The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Eight papers are discussed: two concern the management and use of documents available on the World Wide Web, (...) and six apply machine learning techniques to a variety of legal applications. Preference orderings assigned by coherent lower and upper conditional previsions are defined and they are considered to define maximal random variables and Bayes random variables. Sufficient conditions are given such that a random variable is maximal if and only if it is a Bayes random variable. In a metric space preference orderings represented by coherent lower and upper conditional previsions defined by Hausdorff inner and outer measures are given.

Drawing from extensive, eye-opening first-person accounts, No Refuge puts a spotlight on the millions of refugees worldwide who have to leave home but find nowhere to resettle. As political philosopher Serena Parekh argues, this is not just a problem for politicians. The pharmaceutical industry plays an increasingly dominant role in healthcare, raising concerns about “conflicts of interest” on the part of the medical professionals who interact with the industry. However, there is considerable disagreement over the extent to which COI is a problem and how it should be managed. Participants in debates about COI have become entrenched in their views, which is both unproductive and deeply confusing for the majority of medical professionals trying to work in an increasingly commercialized environment. We (...) used a modified meta-narrative review method to analyse debates about COI in the academic and grey literature. We found two Discourse Models: The Critical Discourse Model sees COI in health and biomedicine as a major problem that both can and should be addressed, while the Defensive Discourse Model argues that current efforts to control COIs are at best unnecessary and at worst harmful. Each model is underpinned by profoundly differing views about how society should be organized—in particular whether market forces should be encouraged or curtailed—and how the dangers associated with market forces should be managed. In order to make any headway, academics and policymakers must recognize that these debates are underpinned by profoundly differing worldviews. (shrink)

Are inequalities of income created by the free market just? In this book Serena Olsaretti examines two main arguments that justify those inequalities: the first claims that they are just because they are deserved, and the second claims that they are just because they are what free individuals are entitled to. Both these arguments purport to show, in different ways, that giving responsible individuals their due requires that free market inequalities in incomes be allowed. Olsaretti argues, however, that neither (...) argument is successful, and shows that when we examine closely the principle of desert and the notions of liberty and choice invoked by defenders of the free market, it appears that a conception of justice that would accommodate these notions, far from supporting free market inequalities, calls for their elimination. This book is a philosophical analysis of the ethical treatment of refugees and stateless people, a group of people who, though extremely important politically, have been greatly under theorized philosophically. The limited philosophical discussion of refugees by philosophers focuses narrowly on the question of whether or not we, as members of Western states, have moral obligations to admit refugees into our countries. This book reframes this debate and shows why it is important to think ethically about people who will never (...) be resettled and who live for prolonged periods outside of all political communities. Parekh shows why philosophers ought to be concerned with ethical norms that will help stateless people mitigate the harms of statelessness even while they remain formally excluded from states. We propose a novel, ontological approach to studying mathematical propositions and proofs. By “ontological approach” we refer to the study of the categories of beings or concepts that, in their practice, mathematicians isolate as fruitful for the advancement of their scientific activity (like discovering and proving theorems, formulating conjectures, and providing explanations). We do so by developing what we call a “formal ontology” of proofs using semantic modeling tools (like RDF and OWL) developed by the computer science community. In this (...) article, (i) we describe this new approach and, (ii) to provide an example, we apply it to the problem of the identity of proofs. We also describe open issues and further applications of this approach (for example, the study of purity of methods). We lay some foundations to investigate rigorously and at large scale intellectual moves and attitudes that underpin the advancement of mathematics through cognitive means (carving out investigationally valuable concepts and techniques) and social means (like communication, collaboration, revision, and criticism of specific categories, inferential patterns, and levels of analysis). Our approach complements other types of analysis of proofs such as reconstruction in a deductive system and examination through a proof-assistant. (shrink)

Parental consent poses challenges to needed research with adolescents who identify as lesbian, gay, bisexual, transgender, queer and/or questioning (LGBTQ+) and are at heightened risk for negative health outcomes. Obtaining parental consent in studies focused on LGBTQ+ issues can prove arduous if adolescents have not yet disclosed their identity or have unsupportive guardians. Institutional Review Boards (IRBs) may be hesitant to grant waivers of parental consent, yet research suggests that studies requiring parental consent deter the participation of adolescents who identify (...) as LGBTQ+. In this article, ethical considerations regarding waivers of parental consent in the context of the American Psychological Association’s (APA) general ethical principles are reviewed and recommendations for psychological researchers seeking waivers of parental consent are offered. A vignette is used to demonstrate a question-and-answer guide to help determine if a waiver of parental consent is ethically justified. (shrink)

Does justice require that individuals get what they deserve? Serena Olsaretti brings together new essays by leading moral and political philosophers examining the relation between desert and justice; they also illuminate the nature of distributive justice, and the relationship between desert and other values, such as equality and responsibility.

Contemporary egalitarian theories of justice constrain the demands of equality by responsibility, and do not view as unjust inequalities that are traceable to individuals' choices. This paper argues that, in order to make non-arbitrary determinate judgements of responsibility, any theory of justice needs a principle of stakes , that is, an account of what consequences choices should have. The paper also argues that the principles of stakes seemingly presupposed by egalitarians are implausible, and that adopting alternative principles of stakes amounts (...) to fleshing out the demands of responsibility rather than imposing limits on them. This paper is an exploration of the role of conscience in the justification of human rights. I argue that in both the western tradition of natural rights and the non-western traditions, human rights are justified, in part, because of their appeal to conscience, and not simply because they issue from a divine source or are based on reason. In contrast, contemporary justifications of human rights primarily look for an objective foundation or simply assert the pragmatic importance of human rights as (...) their justification. While there are distinct advantages to this way of arguing, there are also problems, which I will discuss. As an alternative, I outline Arendt's understanding of conscience as the ability to be with and think with one's self as a secular alternative to both a non-secular version of conscience, and the denial of conscience implicit in contemporary theories. Her view of political judgment helps us to understand how conscience can be understood as subjective but not arbitrary. This paper brings Arendt's insights on conscience and judgment to bear on contemporary discourses of human rights. (shrink)

Open Innovation (OI) allows companies to develop innovative solutions more effectively, with lower costs and risks. The economic benefits of OI have been thoroughly investigated in prior research. More recent literature suggests that OI can help companies also improve their Corporate Social Responsibility (CSR) performance. Contributions on how open innovation can help companies improve their CSR performance, however, are fragmented and lack strong theoretical foundations. In this study, we perform a systematic literature review to synthesize the main findings and provide (...) a theoretical framework to explain how companies can simultaneously improve OI and CSR through the management of relationships with stakeholders. The framework is then used to investigate how OI projects favour the achievement of CSR objectives, by referencing the 17 United Nations (UN) Sustainable Development Goals (SDGs). Results show that the stakeholders' theory can be used to explain the connection between OI and CSR performance. We also find that companies can collaborate with different stakeholders' categories to achieve a variety of CSR goals. We suggest that companies adopt a long-term perspective and explicitly include sustainability objectives in their open innovation strategy to enhance their position as reliable partners and elicit favourable responses from the environment. Results also allow us to provide some suggestions for future research. First, we point out that literature currently lacks conceptual studies to help formalize the connection between OI and CSR. Secondly, we observe that the influence of some stakeholders' categories, such as governments and research organizations, on companies' OI and CSR efforts remains under-investigated. (shrink)

Agostino d’Ippona è stato un punto di riferimento costante nella produzione filosofica arendtiana, a partire dalla dissertazione di dottorato del 1928, intitolata Il concetto d’amore in Agostino, fino alle ultime pagine scritte prima di morire, e dedicate alla trattazione della volontà. Il segno più evidente di questo rapporto è costituito da una frase del De civitate Dei, « initium ut esset creatus est homo, ante quem nullus fuit» sulla quale Hannah Arendt fonda il proprio concetto di libertà, intesa come la (...) capacità dell’uomo di “essere” un nuovo inizio. Attraverso questo concetto H. Arendt tenta di restituire all’uomo il senso della propria irriducibile unicità, contro i tentativi del potere di rendere ogni individuo “superfluo”. A monte dell’interesse per Agostino vi sono, però, anche ragioni di carattere biografico, se è vero che la donna conobbe Agostino attraverso la mediazione, umana e intellettuale, del suo maestro Martin Heidegger. In its broadest sense, globalization refers to the economic, social, cultural, and political processes of integration that result from the expansion of transnational economic production, migration, communications, and technologies. This article outlines the ways in which predominantly Western feminist philosophers have articulated and addressed the challenges associated with its economic and political dimensions.

Distributive justice has come to the fore in political philosophy: how should we arrange our social and economic institutions so as to distribute benefits and burdens fairly? Thirty-two leading figures from philosophy and political theory present specially written critical assessments of the key issues in this flourishing area of research.

Infinite time Turing machines represent a model of computability that extends the operations of Turing machines to transfinite ordinal time by defining the content of each cell at limit steps to be the lim sup of the sequences of previous contents of that cell. In this paper, we study a computational model obtained by replacing the lim sup rule with an ‘eventually constant’ rule: at each limit step, the value of each cell is defined if and only if the content (...) of that cell has stabilized before that limit step and is then equal to this constant value. We call these machines weak infinite time Turing machines. We study different variants of wITTMs adding multiple tapes, heads, or bidimensional tapes. We show that some of these models are equivalent to each other concerning their computational strength. We show that wITTMs decide exactly the arithmetic relations on natural numbers. (shrink)

En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

Resumen: El presente trabajo intenta analizar los elementos críticos a la base de aquella suerte de prescripción que Edward Said formulara a los intelectuales bajo la célebre consigna de “decir las verdades al poder”, esto es, de interpelar públicamente al poder -político, económico, religioso, militar- frente a toda evidencia de injusticia, inconsistencia o turbia manipulación en su operar. En tanto tal, y a partir de nuestra lectura de Said, delimitamos cinco dilemas que el intelectual ha de resolver, en tanto requisitos (...) para decir las verdades al poder: orientación intramundana versus extramundana, rol profético versus sacerdotal, libertad universalista versus organicidad, racionalidad sustantiva versus instrumental y arrojo versus temor. Se comentan las implicaciones de estos dilemas a la luz de los desafíos y oportunidades que las sociedades contemporáneas -en particular, las latinoamericanas- presentan para el rol del intelectual.: This work analyzes the critical foundations of that quasi-rule posed by Edward Said to intellectuals through the famous motto “speaking truth to power”, that is, of publicly interpellating to power -political, economic, religious, military- whenever its exercise may involve injustice, inconsistency or underhanded manipulation. So, according to our interpretation of Said’s work, we identify five dilemmas the intellectual should resolve in order to be able to speak truth to power: a worldliness orientation versus an otherworldliness one, a prophetic role versus a priestly one, universalist freedom versus organic compromise, a substantive rationality versus an instrumental one, and courage versus fear. Involvements of these dilemmas are discussed according to the challenges and opportunities posed by current societies -in particular, the Latin American ones- to the intellectual’s role. (shrink)

Research into television's ethical value has mostly focused on scandal genres, such as Big Brother, Jersey Shore, and Jerry Springer. Only recently have researchers started to explore television's moral content with a broader focus. In this study we explore and describe the types of morality and moral content of a night of Dutch prime time television with an open and inductive approach through a qualitative content analysis. Our results revealed 13 types of morality and a basic differentiation between morals that (...) react on violations and transgressions, focusing on restricting behavior, and morals that are focused on ideals and values and stimulate social behavior. Lastly, we differentiated three moral meta-themes that permeate all genres, as well as six moral themes that arose only in specific genre-clusters. (shrink)

The compensatory desert argument is an argument that purports to justify inequalities in (some) incomes generated by a free labour market. It holds, first, that the principle of compensation is a principle of desert; second, that a distribution justified by a principle of desert is just; and third, that (some) rewards people reap on a free labour market are compensation for costs they incur. It concludes that therefore, a distribution of (some) rewards generated by a free labour market is just. (...) In this chapter I criticise the first two premises of this argument. I argue that the principle of compensation is not a principle of desert (sections 3 and 4), and that a distribution of deserved compensatory payments may be unjust (sections 5 and 6). Before developing my critique of the compensatory desert argument, I start by illustrating further that argument in the version of it which has been defended by Julian Lamont (section 1), and to dispel two objections that have been moved against the view that compensation is a principle of desert. Phenomenological psychology has typically avoided the "importation" of such concepts as social class from sociology.Within the epoche, such terminology is bracketed on the grounds that it brings with it excess theoretical baggage and threatens the return to experience in itself. Yet, in uncovering the lifeworld of university students who—in what in Britain is still predominantly a preserve of the privileged—come from relatively economically disadvantaged homes, "class" or some cognate concept is found to be necessary to capture the range of modes (...) of alienation and disjunction experienced. Following Casey's discussion of the way in which Bourdieu's notion of habitus relates to Merleau-Ponty's description of the interpenetration of the natural and the cultural in the lived body, social class is shown to bring together students' accounts of their multi-faceted sense that "University is not for the likes of us"—encompassing issues of identity, sociality, and spatio-temporal dislocation. This article explores strategies of cultural representation in the production of Gurinder Chadha, a British director of Sikh origin. Chadha’s work is located in what Marie Louise Pratt defines as ‘contact zones’, negotiating between US, European and Indian audiences. The result is a directing style that puts together ‘East’ and ‘West’, Bollywood and Hollywood, in an in-between space that has been radically reconfigured through hybridization. This happens in particular through her use of music and soundtrack, from the documentary I’m British (...) but..., up to the recent Bend It Like Beckham and Bride and Prejudice. Here, many and diverse musical languages are put together through the representational strategies of parody and kitsch, deconstructing the idea of cultural identity in the very gesture that creates it. A implementação e o uso das Tecnologias da Informação e da Comunicação na vida em geral, e aqui com destaque nas esferas do mundo do trabalho e da educação, têm acarretado mudanças significativas na vida das pessoas e nos cenários e estruturas sociais contemporâneos. Na pós-graduação essas mudanças vêm atingindo todos os envolvidos no que diz respeito à produção e veiculação do conhecimento e à necessidade de defrontar-se qualificadamente com o redimensionamento espácio-temporal proporcionado pela inserção das TIC nos processos de (...) estudo e trabalho. Neste artigo, decorrente de uma pesquisa vinculada a um Programa de Pós-graduação e realizada com doutorandos em Educação de uma universidade pública, analisamos como estes relacionam a categoria tempo com o uso das TIC para fazer frente ao desafio do processo do doutorado no contexto atual. Por meio de entrevistas com os participantes e à luz da análise de conteúdo, identificamos que os doutorandos estão adaptando-se à lógica do denominado produtivismo acadêmico, embora muitas vezes sentindo-se paralisados frente às exigências induzidas pelos órgãos de avaliação e fomento da PG. E nesse sentido, paradoxalmente afirmam encontrar nas TIC um importante aliado para a consecução do doutoramento, embora perpassado pela intensificação do tempo. Além disso, o próprio redimensionamento de tempos e espaços na consecução do doutoramento e no processo de pesquisa e escrita da tese com a mediação das TIC configura-se como uma “faca de dois gumes”, cujas contradições são inerentes ao modelo de regulação e avaliação da PG no Brasil. Finalmente, com base nos depoimentos dos entrevistados e nas relações entre produtividade, intensificação do tempo e mediação tecnológica nesse contexto da PG, questionamos a respeito da possibilidade de resgate da perspectiva omnilateral nesse processo formativo de futuros doutores. The aim of this paper is to present the activities and research methodologies of CTL, a laboratory of the Scuola Normale Superiore of Pisa, founded and directed by Lina Bolzoni. CTL’s objective is to investigate the complex structure of relationships between the linguistic and the figurative code in literary tradition, paying particular attention to the XVth, XVIth and XVIIth centuries and using information technologies both as an auxiliary research tool and as a medium for scientific dissemination. Here I shall be (...) discussing the Centre’s digitalization projects, and in particular the project concerned with the Orlando Furioso and its remediation into images. This project, active since 2007, is, I believe, particularly representative of the progressive implementation within CTL of both traditional and computer-related methodologies in the planning of digital collections dedicated to words and images.
