of low-income and middle-income countries (LMICs) to new vaccines in times of pandemic. I will argue that this idea faces numerous challenges of ethical, sociopolitical and economical nature that may hinder any effort to solve the numerous health challenges that LMICs face.
