This article investigates relationships between countries' legal traditions and their quality of life as measured by a number of widely reported social indicators; in so doing it also offers a critique of a highly influential body of work which is widely cited in the literatures of corporate governance, economics and finance. That body of work has shown, inter alia, statistically significant relationships between legal traditions and various proxies for investor protection. We show statistically significant relationships between legal traditions and various (...) proxies for societal health. Our comparative evidence suggests that the interests of investors are not congruent with the interests of wider society, and that the criteria for judging the effectiveness of approaches to corporate governance should be broadened. A comprehensive guide to scriptural sources and authors, translations and critical editions of texts, and books and articles on Yogacara and related topics.

This paper offers a brief guide to implementation research and some of the conceptual and methodological issues it raises. In the course of reviewing investigations of the import of aspects of the 1988 Education Reform Act, it also considers the issues posed for education policy studies in a context where the 'centre' is connected to a dispersed and differentiated periphery.

The minimum-uncertainty states for systems with many degrees of freedom are investigated. The limiting situation, relevant to the electromagnetic field, is discussed and it is pointed out that the states that minimize Δp Δq do not tend to the coherent states. These latter, including the vacuum state, are minimum-uncertainty states for the transverse electric and magnetic fields. In an appendix a direct method to obtain the wave functional for the vacuum is presented.

This article focuses on the three natures (_trisvabhāva_) or three characters (_trilakṣaṇa_) doctrine as described in Indian Yogācāra treatises. This concept is fundamental to Yogācāra epistemology and soteriology, but terminology employed by contemporary buddhologists misconstrues and misrepresents some of its most important features, particularly with regard to the ‘ultimately real nature’ (_pariniṣpanna-svabhāva_), which is equated with terms that connote ultimate reality like ultimate truth (_paramārtha_), emptiness (_śūnyatā_), and reality limit (_bhūta-koṭi_), and which is described as a ‘purifying object of observation’ (...) (_viśuddhālambana_) that facilitates insight when properly understood by meditators. The article discusses how it is described in a range of Yogācāra treatises and compares this with how it has been conceived in academic studies of Indic Yogācāra literature. (shrink)

Construal-level theory emphasizes that representing events at greater spatial, temporal, social, or hypothetical distance results in processing information at high construal levels (more conceptual, abstract). We posit that psychological distance and construal level are somewhat separable constructs, and can have different effects on emotion, and therefore, emotion regulation. We argue that psychological distance influences emotional appraisal, such that increasing distance results in lower emotion intensity, which can be leveraged to down-regulate emotions. However, we consider construal level a mindset, which can (...) occur with either high or low psychological distance. Furthermore, we argue that compared with psychological distance, construal level has a more nuanced relationship with emotion, and changing construal level for the purpose of changing emotion also requires considering the construal level of one's emotion-regulation goals. The renowned philosopher John Searle reveals the fundamental nature of social reality. What kinds of things are money, property, governments, nations, marriages, cocktail parties, and football games? Searle explains the key role played by language in the creation, constitution, and maintenance of social reality. We make statements about social facts that are completely objective, for example: Barack Obama is President of the United States, the piece of paper in my hand is a twenty-dollar bill, I got married in London, (...) etc. And yet these facts only exist because we think they exist. How is it possible that we can have factual objective knowledge of a reality that is created by subjective opinions? This is part of a much larger question: How can we give an account of ourselves, with our peculiar human traits DS mind, reason, freedom, society - in a world that we know independently consists of mindless, meaningless particles? How can we account for our social and mental existence in a realm of brute physical facts? In answering this question, Searle avoids postulating different realms of being, a mental and a physical, or worse yet, a mental, a physical, and a social. There is just one reality: Searle shows how the human reality fits into that one reality. Mind, language, and civilization are natural products of the basic facts of the physical world described by physics, chemistry and biology. Searle explains how language creates and maintains the elaborate structures of human social institutions. These institutions serve to create and distribute power relations that are pervasive and often invisible. These power relations motivate human actions in a way that provides the glue that holds human civilization together. Yet we know we exist in a universe that consists of mindless, meaningless, unfree, nonrational, brute physical particles. How can we resolve the conflict between these two visions? Numerous reports have noted decreasing numbers of antibiotic approvals. To determine the context for this decline, we examined all new molecule entities (NMEs) and new biologic licenses (NBLs) approved by the FDA from 1980–2009, and compared approval rates of the 61 approved antibiotics to trends in other drug classes. We also tracked withdrawals of approved drugs and found more withdrawals for antibiotics than other drug classes. After adjusting for drugs subsequently withdrawn, the record for antibiotic innovation is less dire than (...) previously reported. We also report problems with the quality of the approved antibiotics studied. Future policies providing incentives for new antibiotic development should not be based on simple numerical targets and key provisions should ensure appropriate quality as well as quantity of antibiotic drug innovation. Antibiotic use triggers evolutionary and ecological responses from bacteria, leading to antibiotic resistance and harmful patient outcomes. Two complementary strategies support long-term antibiotic effectiveness: conservation of existing therapies and production of novel antibiotics. Conservation encompasses infection control, antibiotic stewardship, and other public health interventions to prevent infection, which reduce antibiotic demand. Production of new antibiotics allows physicians to replace existing drugs rendered less effective by resistance.In recent years, physicians and policymakers have raised concerns about the pipeline for new antibiotics, pointing (...) to a decline in the number of antibiotics approved since the 1980s. This trend has been attributed to high research and development costs, low reimbursement for antibiotics, and regulatory standards for review and approval. Professional societies and researchers around the world have called for renewed emphasis on antimicrobial stewardship, while also supporting antibiotic research and development through grants, changes to intellectual property laws to extend market exclusivity periods, and modification of premarket testing regulations to reduce antibiotic development time and expenses. In it, Mill argues for a limitation of the power of government (...) and society over the individual, and defines liberty as an absolute individual right. According to the still much debated 'harm principle', power against the individual can only be exercised to prevent harm to others. The concept of practical knowledge is central to G.E.M. Anscombe's argument in Intention, yet its meaning is little understood. There are several reasons for this, including a lack of attention to Anscombe's ancient and medieval sources for the concept, and an emphasis on the more straightforward concept of knowledge "without observation" in the interpretation of Anscombe's position. This paper remedies the situation, first by appealing to the writings of Thomas Aquinas to develop an account of practical knowledge as a distinctive (...) form of thought that "aims at production" of things that lie within an agent's power; and then by showing how this Thomistic understanding of practical cognition seems to have been Anscombe's, too. Having done this, I question whether the thesis that agential knowledge is practical knowledge entails that an agent always has non-observational knowledge of what she is intentionally doing. I answer "Not": Anscombe's claims to the contrary rest on a misleading assimilation of human beings' finite agency to that of an infinite agent like God. (shrink)

Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

This paper addresses a fundamental question in folk metaphysics: how do we ordinarily view human agency? According to the transcendence account, we view human agency as standing outside of the causal order and imbued with exceptional powers. According to a naturalistic account, we view human agency as subject to the same physical laws as other objects and completely open to scientific investigation. According to exceptionalist naturalism, the truth lies somewhere in between: we view human agency as fitting broadly within (...) the causal order while still being exceptional in important respects. In this paper, I report seven experiments designed to decide between these three competing theories. Across a variety of contexts and types of action, participants agreed that human agents can resist outcomes described as inevitable, guaranteed, and causally determined. Participants viewed non-human animal agents similarly, whereas they viewed computers, robots, and simple inanimate objects differently. At the same time, participants judged that human actions are caused by many things, including psychological, neurological, and social events. Overall, in folk metaphysics, human and non-human animals are viewed as exceptional parts of the natural world. (shrink)

Ever since humankind raised its head toward the heavens in search of universal understanding and spiritual fulfilment, wars, pogroms, persecution, prejudice, and contempt have been the means of resolving the many and varied disagreements that have arisen over matters religious. In his Letter Concerning Toleration, Locke offers a compelling plea for freedom of conscience and religious expression. He outlines the limits of social and political incursion into the realm of personal belief or non-belief, discusses the dangers of mixing church and (...) state, and strikes hard at those who would use the power of the state to fulfil religious or political goals. Rational persuasion is always to be encouraged in the hope that wayward souls may find a moral direction in life, but the use of force in such matters is unwarranted and unacceptable. Locke also addresses the question of denominational infighting and relations among the major religions. Talk of heresy and schism should be set aside in favour of understanding and co-operation to achieve mutually desirable social ends. (shrink)
