The concept of identity has become widespread within the social and behavioral sciences in recent years, cutting across disciplines from psychiatry and psychology to political science and sociology. All individuals claim particular identities given their roles in society, groups they belong to, and characteristics that describe themselves. The rationale for pursuing the development and use of Germ-Line selection and modification techniques is examined in this essay. The argument is put forth that it is the moral obligation of the medical profession to make available to the public any technology that can cure or prevent pathology leading to death and disability, in both the present and future generations. Society should pursue the development of strategies for preventing or correcting, at the Germ-Line level, genetic features that will lead to, (...) or enhance, pathological conditions. Because prenatal screening and even early embryo screening and selection can prevent only a subset of known genetic disorders, direct genetic intervention is the only way in which certain couples can exercise their rights to reproductive health. Finally, the arguments most often raised against the pursuit of and use of methods for Germ-Line intervention shall be discussed. It was probably written in the mid-1940s, after the second edition of Korzybski's Science and Sanity and The Philosophy of Literary Form, both published in 1941; perhaps at roughly the same time as the more extended discussions of behaviorism and Korzybski in A Grammar of Motives, published in 1945; and before the full development of Burke's ideas about persuasion, identification, and dialectical symmetry in A Rhetoric of Motives, published in 1950. The paper might have been prepared for a public lecture or for circulation among Burke's literary friends, as a brief commentary on some of the key concepts in A Rhetoric of Motives, while he was completing A Grammar of Motives or perhaps shortly following its publication. If so, then it might have been written as late as 1947.3This paper suggests that Burke's concept of identification was in part a creative response to current issues in behaviorism and general semantics, formulated in sympathy with George Herbert Mead's observations on identification, communication, and community in Mind, Self, and Society and The Philosophy of the Act and in opposition to Korzybski's general semantics and his structural differential. Moreover, and more important, this paper suggests that the final section of A Rhetoric of Motives, titled simply "Order," is essential to a complete understanding of Burke's ideas about persuasion and identification since only in this last section does Burke show how competing points of view [End Page 333] might be reconciled in an ultimate identification via the dialectical symmetry that he traces through the long history of Platonic thought.4James P. Hence he surveys the resources of rhetoric, to the end that one might use the best means available for a given situation. To narrow down the choice of means, he makes a division into kinds of oratory: deliberative (concerned with the expediency of steps still to be taken); forensic (concerned with the justice or injustice of past acts); and demonstrative or epideictic (concerned with praise and blame, primarily involving the present). But to be effective in any of these kinds, one must appeal to the opinions of one's audience—hence the lists of "topics" reviewing such opinions. First he considers the components of happiness, on the grounds that all men aim at happiness, hence this topic figures in all persuasion and dissuasion. For deliberative oratory specifically, he lists the topics naming men's opinions as to the good, the expedient, and their opposites (along with relevant observations on different forms of government). His topics for epideictic, dealing with praise and blame, comprise the things men consider virtuous and vicious. And his list of forensic topics has to do with the motives and effects of just and unjust acts. Also, there are such general topics as the possible and impossible, the more and the less, the likely and the unlikely.Enthymemes (deductions based on opinion) fit well with forensic, he says. This paper examines the role of ?situations? in John Dewey's philosophy of logic. To do this properly it is necessary to contrast Dewey's conception of experience and mentality with views characteristic of modern epistemology. The primary difference is that, rather than treat experience as peripheral and or external to mental functions (reason, etc.), we should treat experience as a field in and as a part of which thinking takes place. Experience in this broad sense subsumes theory and fact, hypothesis and (...) evidence, reason and observation, thought and perception. Logic in this view is a formal study of the generic features of all possible kinds of experience in this broad (thick, deep, wide, multifaceted) sense. The goal of this paper is to explain what Dewey thinks a situation is in the context of this view of experience, and to argue for the fundamental importance of that idea for logic and philosophy in general. This essay considers the relationship between ideal theory and non-ideal theory. It begins with Rawls’s conception of ideal theory and A. John Simmons’s articulation of non-ideal theory. Both defend the priority of ideal theory over non-ideal theory. The essay then considers three different conceptions of the social barriers standing in the way of an ideal society, taken broadly from Mill, Marx, and Foucault. Each conception of power suggests a divergent strategy for pursuing non-ideal theory. The Foucauldian conception also suggests reasons (...) to mistrust our own political and moral judgments. The essay advocates a more limited view of the relationship between ideal and non-ideal theory than is commonly described, in which ideal theory retains its logical priority but not its temporal priority. In other words, the essay argues that we will fare best when we focus first on reducing specific injustices while setting aside further speculation about the character of an ideal society. (shrink)

Objective: The objective of the current study was to maximise the amount of information children and adolescents understand about the risks and benefits associated with participation in a biomedical research study.Design: Participants were presented with one of six hypothetical research protocols describing how to fix a fractured thigh using either a “standard” cast or “new” pins procedure. Risks and benefits associated with each of the treatment options were manipulated so that for each one of the six protocols there was either (...) a correct or ambiguous choice.Participants and setting: Two hundred and fifty one children, ages 6–15 , and 237 adults were interviewed while waiting for a clinic appointment at the Hospital for Sick Children.Results: Using standardised procedures and questionnaires, it was determined that most participants, regardless of age group, were able to understand the basic purpose and procedures involved in the research, and most were able to choose the “correct” operation. The younger children, however, showed an overall preference for a cast operation, whereas the older participants were more likely to choose the pins.Conclusions: By creating age appropriate modules of information, children as young as six years can understand potentially difficult and complex concepts such as the risks and benefits associated with participation in biomedical research. It appears, however, that different criteria were used for treatment preference, regardless of associated risks; older participants tended to opt for mobility whereas younger participants stayed with the more familiar cast operation. This essay is concerned with one aspect of the European antiquarian movement of the seventeenth century. Like the humanist movement out of which it developed, antiquarianism was originally text-centered. However, in the course of time the antiquaries became more and more interested in the material culture of the past. This article adopts a comparative approach to the study of what might be called the "three antiquities," classical, Christian, and barbarian, and focuses on the question of evidence, especially on what the (...) scholars of the time considered to be reliable evidence. What is the appropriate degree of abstraction from existing social facts when engaging in normative political theory? Through a focus on American Indian and other indigenous claims over historically expropriated lands, this essay argues that highly abstracted forms of normative analysis can often misunderstand the core moral problems at stake in real cases, and that they can pose moral dangers when they do so. As argued, the hard moral issues involved in indigenous land claims within countries such as Canada and (...) the United States often have far more to do with questions about competing uses for public lands than with abstract property theory as such. The essay argues that normative theorists will often do more social good, and pose fewer dangers, when they pay close attention to the real moral challenges that social actors face on the ground than when they become captured by abstract questions with ambiguous practical importance. Much controversy has existed over the claims of Native Americans and other indigenous peoples that they have a right—based on original occupancy of land, historical transfers of sovereignty, and principles of self-determination—to a political status separate from the states in which they now find themselves embedded. How valid are these claims on moral grounds? -/- Burke Hendrix tackles these thorny questions in this book. Rather than focusing on the legal and constitutional status of indigenous nations within the states now (...) ruling them, he starts at a more basic level, interrogating fundamental justifications for political authority itself. He shows that historical claims of land ownership and prior sovereignty cannot provide a sufficient basis for challenging the authority of existing states, but that our natural moral duties to aid other persons in danger can justify rights to political separation from states that fail to protect their citizens as they should. -/- Actual attempts at political separation must be carefully managed through well-defined procedural mechanisms, however, to foster extensive democratic deliberation about the nature of the political changes at stake. Using such procedures, Hendrix argues, indigenous peoples should be able to withdraw politically from the states currently ruling them, even to the point of choosing full independence. (shrink)

Popper and Miller (1983) have presented an argument purporting to establish the impossibility of inductive probability. Here I discuss critically their characterization of a deductive part of nondeductive support, a point that has not figured centrally in previous responses.

Abstract Noting that the use of modern instruments of war had unpredictable and revolutionary consequences, Morris Janowitz introduced the concept of a ?constabulary force? to show how a professional military in a liberal democratic state might use modern weapons and yet conserve the existing political order. This article explores the meaning of this concept in three ways. First, it examines the strategic assumptions underlying the concept to explain why Janowitz thought it offered an approach to containing the revolutionary consequences of (...) the use of force that was more promising than alternative concepts of military force. Second, it explores the moral implications of the concept (which Janowitz did not do), identifying key moral commitments a constabulary force must meet to sustain a liberal democratic order as it attempts to resolve dilemmas posed by the use of force. Third, it considers in what way these moral commitments are particular to a constabulary force, while yet preserving an approach to the use of force that could be applied across the spectrum of force by military structures of various kinds. While claims for the return of expropriated land by Native Americans and other indigenous peoples are often evaluated using legal frameworks, such approaches fail to engage the fundamental moral questions involved. This essay outlines three justifications for Native Americans to pursue land claims: to regain properties where original ownership has not been superseded, to aid the long-term survival of their endangered cultures, and to challenge and revise the historical misremembering of mainstream American society. The third justification is most controversial. It (...) asserts that understandings of history shape perceptions of the present, and that intensively pursued land claims can provide powerful challenges to inaccurate conceptions of the past. This essay argues that Native Americans are for this reason justified in strategically pursuing land claims that are difficult to justify on other grounds, and closes with some worries about the legitimate role of strategy in political action.
