In this paper I provide a speech act analysis of microaggressions. After adopting a notion of microaggressions found in the political philosophy literature, I provide an account of both the illocutionary force and perlocutionary effects of microaggressions. I show that there are two parts to microaggressions’ illocutionary force: (i) the general Austinian linguistic conventions; (ii) socio-political conventions that change the speech act into a microaggression. Despite the varied speech acts that can count as microaggressions, I identify a unique perlocutionary effect (...) common to all, perlocutionary frustration, in which the recipient of a microaggression is frustrated or inhibited from addressing the harms that microaggressions cause. The recipient is not necessarily silenced insofar as they are prevented from performing certain illocutionary acts. Instead, the illocutionary acts do not have their intended perlocutionary effects. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

The thesis of the present volume is critical and dual. (2) Almost all philosophy and sci ences of man share the erroneous work ethic which is the myth of man's evil nature - the myth of the beast in man, the doctrine of original sin. To mediate or to compromise between the first view of human nature as good with the second view of it as evil, sociologists have devised a modified utilitarianism with deferred gratification so called, and the theory of the evil of artificial competition (capitalist and socialist alike) and of keeping up with the Joneses. Now, the mediation is not necessary. For, the polarization makes for abstract errors which are simplistic views of rationality, such as reductionism and positivism of all sorts, as well as for concrete errors, such as the disposition to condemn repeatedly those human weaknesses which are inevitable, namely man's inability to be perfectly rational, avoid all error, etc. , thus setting man against himself as all too wicked. This book presents an analysis of masculinity construction in a large corpus of women’s magazines, adopting a feminist Critical Stylistic approach to reveal how men are talked about and ‘sold’ to women as part of a successful performance of hegemonic femininity. This novel approach identifies women’s magazines as sites of ‘lad culture’ that perpetuate ideologies more commonly associated with the ‘laddism’ of male-targeted media. It examines how stereotypical images of men as naturally aggressive and obsessed with sex are promoted, as (...) well as considering some of the ways in which women’s magazines contribute to the social construction of normative understandings of gender and sexuality more broadly. Jennifer Hornsby has defended the Reasons-Knowledge Thesis : the claim that \-ing because p requires knowing that p, where the ‘because’ at issue is a rationalising ‘because’. She defends by appeal to the thought that it provides the best explanation of why the subject in a certain sort of Gettier case fails to be in a position to \ because p. Dustin Locke and, separately, Nick Hughes, present some modified barn-façade cases which seem to constitute counterexamples to and undermine Hornsby’s (...) way of motivating it by rendering their alternative Reasons-Explanation Thesis a better explanation of Hornsby’s datum. This paper defends and Hornsby’s argument for it against those objections. First, I point out that their supposedly intuitive verdict about the relevant barn-façade cases is not as intuitive as they think. Second, I point out that even if we share the intuition: we have strong reason to doubt the verdict anyway. And finally, I point out that since is independently implausible, the two problems can be tackled anyway. (shrink)

The case of a dying baby with is one of the most difficult in pediatric ethics. I have been involved in several such cases and they are extremely challenging for all parties, especially the parents. With the luxury of being an I will comment on this case from the perspective of when it first began and at the end point described in the narrative.

According to standard comparativist views, death is bad insofar as it deprives someone of goods she would otherwise have had. In The Ethics of Killing, Jeff McMahan argues against such views and in favor of a gradualist account according to which how bad it is to die is a function of both the future goods of which the decedent is deprived and her cognitive development when she dies. Comparativists and gradualists therefore disagree about how bad it is to die at (...) different ages. In this paper I examine two prominent criticisms of gradualism and show that both misconstrue McMahan. I develop a related criticism that seems to show that a gradualist cannot coherently relate morbidity and mortality. This criticism also fails, but has an instructive implication for how policy-makers setting priorities for health care investments should regard choices between life-saving interventions and interventions against non-fatal diseases in the very young. Applications of artificial intelligence/machine learning in health care are dynamic and rapidly growing. One strategy for anticipating and addressing ethical challenges related to AI/ml for health care is patient and public involvement in the design of those technologies – often referred to as ‘co-design’. Co-design has a diverse intellectual and practical history, however, and has been conceptualized in many different ways. Moreover, AI/ml introduces challenges to co-design that are often underappreciated. Informed by perspectives from critical data studies and critical digital (...) health studies, we review the research literature on involvement in health care, and involvement in design, and examine the extent to which co-design as commonly conceptualized is capable of addressing the range of normative issues raised by AI/ml for health care. We suggest that AI/ml technologies have amplified and modified existing challenges related to patient and public involvement, and created entirely new challenges. We outline three pitfalls associated with co-design for ethical AI/ml for health care and conclude with suggestions for addressing these practical and conceptual challenges. (shrink)

The Practice of Value explores the nature of value and its relation to the social and historical conditions under which human agents live. This research explores the impact of media engagement on the identity perceptions of the Aeta Ambala, an indigenous group in the Philippines, particularly after the 1991 Mt. Pinatubo eruption. This catastrophic event led to significant displacement and cultural shifts for the Aeta, who were forced to adapt to urban lifestyles. The study focuses on the differences in identity perceptions between the older and younger generations, with the former holding onto pre-eruption cultural norms and the latter aligning more with urban and (...) resettlement community cultures. Employing in-depth interviews and focus group discussions, the study finds that media representations often negatively portray the Aeta Ambala, leading to discrimination and altering self-perception. Despite this, the community maintains a strong sense of ethnic identity, viewing it as an immutable aspect of their heritage. Media engagement is seen as inevitable for staying informed, particularly in emergencies, but it also influences perceptions of the outside world and reshapes cultural and ethnic identity. Younger generations, more engaged with media, tend to adopt external beauty standards and lifestyles, leading to early marriages and cultural indifference. There is also a noted mistrust towards media organizations due to exploitation concerns. In conclusion, the study highlights the complex relationship between media interaction and self identification within the Aeta Ambala community, suggesting that while media engagement alters perceptions and behaviors, the core Aeta Ambala culture remains strong and resilient. Since 1998, several attempts have been made to reform the existing mental health legislation - the Mental Health Act 1983. However, all efforts thus far have been resoundingly rejected by mental health charities, psychiatrists and related professions. Following the Government's decision to abandon the draft Mental Health Bill in March 2006, plans to introduce new legislation designed to amend the existing 1983 Act have been published. This shorter bill was introduced before Parliament in November 2006. The amendments focused on six (...) key policy areas including supervised community treatment, the nearest relative, the definition of mental disorder and detention criteria. It is also intended that the Mental Capacity Act 2005 will be amended to bridge the present 'Bournewood' gap. (shrink)

We argue that there is a conflict among classical theism's commitments to divine simplicity, divine creative freedom, and omniscience. We start by defining key terms for the debate related to classical theism. Then we articulate a new argument, the Aloneness Argument, aiming to establish a conflict among these attributes. In broad outline, the argument proceeds as follows. Under classical theism, it's possible that God exists without anything apart from Him. Any knowledge God has in such a world would be wholly (...) intrinsic. But there are contingent truths in every world, including the world in which God exists alone. So, it's possible that God contingently has wholly intrinsic knowledge. But whatever is contingent and wholly intrinsic is an accident. So, God possibly has an accident. It is a terrible thing to let a child die against the deeply held and clearly expressed view of the child's parents. Yet it could be claimed that there are some conditions so burdensome that it may also be a terrible thing to deny a child the escape of death. The focus of this piece is on three ethical issues relating to withholding and withdrawal of treatment in a neonatal and paediatric context. The first is whether there are other interests (...) that should be considered as well as those of the child. The second is how we should think about the interests of the child. The third is a set of issues raised by cases where the medical team and the family reach different conclusions about what it is best to do. Joseph Margolis, known for his considerable contributions to the philosophy of art and aesthetics, pragmatism, and American philosophy, has focused primarily on the troublesome concepts of culture, history, language, agency, art, interpretation, and the human person or self. For Margolis, the signal problem has always been the same: how can we distinguish between physical nature and human culture? How do these realms relate? _The Cultural Space of the Arts and the Infelicities of Reductionism_ identifies a conceptual tendency that can (...) be drawn from the work of the twentieth century's best-known analytic philosophers of art: Arthur Danto, Richard Wollheim, Kendall Walton, Nelson Goodman, Monroe Beardsley, Noël Carroll, and Jerrold Levinson, among others. Through his analysis, Margolis sets out to retrieve an adequate picture of the essential differences between physical nature and human culture—particularly through language, history, meaning, significance, the emergence of the human self or person, and the essential features of human life—all to explain how such difference bears on our perception of paintings and literature. A good therapeutic relationship in mental health services is a predictor of positive clinical outcomes for people who seek help for distressing experiences, such as voice hearing and paranoia. One factor that may affect the quality of the therapeutic relationship and raises further ethical issues is the impact of the clinical encounter on users’ sense of self, and in particular on their sense of agency. In the paper, we discuss some of the reasons why the sense of epistemic agency may (...) be especially fragile in young people with unusual experiences and beliefs. We argue that it is important to identify and avoid behaviours that can undermine young people’s contributions as epistemic agents in the clinical encounter. (shrink)

Particularism's model of explanation is challenged on the ground that a sensible intelligibility principle requires that there must be an explanation for the difference between a good and a bad action. Raz is concerned with what it is to be guided by reason, as well as with the results of the fact that reason can often undermine particular outcomes. What determines the moral status of an action must extend beyond what the agent's reason for acting is. Sartre’s Critique of Dialectical Reason ranks with Being and Nothingness as a work of major philosophical significance, but it has been largely neglected. The first volume, published in 1960, was dismissed as a Marxist work at a time when structuralism was coming into vogue; the incomplete second volume has only recently been published in France. In this commentary on the first volume, Joseph S. Catalano restores the Critique to its deserved place among Sartre’s works and within philosophical discourse as (...) a whole. Sartre attempts one of the most needed tasks of our times, Catalano asserts—the delivery of history into the hands of the average person. Sartre’s concern in the Critique is with the historical significance of everyday life. Can we, he asks, as individuals or even collectively, direct the course of our history? A historical context for our lives is given to us at birth, but we sustain that context with even our most mundane actions—buying a newspaper, waiting in line, eating a meal. In looking at history, Sartre argues, reason can never separate the historical situation of the investigator from the investigation. Thus reason falls into a dialectic, always depending upon the past for guidance but always being reshaped by the present. Clearly showing the influence of Marx on Sartre’s thought, the Critique adds the historical dimension lacking in Being and Nothingness. In placing the Critique within the corpus of Sartre’s philosophical writings, Catalano argues that it represents a development rather than a break from Sartre’s existentialist phase. Catalano has organized his commentary to follow the Critique and has supplied clear examples and concrete expositions of the most difficult ideas. He explicates the dialogue between Marx and Sartre that is internal to the text, and he also discusses Sartre’s Search for Method, which is published separately from the Critique in English editions. This chapter explores the foundation and content of the duty to respect persons. The authors argue that it is best understood as a duty to recognize people’s rights. Respect for persons therefore has specific implications for how competent and non-competent persons ought to be treated in research. For competent persons it underlies the obligation to obtain consent to many research procedures. The chapter gives an analysis of the requirements for obtaining valid consent. There is a growing body of empirical evidence which shows that infants and non-human primates have the ability to represent the mental states of other agents, i.e. that they possess a Theory of Mind. We will argue that this evidence also suggests that infants and non-human primates possess the concept of truth, which, as we will explain, is good news for primitivists about truth. First, we will offer a brief overview of alethic primitivism, focusing on Jamin Asay’s conceptual version of (...) the view. Next, we will survey relevant work on Theory of Mind which indicates that children younger than two and non-human primates are able to attribute false beliefs. Then, we will bring these false-belief data to bear on Asay’s form of primitivism, arguing that the data support two of the four distinctive theses of this view and offering some remarks about the empirical evaluability of the two remaining theses. We hope that our discussion will help to bridge the gap between psychological and philosophical inquiry and that it will encourage further empirical research on the cognitive significance of the concept of truth for humans and other thinking creatures.
